Checklist - Application to Include Body of Water or Road in Subdivision

(Refer to Circular Letter No.458, Circular Letter No. 466, Section 58 of the Land Act, and SGD Policy and Procedure for disposing ofprovincial public highway through section 58 of the Land Act)

Before you proceed with an application, you must confirm that the bed of the body of water, watercourse or road that is the subject of the application is depicted in a colour other than red on the Crown grant tracing.

The fee for submission of a Section 58 application is listed on the LTSA Fee Listing.

We encourage you to submit your application through the Electronic Filing System (EFS). The EFS User’s Guide outlines the process to submit an application.

Alternatively, you may submit your application in hard copy. The package must include three copies of a preliminary plan signed by the land surveyor, a copy of this completed checklist, all documents required by this checklist and payment of the application fee. The address for submission is:

Checklist of Requirements for the Application Package

Preliminary Plan showing:

The unregistered land which is coloured other than red on the tracing attached to the Crown grant of the parcel which is the subject of the application;

Plotted positions and directions of terrestrial photographs and all survey points (monuments and traverse hubs) in the vicinity of the subject area flagged and identified

Colour terrestrial photographs of application area showing:

The location of the application areas clearly marked with a black line;

The photograph number clearly marked on the front of each photograph.

A copy of all pertinentLand Title Act plans of the upland property, plus copies of adjacent Land Title Act plans if they are relevant to the application;

Copy of Crown grant and Crown grant tracing;

An explanation of why the application area is no longer required to remain as provincial land. If the watercourse no longer exists, an explanation as to why itno longer exist should be provided. Any unnatural interference with the subject area must be documented;

Explanation describing the current state of the land including soil type, vegetation, artificial works (if any) and any other pertinent history affecting the application;

A copy of a composite map of the area, preferably at a scale of either 1:5000 or 1:2500;

The name of the municipality or Regional District (whichever is appropriate) and the civic address of the subject upland property.

Once conditional approval is granted and you have complied with any requirements of the conditional approval, you may seek final approval as follows:

The electronic plan affixed to a digitally signed Certification Form accompanied by anelectronic Application to Deposit Plan at Land Title Office Form (Application Form) is to be submitted to the Surveyor General through EFS. The EFS User’s Guide outlines the process to submit the plan.The Application Form is to be as complete as possible, containing signature blocks for all consenters and approvers, but not digitally signed by a Subscriber. Upon signature of the appropriate certificate on the Application Form by or on behalf of the SurveyorGeneral, the Form will be scanned and e-mailed back to you.

Checklist of Requirements for the Final Plan

Plan depicts the road or water body subject to the application in a manner that matches the preliminary approval.

The approved application area depicted on the plan with broken lines and identified as, “Unregistered land subject to the section 58 Land Act certificate hereon”.

Plan title does not refer to “pursuant to section 58”.
