2009 Official Rules & Regulations

  1. The Journalism Contest (hereinafter “Contest”) is organized by the Canadian Living, property of Transcontinental Media G.P. (“Transcontinental”). It starts on Tuesday, September 15, 2009, and closes on Friday, November 6th, 2009 at 5.00PM (EDT). Any reference to time in this document indicates Eastern Daylight saving Time (EDT).

2. ELIGIBILITY

This Contest is open to all residents of Canada and is governed by Quebec/Canada law, who have reached the age of majority in the Province in which they reside, who are currently enrolled full-time in a journalism program at an accredited college or university in Canada except employees, agents and/or representatives of the Canadian Living, property of Transcontinental Media G.P. (hereinafter the “Contest Sponsor”) and their respective advertising and promotional agencies or any contributor to the Contests, as well as anyone with whom an employee, agent and/or representative is domiciled or any member of his or her immediate family.

3.HOW TO ENTER:

To enter the Journalism Contest (hereinafter “Contest”), print and fill out the application form available online at

Then submit a completed application package, which shall include:

  1. The completed application form;
  2. Up to three published or unpublished samples of the entrant’s original journalistic writing, in the form in which they appeared in publication (i.e., scans, or photocopies of the piece from the publication, or PDF files of the pages, including the name of the publication, the date and page numbers);
  3. One signed and dated letter of reference from one of the entrant’s current journalism professors; and
  4. An original story proposal for a feature article in Canadian Living, for the Life and/or Health section, including a description of: the focus of the piece; who the entrant has spoken to or intends to speak to or interview; how the entrant intends to present the piece or the angle the entrant intends to take; how the piece is appropriate for Canadian Living; and how the piece will appeal to Canadian Living readers.

Each entry application must be entered in one of the following two sections: Life or Health. Entries are limited to one per person per section for the duration of the Contest, whatever entry mode. Each entrant can only use one e-mail address (which must be valid) to enter via the electronic entry form. For mail-in entries, each entry must be mailed in a separate envelope bearing sufficient postage. Each entry, whether submitted via e-mail or mail, must contain a unique story proposal; duplicate entries will not be accepted. Illegible entries, bulk mailings or reproductions are ineligible.

By entering the Contest, entrant certifies that each entry submitted is his or her original work (hereinafter the “Work”). Any plagiarized or adapted versions of another person’s work will be immediately disqualified.

All entries, via e-mail or mail, must be received by 5:00 p.m. (EDT) Friday, November 6, 2009.No purchase necessary.

2. JUDGING:

A Canadian Living judging panel will select a number of finalists of their choosing (the final number will be determined by the number and quality of entries submitted) from all entries submitted on Friday, December 4, 2009, in Toronto, Ontario. The selected finalists (hereinafter the “Finalists”) will be notified by Monday, December 7, 2009 by telephone and/or e-mail.

Each Finalist will be required to submit the completed feature story proposed in the story proposal submitted initially upon entry in the Contest. This completed feature story must be submitted to Canadian Living by 5:00 p.m., Monday, February 1, 2010 by telephone and/or e-mail.

A Canadian Living judging panel will select, at their sole discretion, two (2) first-prize winners, two (2) second-prize winners and two (2) third-prize winners (hereinafter collectively the “Winners”) from the stories submitted by the Finalists on Monday, March 8, 2010, in Toronto, Ontario. The odds of an entry being selected depend on the number and quality of eligible entries received by the Contest closing date.

Furthermore, the Canadian Living judging panel will judge each entry on the following criteria’s; suitability for Canadian Living, journalistic acumen, timeliness, originality and understanding of the reader of the Canadian Living. The Winners will be notified by Monday, March 15, 2010 by telephone and/or e-mail.

The decisions of the judging organization are final with respect to all aspects of the Contest. No correspondence will be entered into except with the Finalists and individuals requesting a copy of Contest rules.

3. PRIZES:

Overall of six (6) prizes will be awarded for this Contest as follows;

First prize:

Two (2) first prizes Winners, one for the Life section and the other for the Health section; each consisting of $1,500 and the publication of the winning entry in Canadian Living Magazine and a 12-week editorial internship (without compensation) in the offices of Canadian Living in Toronto,will be awarded. Approximate value of each grand prize is $1,500 CDN.

Second prize:

Two (2) second prizes Winners, one for the Life section and the other for the Health section; each consisting of $500 and the publication of the winning entry in Canadian Living Magazine or on will be awarded. Approximate value of each second prize is $500 CDN.

Third prize:

Two (2) third prizes Winners, one for the Life section and the other for the Health section; each consisting of $200 and the publication of the winning entry on will be awarded. Approximate value of each third prize is $200 CDN.

The first, second and third prizes are collectively referred to hereinafter as the “Prize”.

The Prize must be accepted as awarded and cannot be sold, traded, transferred without the prior written agreement of the Contest Sponsor, substituted with another prize or exchanged in whole or in part for money. Should the winner refuse a Prize, the Contest Sponsor and their respective advertising and promotional agencies are released from any obligation related to the Prize. Should the Contest Sponsor, for reasons out of its control and not related to the Winner, not be able to award the Prize as described in the present document, the Contest Sponsor reserves the right to award a similar prize (or a portion of the prize) of equal value or, at its sole discretion, the value of the prize indicated in this present document (or a portion of the prize) in money.

