RIDING LESSON CONTRACT

ADULT STUDENT CLAUSE:

This Agreement, date the ______day of ______, 20_____ is made between TNC Equine Center (STABLE) and ______(STUDENT). These parties warrant that they have the right to enter into this AGREEMENT.

MINOR STUDENT CLAUSE:

I, ______, (Parent/Guardian) have contracted with TNC Equine Center on the ______day of ______, 20_____ to give ______(rider’s name) riding lessons. These parties warrant that they have the right to enter into this AGREEMENT.

Payment/Information:

  1. Riding Lessons are to be paid at the beginning of each lesson. Checks should be made payable to Christy Stermer (Stable Manager). Please place all cash in an envelope with your name on it so as not to confuse your payment with another student’s payment. Cash and checks can be placed in the payment box inside the barn. There will be a $35 return check fee on all returned checks. An extra $10 will be charged for all late payments. Riding lessons are charged at the following rates:

Private, 30-minutes (ages 3-5) $30

1 hour private or group lesson on your own horse $40

1 hour private or group lesson on one of our horses $45

  1. A lesson is 60 minutes in length with a maximum of 3 riders and is to consist of grooming, tacking up, mounting each rider, tack adjustments, exercises while mounted, cool down time, dismounting, and untacking. More advanced students may be permitted at the instructor’s discretion to arrive early to tack up.
  2. Any lesson cancelled by the Riding Instructor or Barn Manager do not require payment.
  3. All lessons cancelled by the student must be paid for except:
  4. With a valid medical excuse from the doctor for the student.
  5. Proof of death in the family.
  6. One week vacation per year.
  7. Cancellations with more than 24 hour notice that are rescheduled within one week of the cancellation at the discretion of the riding instructor and their availability.
  8. Any rider who does not comply with the payment policy will lose their riding spot.
  9. I understand that TNC Equine Center reserves the right to substitute a riding instructor or Barn Manager in the event that their regularly scheduled riding instructor is unable to be present at the lesson.
  10. If you are late for a lesson, your ride time will not be extended. If riding in a group lesson and you are unable to tack your own horse and you are late, you will not be permitted to ride and payment will be required.
  11. I understand that proper attire must be worn for riding lessons, which is to be pants, shirt, shoes/boots with at least a half-inch heel, and an ASTM/SEI approved riding helmet that fits properly with an attached harness.
  12. I further accept that TNC Equine Center’s Riding Instructor or Barn Manager reserves the right to release a rider due to unsafe situations, physical stress to the rider resulting from riding, and/or any safety/medical problems that may arise.

Important areas used during riding lesson:

§  Parents are strongly encouraged to watch their children’s riding lesson. If you do not stay, please be on time picking your child up at the end of the lesson.

§  Please do not use this time to discuss situations with the Riding Instructor. Riding Instructors and volunteers must stay focused on the current lesson for safety reasons. Please call the Riding Instructor outside of lesson time for all questions and concerns that you may have or fill out a suggestion/comment card and someone will call you to discuss your questions or concerns. The Riding Instructor has other lessons scheduled after your lesson and can not be discussing issues during lesson time.

§  Please do not talk with your children during their lesson. It not only distracts your child and the other children in the lesson.

Arrival to Lesson:

§  Do not drive or park on the grass.

§  If the previous lesson is in progress or dismounting, please do not enter the ring to start your lesson.

§  Riders who are permitted to tack up their horse prior to lesson should remain unmounted in the barn with their tacked up horse until the previous lesson returns to the barn to untack.

§  Riders who are not permitted to tack up their horse prior to lesson should wait in the barn area for the Instructor to help get your horse tacked up.

§  The only people who are to be in the arena are the Instructors, volunteers, and riders that are getting ready to ride in current lesson.

§  If you need to talk to the Riding Instructor about medical or physical problems which may have a safety implication for the current lesson, please do so before the mounting phase of the lesson gets started.

During Lesson:

§  While a riding lesson is in progress, all parents, family members, and guests must stay outside of the arena. You may only enter the arena if asked by an Instructor or volunteer.

§  No loud noises (clapping, car door slamming, loud talking/laughing, calling to riders, etc.)

§  No umbrellas or flash cameras while horses are present.

§  No ball playing, tag games, or fast-type movement games allowed before, during, or after scheduled lesson times.

§  Riders must not carry loose items which may fall, blow away, flap in the wind, bounce, or make sharp, loud noises, which could possibly scare the horse. Some examples are: cameras, hats, toys, purses, cell phones.

§  Riders must not make sharp, loud noises such as screaming or yelling, which may scare the horse.

§  We encourage you to leave younger siblings at home if at all possible, however, in the event that they need to come along to the lesson, please understand that they must stay with you at all times and be under control so as to not scare the horses.

§  If you turned on a light, turn it off when you are finished using that area. Keep the aisle clean of tack, brushes, halters, hoof pickings or manure. If you or your equine put it there, pick it up. If you open it, close it. If you unlock it, lock it. If you make a mess, clean it up. If it belongs to someone else, get permission to use it. All trash should be placed in the trash barrel.

After Lesson:

§  After lesson the rider will return to their parent, guardian, or ride.

§  Water and snacks are available for purchase from the Riding Instructor.

Liability:

I recognize the inherent risks of injury involved in any type of horseback riding generally and in learning to ride in particular. In taking lessons at TNC Equine Center, I assume any such risk of injury and further, I voluntarily release TNC Equine Center, its instructors, and agents {Christy Stermer and Thomas Bageant} from any responsibility on account of any injury I or my child or ward may sustain while receiving instruction or while riding in connection therewith, and I agree to indemnify and hold harmless TNC Equine Center, its instructors, and agents {Christy Stermer and Thomas Bageant} on account of any such claim. I further have reviewed and understand the content of Pennsylvania’s Liability Law which is posted inside and outside the barn. Likewise I accept full responsibility for friends and visitors accompanying myself on TNC Equine Center property.

“WARNING”

Under law, an equine professional {Christy Stermer, Thomas Bageant} is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risks of equine activities.

I, the undersigned, have read and understand the above contract and I agree to abide by in total, and I have received a copy of this contract. I further understand that if any of the TNC Equine Center policies or rules are not followed that TNC Equine Center has the right to cancel this contract in full without any refund of money. I have the right to cancel this contract at any time. All lessons missed prior to cancellation of this contract that are not approved absences must be paid for at the time of cancellation of this contract.

Attorney Fees: In any litigation, arbitration, or other proceeding by which one party either seeks to enforce its rights under this Agreement (whether in contract, tort, or both) or seeks a declaration of any rights or obligations under this Agreement, the prevailing party shall be awarded its reasonable attorney fees, and costs and expenses incurred.
