In reply to a query it was confirmed that no further representations to the planning applications relating to Priory Park, Reigate had been received before the 27th January, 2006 deadline.

RESOLVED that the Minutes of the meeting held on 25th January, 2006 be approved as a correct record and signed.

169.  PLANNING APPLICATIONS FOR DECISION

RESOLVED that the list of planning applications to be determined under Items 5 to 17 of the Agenda be noted.

170.  planning applications 05/02387/f and 05/01605/cac – 6-8 cavendish road, redhill

The Committee considered a report on an application for the demolition of 8 Cavendish Road and the erection of 11 no. 1, 2 and 3 bedroom residential units, formation of new access and parking, and an application for Conservation Area Consent for demolition of 8Cavendish Road at the above location. An objector and a representative of the applicant addressed the Committee.

RESOLVED that consideration of these applications be DEFERRED to the next ordinary meeting to enable a site visit to be held on a date and time to be agreed in consultation with the Chairman.

171.  planning application 06/00035/f – kiln brow, three arch road, redhill

Consideration was given to a report on an application for a single storey sectional building for use as a clubhouse for a temporary period of 15 years at the above location.

RESOLVED that planning permission be GRANTED subject to the following conditions:

1. The building hereby permitted shall be removed, and the land restored to its former condition on or before 1 March 2021 in accordance with a scheme of works submitted to and approved in writing by the Local Planning Authority.

Reason:

To enable the applicant, through a reasonable length of time, to seek and secure funding for the development of a more permanent form of development in this green belt location and in the interest of safeguarding the character and amenity of the locality with regard to Reigate and Banstead Borough Local Plan 2005 policies Re 2 and Co1.

2. Surface water drainage works shall be carried out in accordance with details which shall have been submitted to and approved in writing by the Local Planning Authority before the development hereby permitted commences.

Reason:

To prevent the increased risk of flooding and to comply with policy Ut4 of the Reigate and Banstead Borough Local Plan 2005 and policy SE3 of the Surrey Structure Plan 2004.

3. No soakaways shall be constructed such that they exceed 3 metres in depth below existing ground level.

Reason:

To prevent pollution to ground water with regard to Reigate and Banstead Borough Local Plan 2005 policy Ut4 and Surrey Structure Plan 2004 policy EN3.

172.  planning application 05/02667/f – 28 high street, banstead

The Committee considered a report on an application for the conversion of the existing post office building and sorting office into a delicatessen, brasserie and restaurant, extension at first floor level to provide w.c. accommodation, and remodelling works to shop front at the above location.

RESOLVED that planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason:

To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004

2. The proposed external finishing materials shall match those of the existing buildings and there shall be no variation without the prior approval in writing of the Local Planning Authority.

Reason:

To ensure that the development hereby permitted is only constructed using the appropriate external facing materials or suitable alternatives in the interest of the visual amenities of the area with regard to Reigate and Banstead Borough Local Plan 2005 policies Em3 and Sh2.

3. Before any works commence, details of the proposed ramp and railings shall be submitted to and approved in writing by the Local Planning Authority to show the gradient of the ramp and the crossfall and longitudinal gradient of the adjoining highway land.

Reason:

In order that the development should not prejudice highway safety, nor cause inconvenience to other highway users and to comply with policies DN2 of the Surrey Structure Plan 2004.

4. The use hereby permitted shall not commence until:

(i) details of filtration equipment to prevent the escape of steam, fumes, odours, grease, smoke or other potentially harmful or noxious pollutants from the premises to the atmosphere have been submitted to, and approved in writing, by the Local Planning Authority; and

(ii) the approved filtration equipment has been installed and is in full working order.

The approved filtration equipment shall be used whenever cooking takes place on the premises.

Reason:

To ensure that the proposed development does not prejudice the amenities of the properties in the surrounding area with regard to Reigate and Banstead Borough Local Plan 2005 policy Sh2.

Informatives:

1. The food business operator will need to register the business with the Council 28 days before opening and is recommended to contact Environmental Health for advice prior to finalising the design of the ventilation extract system.

2. Thames Water recommends that a bacterial or enzyme dosing unit be fitted on all waste discharge points from kitchen sinks and floor drains prior to discharging to the public sewerage system to avoid blockages at a later date.

3. This permission does not purport to grant permission for any signage which would require separate advertisement consent.

4. The required crossfall of the footway is 1:40. The required longitudinal gradient should be no more than 1:20.

5. Details of the highway requirements necessary for inclusion in any application seeking approval of reserved matters may be obtained from the Transportation Development Control Division of Surrey County Council.

6. The permission hereby granted shall not be construed as authority to carry out works on the highway. The applicant is advised that a licence must be obtained from the Highway Authority before any works are carried out on any footway, footpath, carriageway, verge or other land forming part of the highway.

173.  planning applications 05/02094/cu and 05/02707/f – 1, 3 and 5walton street, walton-on-the-hill

Consideration was given to applications for the change of use of 3 and 5 Walton Street from retail to restaurant use in conjunction with the restaurant at 1 Walton Street and the change of condition 2 of 03/02389/CU to extend the opening hours at 1 Walton Street.