4. HOW TO WIN:

For a chance to win, your entry must be received by 5:00 p.m. (EDT) on theContestclosing date, Friday, November 6, 2009.

To win a Prize, selected entrants must have complied with the Contest rules herein detailed. The Winners must fill in a Declaration of Release (hereinafter “Release”) that will be sent to them by mail and/or courier and/or fax and/or e-mail by the Contest Sponsor and return it filled in and signed within fifteen (15) days of receiving it. In the event that the Release is not signed and returned within the time limit, the Contest Sponsor reserves the right, at its sole discretion, to conduct or not a new judging panel to award the Prize. If Contest Sponsor decides not to conduct a new draw, the Prize will simply not be awarded. Each Winner must return the completed Release within five (5) days of receipt.

If the Release are not returned within the deadline, if the Winner is not eligible for any reason or if the Winner cannot be contacted after five (5) business days of the first attempt to contact the Winner, such Winner shall be disqualified and the Contest Sponsor shall have the right to select another entrant and the Contest Sponsor shall be released and discharged from any liability or responsibility in this regard. The selected entrant will be disqualified and another potential winner chosen from all eligible entries. The newly selected Winner must return completed release form within five (5) days of receipt.

Upon receipt of the Release, Contest Sponsor will inform the Winners by e-mail and/or by mail and/or by phone and/or by messenger of all the details related to the Prize awarded.

The monetary portion of the Prize will be delivered between Monday, April 12, 2010, and Friday, April 23, 2009, inclusively.

5. GENERAL TERMS AND CONDITIONS

All monetary amounts specified in the Contest rules are in Canadian currency.

The Contest is subject to all applicable federal, provincial and municipal laws.

Limit of one Prize per person, per email address or per address will be awarded.

The Contest Sponsor and their respective affiliates, their advertising and promotional agencies accept no responsibility in any case where their inability to satisfy these Contest rules arises from any situation which is outside of their control including but not limited to a situation of strike, lock-out or other labour strife in the Contest Sponsor’ facilities or in the facilities of any organization or entity whose services are used for running this Contest.

The Contest Sponsor accept no responsibility for entries lost, misdirected, illegible, incomplete, delayed or destroyed or for the failure or malfunction of any hardware, software or telecommunication component relating to online entries.

The Contest Sponsor reserves the right, subject to the approval of the Quebec’s Régie des alcools, des courses et des jeux, to terminate or alter the rules of the Contest without advance notice. For Quebec residents, any litigation respecting the conduct or organization of a promotional contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie des alcohols, des courses et des jeux only for the purposes of helping the parties reach a settlement.

The Contest Sponsor reserves the right to modify or cancel the Contest without advance notice, subject to having obtained any required approval from Quebec’s Régie des alcools, des courses et des jeux.

By entering the Contest, all entrants authorize the Contest Sponsor, if required, to use his name, photograph, place of residence, voice, image, and (or) declaration regarding its Prize for advertising purposes without any form of remuneration. Furthermore, the selected contestants agree to permit his name and town of residence to be broadcast in print, radio or televised publicity or in any form of media known or to be discovered and (or) on the Contest Internet page without any form of remuneration.

No entry will be returned to entrants throughout this Contest. The Winners hereby assign and transfer all right, title and interest in the Work submitted to the Contest Sponsor hereby accepting and copyright in the Work to Contest Sponsor, effective as of the date the Winners have submitted the Release.

The Finalists hereby grant to Contest Sponsor hereby accepting, an unlimited, non-exclusive, non-transferable licence to use and promote, in any format, the Work submitted to the Contest Sponsor.

The Contest Sponsor, which assumes no responsibility for lost, stolen, delayed, damaged, postage-due or misdirected entries or for any failure of the websites during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by the Contest Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion. Contest Sponsor reserves the right, in its sole discretion to cancel or suspend this Contest should a virus, bug or other cause beyond the reasonable control of the Contest Sponsor corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

The Contest Sponsor will be collecting data about entrants through the Contest entry process. Any personal information will be handled in accordance with the privacy policy of Canadian Living (Transcontinental Media G.P.). By entering the Contest, each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor for the purposes of implementing, administering and fulfilling the Contest.

The Contest Sponsor will not sell or transmit this information to third parties unless the entrant has specifically consented to same, the Contest Sponsor believe in good faith that it is required by law, to their affiliates (provided that such affiliates and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these rules and regulations), or to their respective agents for data processing purposes, their respective professional advisors and promotional and marketing agencies (provided that such agents, professional advisors and promotional and marketing agencies are restricted from using the information for any purpose other than as described in these rules and regulations).

The Canadian Living, property of Transcontinental Média G.P., its respective companies and divisions and any other moral person of its corporate group, its affiliated broadcast distributors, advertising and promotional agencies and their respective shareholders, administrators, executives, employees and agents, as well as any contributor to the Contest, are not responsible for matters regarding the Prize or the Contest and provide no guarantee for either.
