ADOPTION CONTRACT
Release and Indemnity Agreement /On this date, ______20____, ______(hereinafter referred to as “Adopters”). agree to take possession of one dog, otherwise known as ______(hereinafter referred to as “the Samoyed”), from an agent of Buckeye Samoyed Rescue (BSR). In consideration of the donation of ______(dollars), the receipt of which is hereby acknowledged, Adopter(s) do hereby release and hold harmless BSR and any other person, firm or corporation charged or chargeable with liability, their heirs, administrators, executors, successors and assigns from any and all claims, damages, costs, expenses and loss of services belonging to the said Adopter(s) arising out of any act or occurrence from the present time. To Procure the payment of the said sum, the Adopter(s) hereby declare that no representations about the nature of said dog, nor any representations regarding the nature and extent of legal liability or financial responsibility have induced the Adopter(s) to make this Release and Indemnity Agreement; that in determining the amount of the said sum, there has been taken in to consideration age, health, veterinary services and care of the said dog, up to the present time.
ADOPTERS’ DUTIES AND RIGHTS
The undersigned hereby further agrees to abide by the “Terms of Adoption” listed below:
1. Adopters understand that Adopter(s) are entitled to no financial reward, fee, reimbursement or subsidy for taking possession of the Samoyed ______(initial)
2. EXERCISE - Adopter(s) agree to keep the Samoyed as a pet, to have indoor sleeping quarters and be exercised in a fenced yard or on a leash and NOT BE ALLOWED TO RUN FREE IN THE STREETS. The Adopter(s) agree to NEVER allow the dog to ride in the back of an open vehicle (pickup truck, trailer, etc.) unless the dog is within a securely tied down crate. 3. Adopter(s) agree not to sell, trade or dispose of the Samoyed in any way without first contacting BSR. The Samoyed shall not be used for medical or other experimental purposes or sold or given to a pet store, supplier or wholesaler. I attest that I am not associated with a guard or attack-dog agency or a pet shop. ______ (Initial)
4. IDENTIFICATION- The Samoyed must be licensed in accordance with the laws of the jurisdiction in which the adopter(s) reside. Adopter(s) agree to have proper identification on the dog at all times (Personal ID and Rabies tags) and to telephone BSR immediately if the Samoyed becomes lost or is stolen. There will be no refund if the dog is lost or stolen. If it becomes necessary that adopter(s) can no longer care for the dog due to unforeseen circumstances (divorce, marriage, moving, etc.) Adopter(s) agree to return the Samoyed to BSR. 5. HEALTH- The Samoyed shall be given vaccines and heartworm tests and be maintained on a heartworm preventative as established by the Adopter(s) veterinarian for the rest of the dog’s life. I attest that I have read and understand this. ______(Initial)
6. RESPONSIBILITY- The Adopter(s) understand that BSR cannot be responsible for the behavior of this dog after adoption and the Adopter(s) accept full legal, custodial and financial responsibility for the dogs actions. I attest that I have read and understand this. ______ (initial)
7. RESERVATION OF RIGHTS- BSR reserves the right to follow through on this adoption in the form of follow-up calls and/or visits in order to protect the welfare of the Samoyed. If the Terms and Conditions of this Agreement are not upheld by the Adopter(s), MSR reserves the right to terminate this agreement and MSR may reclaim the dog immediately from the Adopter(s) home or premises on any given time and date. 8. RETURN- If for any reason the adoption is not satisfactory to the adopting party and the dog is in as good or better mental or physical condition as on the date of adoption there will be a conditional, pro-rata refund of the adoption fee subject to the discretion of BSR. 9. ATTORNEY FEES AND COSTS- Should it become necessary for BSR to take legal action to recover an adopted dog or to defend this contract the Undersigned Adopter(s) agree to pay all court costs and reasonable attorney fees. 10. If for ANY reason you are no longer able to keep the above referenced Samoyed, the dog shall be returned to Buckeye Samoyed Rescue Immediately ______(initial)
THE UNDERSIGNED understands that the parties hereby released admit no liability of any sort by reason of the said adoption and that said payment is made to terminate further controversy respecting any and all claims for damages that said Adopter(s) have heretofore asserted or might personally or through personal representatives hereafter assert because of said adoption.
BY SIGNING THIS CONTRACT, IF I DO NOT COMPLY WITH THE ABOVE TERMS, I AGREE TO ALLOW BUCKEYE SAMOYED RESCUE TO REMOVE THIS DOG FROM MY PROPERTY.
I have read and received a copy of, and hereby agree to abide by all the terms and conditions of this agreement.