(a) Application 05/02094/CU

The Committee was minded to refuse this application contrary to Officer advice, but in accordance with agreed procedures it was

RESOLVED that consideration of this application be DEFERRED to the next ordinary meeting to enable a site visit to be held on a date and time to be agreed in consultation with the Chairman.

(b) Application 05/02707/F

RESOLVED that planning permission be REFUSED for the following reason:

The proposed extension of the opening hours of the restaurant would result in noise and disturbance to surrounding residential properties late into the night, harmful to their residential amenities and failing to preserve the quiet character of this part of the Walton-on-the-Hill Conservation Area, contrary to policies, Sh11, Sh12 and Pc13 of the Reigate and Banstead Borough Local Plan 2005 and policy SE5 of the Surrey Structure Plan 2004.

174.  PLANNING APPLICATION 05/02243/F – ORCHARD HOUSE, THE WAY, REIGATE

The Committee considered a report on an application for the demolition of the existing dwelling and the erection of two pairs of dwellings and a bungalow at the above location. A representative of the Residents’ Association addressed the Committee in support of theapplication, and it was noted that a site visit had been held in connection with a previous application at this location.

RESOLVED that planning permission be REFUSED for the following reason:

The proposed development, by reason of its low density on a site that has capacity for a higher density development in a sustainable location and on a site in excess of 0.4 hectares, would result in the inefficient use of land for which no adequate design justification has been provided. The proposal would therefore be contrary to policy Ho9A of the Reigate and Banstead Borough Local Plan 2005, policy SE4 of the Surrey Structure Plan 2004 and advice contained in PPG 3 “Housing”.

(NOTE: Councillors M.A. Brunt and D.J. Pay declared a personal and prejudicial interestin the above application and withdrew from the meeting during consideration thereof. Councillor C.T.H. Whinney declared a personal interest in the above application.)

175.  planning application 05/02456/f – 18-20 holmethorpe avenue, redhill

Consideration was given to an application for the alteration and expansion of the existing premises to provide increased warehouse space at the above location.

RESOLVED that planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason:

To comply with Section 91(1) of the Town and Country Planning Act 1990.

2. No development shall take place until samples of the materials to be used in the construction of the external surfaces, including fenestration and roof, have been submitted to and approved in writing by the Local Planning Authority, and on development shall be carried out in accordance with the approved details.

Reason:

To ensure that a satisfactory external appearance is achieved of the development with regard to Reigate and Banstead Borough Local Plan 2005 policies Em3 and Em8.

3. No development shall commence on site until a scheme for the landscaping and tree planting of the site has been submitted and approved in writing by the Local Planning Authority. Landscaping schemes shall include details of hard landscaping, planting plans, written specifications (including cultivation and other operations associated with tree, shrub, hedge or grass establishment), schedules of plants, noting species, plant sizes and proposed numbers/densities and an implementation programme.

Reason:

To ensure that good arboricultural and landscape practice is followed, and to preserve and enhance the character and appearance of the area with regard to Reigate and Banstead Borough Local Plan 2005 policy Pc4 and Surrey Structure Plan 2004 policies SE9 and SE4.

4. All hard and soft landscaping work shall be completed in full accordance with the approved scheme, prior to completion of the development hereby approved, or in accordance with a programme agreed with the local planning authority and the following will apply:

All trees shrubs, hedges and plants supplied shall comply with the requirements of British Standard 3936, specification for nursery stock and British Standard 4043:1989 Transplanting root-balled trees. All pre planting site preparation, planting and post-planting maintenance work shall be carried out in accordance with the requirements of British Standard 4428 (1989) Code of Practice for general landscape operations (excluding hard surfaces).

All new tree planting shall be positioned in accordance with guidelines and advice contained in the current British Standard 5837 “Trees in relation to construction”.

Any trees shrubs or plants planted in accordance with this condition which are removed, die or become severely damaged or become severely diseased within five years of planting shall be replaced within the next planting season by trees, and shrubs of the same size and species.

Reason:

In the interests of the character and appearance of the area and with regard to Reigate and Banstead Borough Local Plan 2005 policy Pc4 and Surrey Structure Plan 2004 policies SE9 and SE4.

176.  PLANNING APPLICATION 05/02235/F – 26 STATION APPROACH, TADWORTH

The Committee considered a report on an application for the sub-division to form two shop units, insertion of shop front and single storey rear addition at the above location.

RESOLVED that planning permission be GRANTED subject to the following conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason:

To comply with Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 (1) of the Planning and Compulsory Purchase Act 2004.

2. The land at the side of the premises shall be retained and made available for the storage of waste and recycling bins associated with both 26 Station Approach and the new retail unit hereby permitted, and ancillary staff parking when not required for access purposes.

Reason:

In the interest of the amenities of the surrounding area, in accordance with Reigate and Banstead Local Plan policy Sh2.

Informative:

1. The applicant is advised that prior to the initial occupation of the new retail unit, a wheeled refuse bin conforming to British Standard RG723/2, and separate recycling bins for paper/card and mixed cans should be installed.
