City Council Meeting

May 14, 2012

The regular Minburn City Council meeting was called to order at 7:00p.m. at City Hall. Mayor Michael Pace presided. Council members present were: Maggie Buscher, Jordan Lint, Donald Peel and Phyllis Moss. David Baccus was absent. Attorney Beverly Wild was also present.

Agenda: The order of several items on the agenda was changed. Move Lint, second Moss to approve amended agenda. . All Ayes. Motion carried.

Minutes: Move Lint, second Moss to approve minutes of 4/9/12. All Ayes. Motion carried.

Bills: Move Lint, second Moss to approve bills as presented. All Ayes. Motion carried.

Public comments: Jon West Sr. and Stacey Hartman presented information regarding a proposed Confined Animal Feeding Operation to be located northeast of Minburn. They encouraged everyone to attend the Dallas County Supervisors meeting on May 15.

Planning and Zoning: Gaylynn Stajcar, Dave Rolfe and Dave Ackerlund from the Planning and Zoning Commission were present. Stajcar explained the draft color-coded map of the city they have developed for zoning classifications, including residential, commercial, etc. Discussion was held on parking, truck routes, signs, building permits and changes to the code.

Lagoon: Scott Schmoker, an engineer at Kirkham and Michael, will replace Mark Seip on the wastewater treatment system. Russ Lemke will continue working on the sewer system / lagoon project as well. Lemke and Attorney Wild will work together on the language for the easements. On Monday, May 21st the engineer, an electrical consultant and some of the council members will walk around town and look at the council member’s houses to identify what problems may be encountered when hooking up the electrical box and grinder pumps.

Water treatment Plant: The site approval from the DNR will be requested after the Community Development Block Grant (CDBG) is formally awarded.

Water curb stop / water line assessment: Lemke and Schmoker evaluated the non-compliant curb stop valves at 303 North and 615 Fourth and submitted two options. The first option is estimated to cost $60,900, the estimate for the second option is $64,680. The council decided to discuss the options further and include short term fixes and/or rolling it into the upcoming sewer improvements.

Depot: John Koester is still putting together the cost for the consultant and will try to have something ready by May 21. He also is working towards getting the rest of the contracts signed by the sub consultants for the project. Koester said they will be ready to start work as soon as the DOT approves the contracts with Koester and the sub consultants. The next major step is talking to the bank about a grant anticipation loan and additional funds to fund the project until the tax credit monies comes through.

School reuse: The Phase 1Environmental Study and the lead and asbestos inspection are completed. Impact7G is working on the cost estimate to remove the asbestos from the school building.

Evaluation and bids for cutting down trees: Discussion on the language in the Ordinance Code about the city’s responsibility to cut down trees in the parking area. Move Lint, second Moss to hire Walton Tree and Stump Removal to cut down trees at 3rd and Chestnut. Peel Nay, Baccus absent and Buscher abstained. Motion failed.

Parks: Peel stated the bandstand at Meek Park and shelter at Rogers Park needs painted.

Local Option Sales Tax: Move Lint, second Buscher to adopt Resolution 2012-05 REQUESTING PERMISSION FROM OTHER COUNTY CITIES AND BOARD OF SUPERVISORS TO APPROVE PLACEMENT OF A PUBLIC MEASURE ON A GENERAL OR SPECIAL ELECTION BALLOT PROVIDING FOR A LOCAL SALES AND SERVICE TAX TO BE IMPOSED IN THE CITY OF MINBURN, IOWA. All Ayes. Motion carried.

Codification: Clerk reported there were two options for recodification of the ordinances. Option 1 would just supplement the ordinances and cost $850. Option 2 would involve a comprehensive update of the entire code book for $4,000. Council decided on option 2 and to prepay the balance before June 30th since the cost is already budgeted in the current year’s budget. They also directed the clerk to contact Simmering & Cory to make sure the mayor and council will have an opportunity to review the new code prior to it being approved and report back at the May 21 meeting.

New contract for mosquito spraying of bike trail: Clerk reported it will cost an additional $500 to have the bike trail sprayed for mosquitoes. Move Lint, second Peel to enter into a new contract with Mosquito Control of Iowa for $2,550 which includes spraying of the town and bike trail. All Ayes, Motion carried.

Utility Billing Clerk applications: Due to the late hour, reviewing the applications was tabled until the next council meeting on May 21st.

Adjournment: Move Lint, second Moss to adjourn. All Ayes. Motion carried. Meeting was adjourned at 10:30 p.m.
