TERMS OF SERVICE AND GUARANTEE: PERMANENT STAFFING

INTRODUCTION:

CAREER CHOICE CC is a company which provides permanent placement within various industries. CAREER CHOICE CC supports and complies with all the laws and regulations of the Republic of South Africa especially employment legislation and standards which apply to the provision of employment services.

FEE BASIS AND TERMS OF PAYMENT:

The fee is calculated on the basis of a percentage of the employee’s total Annual Taxable Remuneration inclusive of car allowances, guaranteed commissions – expected OTE, company car valued at R2, 500 per month, bonus and / or 13th cheque. Fees arise and become due for payment when the candidate introduced commences employment in any capacity (whether as an individual or other legal entity) temporary or permanent with your company or a party to whom you introduce the candidate within six months of the last date of referral

The fee is payable by the employer and no charge is made to work seekers. If registered, VAT may be claimed by your company as input tax.

CAREER CHOICE CC reserves the right to charge a placement fee should a CAREER CHOICE CC employee be recruited by a Client or third party introduced by the Client. No variations can be made to these Terms of Service without written confirmation signed by or on behalf of both parties.

GUARANTEE:

CAREER CHOICE CC offers a three-month (3) Guarantee subject to the Guarantee being validated.

The Guarantee is validated by the full fee being paid within ten (10) days of the candidate commencing employment.

Should payment not be received within ten (10) days, the fee will be reinvoiced at 18% + VAT.

CAREER CHOICE CC reserves the right to charge interest at the maximum rate in terms of the Usury Act for any late payments.

Guarantees are not valid where the candidate is no longer employed due to termination owing to operational requirements, an unfair labour practice or a breach of agreement which causes the said employee to leave.

CAREER CHOICE CC shall not make cash back payments on guarantees, but shall make a replacement candidate available to the client in respect of such payments, please note that CAREER CHOICE CC does not allow refunds, credit notes are given.

Terms of Guarantee:

Replacement: If the Guarantee is validated and if the first person employed leaves within the Guarantee period, the Client is entitled to receive a replacement candidate to fill the same vacancy. Take into account differences in salary packages, i.e. between the first person employed and a replacement, the original charge will be credited in full, and the new fee calculated and invoiced on the replacement’s package.

If the Client does not validate the Guarantee, even if the candidate leaves the Client’s employ within the Guarantee period, the Client will not be entitled to receive replacement candidates or a rebate. The Client will be liable for the total amount on the original invoice.

Requests for replacements must be made to CAREER CHOICE CC within 48 hours of the last date of employment, and must specify the date the original person placed actually left, or will leave, the Client’s employment.

REFERENCES:

All references are forwarded on a strictly confidential basis and should not be discussed with the candidate.

PSYCHOMETRIC TESTING:

If required, arrangements can be made for candidates to be tested by a registered industrial psychologist or on an accredited programme. The professional fee will be advised at the time, and will be for the Client’s account

INDUSTRY SPECIFIC CHECKS:

On request a credit check, qualification verification etc. can be completed on the final selected candidate.

The client is to notify Career Choice CC in order for these checks to be completed.

CLIENT / ATTORNEY CHARGES:

In the event that CAREER CHOICE CC instructs its attorney to institute legal proceedings against a Client, the Client hereby undertakes and agrees to pay CAREER CHOICE CC’s attorney legal fees on the scale as between attorney and Client, collection commission, tracing fees and the like should any judgement be granted in favour of CAREER CHOICE CC.

JURISDICTION:

The Client hereby consents and submits to the jurisdiction of the Magistrate’s Court having jurisdiction over its person in respect of all proceedings connected with CAREER CHOICE CC’s Standard Terms of Service, notwithstanding that the amount claimed or the value of the matter in dispute exceed such jurisdiction.

AGREEMENT:

Should any Client not understand the aforegoing terms and conditions or should he disagree with all, or any of them, he must note his query or disagreement in writing, with us by prepaid registered mail prior to the conclusion of any contract between us. Should the employer fail to lodge his notice with us timorously, he is deemed to have accepted the terms and conditions of business as stated herein.

The above conditions shall accordingly be deemed to be embodied in any contract entered into by us, save and except upon variation thereof, in writing, signed and agreed to by all parties.
