AN ORDINANCE AMENDING THE

CENTRAL STICKNEY FIRE PROTECTION DISTRICT

FIRE CODE TO ADOPT THE 2009 INTERNATIONAL FIRE CODE WITH

AMENDMENTS AS THE FIRE CODE OF THE

CENTRAL STICKNEY FIRE PROTECTION DISTRICT

WHEREAS, code officials have long recognized the need for a single, up-to-date Fire Code applicable throughout the country; and

WHEREAS, representatives of the three major code writing organizations, Building Officials and Code Administrations International, Inc. (BOCA), International Conference of Building Officials (ICBO), and Southern Building Code Congress International, Inc. (SBCCI), have joined together to develop one International Fire Code (IFC), for the entire country; and

WHEREAS, the Board of Trustees of the District deems it in the best interests of the District to adopt the 2009 International Fire Code with certain deletions and amendments; and

WHEREAS, a copy of the 2009 International Fire Code has been on file with the District for thirty (30) days and has, during that time, been available for public use, inspection, and examination.

NOW, THEREFORE, Be itordained by the President and Board of Trustees of the Central Stickney Fire Protection District, Cook Counties, Illinois, as follows:

SECTION 1

The Central Stickney Fire Protection District Fire Code is hereby amended to delete and repeal the present language in its entirety and substitute the following:

1-1-1: IFC 2009 ADOPTED:

Adopted and applicable as the Fire Code of the Central Stickney Fire Protection District are those rules and regulations set forth with particularity in the booklet entitled “International Fire Code 2009”, published by the International Code Council, Inc., amended, however, in that the following portions indicated in Section 1-1-2 hereof are not hereby adopted, or are hereby amended or added to that Code as indicated in Section 1-1-3 and as set forth with particularity in the document entitled “International Fire Code 2009.”

SECTION 4 PENALTIES – FIRE PREVENTION CODE

Any person who shall violate any of the provisions of this Ordinance or the Codes hereby adopted or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or fail to pay a fee or fine set by this Ordinance or the Codes hereby adopted, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Board of Trustees or the Code Official or by a court of competent jurisdiction, within the time fixed therein, shall severally for each and every such violation and noncompliance respectively, be punishable by a fine of not less than Fifty ($50.00) Dollars nor more than One Thousand ($1,000.00) Dollars, plus all legal fees and all costs caused by enforcement. Any such violation shall also be required to be corrected or remedied by all such persons as soon as possible. Each day that prohibited conditions are maintained shall constitute a separate offense.

The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions, including the issuance of mandatory injunctions.

SECTION 5 SAVINGS CLAUSE

That nothing in this Ordinance or in the Building and Fire Prevention Codes hereby adopted shall be construed to affect any lawsuit or proceeding pending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this Ordinance; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

SECTION 6SEVERABILITY

6.1 It is hereby declared to be the intention of the Board of Trustees of the Central Stickney Fire Protection District that the several provisions of this Ordinance, and all codes adopted hereby, are severable, in accordance with the following:

  1. If any Court of competent jurisdiction shall adjudge any section, subsection, paragraph, sentence, clause, phrase or word of this Ordinance or the Codes adopted hereby to be invalid, such judgment shall not affect any other section, subsection, paragraph, sentence, clause, phrase or word of this Ordinance, or the Codes adopted hereby, not specifically included in said judgment, and
  1. If any court of competent jurisdiction shall invalidate the application of any section, subsection, paragraph, sentence, clause, phrase or word of this Ordinance or Codes adopted hereby to a particular property, building, or other structure, or any items of personal property, such judgment shall not affect the clause, phrase or word of this Ordinance or Codes adopted hereby to any property, building, structure, or personal property not specifically included in said judgment.

6.2 It is the declaration of the Board of Trustees of the Central Stickney Fire Protection District that if any section, subsection, paragraph, sentence, clause, phrase or word of this Ordinance or Codes adopted hereby be adjudged by a court of competent jurisdiction to be invalid, all remaining sections, subsections, paragraphs, sentences, clauses, phrases and words of this Ordinance, or Codes adopted hereby, would have been enacted by the Board of Trustees without the incorporation in this Ordinance, or Codes adopted hereby, of any such invalid or unconstitutional section, subsection, paragraph, sentence, clause, phrase or word of this Ordinance, or Codes adopted hereby.

SECTION 7EFFECTIVE DATE

That the provisions of this Ordinance shall be in full force and effect from and after its passage, and approval, and ten (10) days after publication as provided by law. Copies of the International Fire Code 2009,Exhibit A and any section, additions or revisions shall be available for public inspection at the Administration Office, 4951 S. Louts Ave., Stickney Twp, Illinois, during normal business hours.

SECTION 101

ADMINISTRATION - general

101.1 is amended to read as follows:

101.1 Title. These regulations shall be known as the Fire Code of Central Stickney Fire Protection District, hereinafter referred to as "this code."

