A motion was made by Mr. Olson and seconded by Mr. Valentine to approve the minutes

Z11-08 Trac Contracting, Waterloo Rd, Cranberry Lake, Block 91, Lot 286

New SFD on undersized lot, unimproved road, with setback variances

(carried from 12/18, 2/5, 3/5, 3/19, 4/2, 5/7)

Request to be carried to 12/3/09. Will re-notice.

A motion was made by Mayor Danielson and seconded by Mr. Valentine to carry the application to December 3, 2009. The applicant will re-notice.

SD2-09 and SD3-09 Hudson Farm Greenway, 225/15 & 360/26, 360/39-40

Minor Subdivision with Variance for Open Space purchase

Caryn Segal, Marie Raffay and Bob Chozick all stepped down for this application. Mr. John Ursin appeared on behalf of the applicant. He explained the history of these properties and he explained the layout of all the properties involved.

Three of the proposed lots would be conveyed to the township. The result is that the township will own all of the parcels that are actively used. The remaining ecologically sensitive properties would be eased with a conservation easement to the township for passive recreation. The NJ Conservation Foundation will manage and maintain the properties.

The 10.66-Acre parcel on Jones Lane to be purchased by the town is cleared and contains several structures. The land will be used for fields and the buildings for restrooms, concessions or storage.

Mr. Ursin then proceeded to the next parcel and set of plans. Page two of the plans shows the existing driveway and dam structure. This property can accommodate parking for this lot and for the Beckmann parcel across the street. The dam will be refurbished by the applicant sometime in the fall once DEP has authorized moving the fish and lowering the lake.

Page three shows the continuation of the lake. The map also shows the cemetery parcel. The Historical Society is interested in accepting a donation of the parcel.

The existing garage and assorted structures will be parceled out and retained by the applicant.

Lot 42.04 will not have road frontage and therefore needs a variance. There will not be any new structures as part of this proposal. The eased land will include access easements for the pubic to enter.

OPEN TO THE PUBLIC

Nick Cutrone of 60 Sleepy Hollow Road has an issue with ATV riders crossing his property to access his property. He wants the town to ensure that the proposed trail will not be near his property line.

Mr. Ursin stated that the proposed trail will be the one used for the fall charity hike.

Mr. Cutrone is supportive of the proposal.

Cate Roberts asked if the land will be open to ATV’s and was told no.

Tom Roberts stated that the trails society has approached him about the emergency access.

There were no other members of the public wishing to speak.

A motion was made by Mr. Olson and seconded by Mr. Valentine to approve the application.

SP1-09 Lake Lackawanna Golf Course, Bl 248 L1, 14 Reis Ave

Thomas Falleni, president of the lake and Michael Byrne representing the management company of the golf course were both sworn in.

The existing building was bumped out to the extent of the roof. There were issues with kids hanging out at night and vandalizing the property.

There are no variances required and no notice was given.

Scott has concerns about all the activity being concentrated on the side of the building near the road.

A motion was made by Mayor Danielson and seconded by Mr. Chozick to approve the application.

OTHER BUSINESS

Kurt gave an update on the accessory structure ordinance and the possibility of an appeal of the Lutz application.

Caryn asked about the letter from the county regarding obtaining local approval before County Board of Health approval.

A brief discussion was had regarding the issue.

The Board decided that the County is in the town’s employ and will continue to request their input on applications pending before the Board.
