CHECKLIST: H-1B NEW TO UNIVERSITY AND IN H-1B STATUS FOR ANOTHER EMPLOYER

From H-1 Beneficiary

o  Copies of current and all previous H-1B approval notices (Forms I-797).

o  Copies of passport identity and validity page(s) and all US visas.

o  Copy of passport page with initial date of entry to the U.S. in H-1B status.

o  Copy of current I-94 record printed from https://i94.cbp.dhs.gov/I94/request.html

If ever in J status, list of all dates scholar maintained status as J-1 or J-2 in the US and copies of all DS-2019s or IAP-66s.

If ever in J status, evidence that the scholar is not subject to the 2-year home residency requirement:

o  Annotation on J visa in passport and annotation on DS-2019/IAP-66;

o  Evidence that scholar spent two years in home country after J time in US; or

o  Waiver approval notice.

o  Copies of diploma(s) and transcript(s) of courses taken.

o  Translation(s) if documents are not in English

o  Evaluation of foreign credentials, if available

o  Updated Curriculum Vitae or resume, including list of publications.

o  Copies of three most recent pay advices or check stub from current employer.

If involved in any patient care:

o  Colorado medical or dental license

o  Documentation of graduation from medical school in the US or a foreign stateOR full and unrestricted license to practice medicine in a foreign state

o  Evidence of passage of Steps 1, 2, and 3 of the U.S. MLE. (Step 3 not required if Beneficiary completed med school in U.S.)

o  ECFMG Certificate (Canadian citizens exempt).

From H-4 Dependent(s)

o  Completed Form I-539 (fillable form available from USCIS website at www.uscis.gov, ISSS can provide a sample form with helpful instructions)

o  Copies of dependents’ passport ID and validity pages, current visa stamps, I-797 notices, and I-94 records.

o  Copies of children’s birth certificates, with translations if not in English, to show relationship to H1B Beneficiary.

o  Copies of marriage license, with translation if not in English, to show relationship to H1B Beneficiary.

o  Photocopy of letter of offer or FRF in School of Medicine, as appropriate.

o  Actual Wage Form.

o  Completed H1B Questionnaire.

o  A copy of the official position description for this position, including the minimum and preferred requirements or a copy of the position as listed in CU Careers.

o  Enter and upload information about the H1B Beneficiary using the “Deemed and Hand Carried” module component of Visual Compliance.

o  FedEx account number and/or speed type for Fed Ex airbill to send petition to USCIS. If premium processing is used, ISSS will generate 2nd another FedEx air bill for USCIS to return approval notice to ISSS.

o  Filing fees (see instructions on next page for CU Marketplace payment vouchers).

Supplier: Use the “Supplier Search” function and type in “U.S. Department of Homeland.” Select “California Service Center” from the list of options.

Payee Type: Non-Employee

Warrant Delivery Code: Select "Campus Mail" and type “A005/185” as campus mailbox. The check will be sent directly to ISSS.

Business Purpose: Select “Immigration/Visa Fees” and include the H-1B Beneficiary’s name in the description.

Amount: Include the appropriate amounts from the chart below.