101.2.2 is added to read as follows:

101.2.2 Name Change. Any where in this code where the term “Fire Code Official” is used, it shall be changed to “Fire Prevention Code Official.”

101.5.1 is added to read as follows:

101.5.1 Conflicting Code Information. In the event this code or any portion thereof shall be in conflict with another code or portion thereof on the same subject matter the more stringent code shall apply.

101.6 is added to read as follows:

101.6 NFPA Appendixes: The appendixes of all NFPA standards are to be considered as part of each standard and are considered “shall” requirements, not “should” information.

SECTION 102

APPLICABILITY

102.3 is amended to read as follows:

102.3 Change of use or occupancy. A change of use or occupancy shall not be made to any building or tenant space without approval of the Code Official. The Code Official shall certify that such building or tenant space meets the provisions of law governing building construction for the proposed new use or occupancy. The building is required to comply with the fire protection requirements of this code.

SECTION 104

GENERAL AUTHORITY AND RESPONSIBILITIES

104.6.5 is added to read as follows:

104.6.5 Written request for records. Any person wanting records from the Fire Prevention Bureau must submit in writing on the Central Stickney Fire Protection District Written Request for Records form. (Appendix E)

SECTION 105

PERMITS

105.3.6 is amended to read as follows:

105.3.6 Compliance With Code: All work preformed under a permit issued shall conform to the approved application and plans and any approved amendments thereto. It shall be unlawful for any owner, agent, architect, structural engineer, contractor, or builder engaged in erecting, altering, or repairing any structure or appurtenance thereof to make any departure from the drawing or plans as approved by the code official. Any of the requirements in this ordinance shall render the same void.

The Central Stickney Fire Protection District reserves the rights to send out any plan reviews to a third party agency because of the level of difficulty or availability of personal to perform the review. The third party agency shall invoice the permit holder directly for the services rendered.

105.3.6.1 is added to read as follows:

105.3.6.1 Compliance: No building or structure shall be constructed or occupied if said building or structure is not in compliance with this ordinance. An occupancy permit shall be issued by the code official in conjunction with the Cook County Building Inspector prior to occupancy when it is determined the building or structure has been constructed in compliance with this ordinance.

105.3.9 is added to read as follows:

105.3.9 Certificate of occupancy. The Code Official shall issue a certificate of occupancy only if, after inspection, he/she finds that such building or tenant space complies with the provisions of this Ordinance and all other Ordinances of the Central Stickney Fire Protection District, Cook County, and that said building or tenant space has been completed in accordance with the approved plans and documents filed in support of the Application for Building Permit relating to said building or tenant space. Such Certificate shall show the permitted use for the building or tenant space.

In accordance with Attachment B (Fees), all outstanding fees shall be paid in full, prior to issuance of a certificate of occupancy by the Code Official.

105.4.4 is amended to read as follows:

105.4.4 Approved documents. Construction documents approved by the fire code official are approved with the intent that such construction documents comply in all respects with this code. Review and approval by the fire code official shall not relieve the applicant of the responsibility of compliance with this code. Approval or disapproval shall be addressed in letter form and forwarded to the appropriate county or village building department having jurisdiction, stating reason(s) for disapproval or all requirements to be met prior to occupancy.

SECTION 106

INSPECTIONS

106.5 is added to read as follows:

106.5 Inspection and Enforcement process: In its efforts to ensure that fire protection safety for its residents and businesses of the Central Stickney Fire Protection District, the Fire Prevention Bureau shall inspect all buildings in the District for compliance with the fire safety codes of the District on a regular basis. The process by which the Bureau shall inspect and issue citations for failure to comply with the District fire safety codes shall be established by the Bureau S.O.P.

SECTION 108

BOARD OF APPEALS

108.1 is amended to read as follows:

108.1 Board of appeals established. In order to hear and decide appeals of orders, decisions or determinations made by the code official relative to the application and interpretation of this code, there shall be and is hereby created a board of appeals consisting of members who are qualified by experience and training to pass on matters pertaining to this code and who are not employees of the jurisdiction. The code official shall be an ex officio member of said board but shall have no vote on any matter before the board. The board of appeals shall be the board of trustees of the Central Stickney Fire Protection District. The board shall adopt rules of procedure for conducting its business, and shall render all decisions and findings in writing to the appellant with a duplicate copy to the code official.

SECTION 109

VIOLATIONS

109.3 is amended to read as follows:

109.3 Violation penalties. Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the code official, or of a permit or certificate used under provisions of this code, shall be guilty of an ordinance violation, punishable by a fine of not less than fifty ($50.00) Dollars nor more than one ($1,000.00) thousand dollars, plus all legal fees and all costs caused by enforcement. Such fees and costs shall include, but not limited to, staff costs of inspection or re-inspection, legal fees, and staff cost of enforcement. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
