Live Breeding Contract- Cherokee Country
This Stallion Service Contract for Live Breeding for the 2017 breeding season is made and entered into on this _____ day of ______, 2017 by and between Sierra Ranch Co. hereinafter designated as Stallion Owner and ______hereinafter designated as Mare Owner(s).
Mare Owner agrees to breed the mare, ______, registered with ______, registration #______, to the Stallion, Cherokee Country, registered with The Jockey Club, registration #H429180, for the fee of $______for a “live foal”, during the month of ______2017, subject to the following conditions:
- Non-refundable booking fee of $500.00 must be paid at the time of the signing of the contract. This $500.00 check or money order, made out to Randy Chubak, along with a signed copy of this contract, verification of health requirements, and a duplicate copy of the mares registration papers, should be sent back to the address at the top of this document, if it cannot be presented in person. Once the signed contract, copy of mares’ papers, verifications of health requirements, and booking fee are received, mare will have a space reserved for requested time.
- The entire stud fee must be paid in full, as well as copies of the mares registration papers, health certificates, and signed contract must be received before the mare will be allowed on the premises for breeding.
- Health Certificates required from a licensed veterinarian prior to mares arrival:
- Health certificate indicating current vaccination for equine influenza, strangles, tetanus, and sleeping sickness
- A negative Coggins test within the previous 6 months
- Verification indicating that the mare is in sound breeding condition
- Mare Owner agrees to provide, in writing, any particular known health risks/circumstances which may be relevant to the care of mare during the period of the performance of this contract.
- Mare must be left on site for sufficient time to be pregnancy checked by a licensed veterinarian (no more than 2 cycles). Cost of pregnancy check and hauling fee will be paid for by mare owner.
- Veterinarian services are provided by D&R Veterinarian Services. All veterinarian care (including pregnancy check) is paid for by mare owner directly to D&R Veterinarian Services. A credit card must be on file with D&R Veterinarian Services prior to mare being brought to farm for breeding.
- Mare Owner shall be responsible for payment of boarding fees at the rate of $18 per day for the keeping and ordinary care of the mare. Mare with foal at side is $20 per day. Mare care is invoiced at the end of each month and due within 7 days.
- Furthermore, it is expressly understood and agreed that the boarding of said horse, as agreed to herein, is not a personal service contract and accordingly, any services provided for hereunder may be performed by Stud Farm/Owner of Stallion, employees, officers, agents, friends, and/or family members.
- A “Breeders Certificate” will be issued for the foal, conceived by this mating, when the remainder of the Stud Fee in the amount of $______and all other expenses have been paid in full and when mare has produced a live foal by this mating.
- All monies owed regarding mare care, hauling fees, extra care fees, etc. must be paid prior to removing mare from Stallion Owners property.
- LIVE FOAL GUARANTEE: (For this purpose, “Live Foal” shall be defined as a foal that stands and nurses without assistance.) If the mare proves not to be in foal in the year bred, or loses her foal, Mare Owner has the option to rebreed the mare the following year or provide a substitute mare the following year, in case of a problem mare, provided all documentation and health certificates are provided to Stallion Owner prior to mares arrival on property.
- The above is subject to the condition that notification must be made to Stallion Owner within 48 hours after time of foaling or aborting, that mare did not produce a live foal. A certified large animal veterinarian’s statement, in writing, must follow, giving particulars to substantiate live foal guarantee. Stallion Owner must receive veterinarians’ statement within 14 days of said mares foaling or aborting, or live foal guarantee shall become null and void.
- This solely applies to the foal resulting from the mating of the two horses, herein named and conceived exclusively as a result of this particular breeding. If said foal is born dead, or if after being pronounced “Safe in foal” by a licensed veterinarian, the foal that results from the breeding, herein contracted for, should be miscarried, abort, or otherwise cease to exist, prior to the foaling date, there is a single breeding return to be used in the breeding year IMMEDIATELY following the year in which this contract was made. This return stud service, should it be chosen, consists of a ONE TIME waiver of the stud fee only. This does NOT include a waiver of any AI and /or shipping costs, collection costs, mare care, nor any other costs the Mare Owner may incur.
- It is further agreed that should the stallion die, be sold by the Stallion Owner, or become unfit for service prior to settling the mare, that 100% of the breeding fee will be refunded, if it has been paid in full, thereby canceling this entire contract. This refund will consist of the paid portion of the stud fee ONLY and will NOT include any other monies spent by the Mare Owner.
- If the mare dies or becomes unfit to breed, before being brought to Stallion owners property but after booking deposit and/or stud fee has been paid, the Stallion Owner may, at their sole discretion, accept another mare as a replacement. A replacement mare must be selected, and presented for breeding, with all proper documents and health certificates, as required in this contract for the original mare, in either the same year as this contract was issued into, or NO LATER than the IMMEDIATELY following year, otherwise the offer of accepting a replacement mare will be rendered NULL and VOID.
- Should Mare Owner decide not to breed the mare referred to in this contract, for any reason, and chooses not to provide a replacement mare per section 12 of this contract, all monies paid to Stallion Owner are forfeited. However, if Mare Owner chooses, said monies can be put towards a breeding the year IMMEDIATELY following the year in which this contract is entered into.
- Responsibility for insurance and risk of loss passes to the Mare Owner with this contract. Mare Owner assumes the unavoidable risks inherent in all horse related activities, including, but not limited to Mare Owners horse, Mare Owner, and Mare Owners family members. Mare Owner agrees to look solely to his or her insurance for compensation for any such loss, and further agrees to indemnify and hold harmless the Stallion Owner, Manager, his family, friends, and employees.
- In the event it becomes necessary to refer debts arising from this contract to collection, an attorney, or if suit is instituted hereon, Mare Owner agrees to pay all reasonable court costs and attorney’s fees incurred in the suit or collections. Payment past due thirty (30) days will be considered a default and breeder is entitled to a possessory lien against Mare Owners horse.
- This contract cannot be assigned or transferred without prior consent of the Stallion Owner, in writing, sent Certified Letter, Return Receipt Requested.
- This contract represents the entire agreement between the parties. No other agreement or promises, verbal or implied, are included unless specifically stated in the written contract.
When Mare Owner and stallion Owner sign this contract, it will then be binding on both parties, subject to the above terms and conditions. Mare Owners signature on this contract certifies that he/she has read and fully understands all of the terms and conditions outlined herein, and accepts this contract as a legal and binding instrument on behalf of Mare Owner, Mare Owners heirs, successors and assigns. This contract is hereby executed as of the date signed by the Stallion Owner which date shall govern the effective dates of said contract.
