I – SPECIFIC CONDITIONS

SIMPLIFIED PROCEDURE FOR DIRECT PROCUREMENT

1 – PURPOSE OF THE PROCUREMENT

The purpose of this Procurement is to purchase two small refrigerators and twoelectriccookers (3 or 4 burners) for the Argentine Residence in Abuja, located at No. 9 Rio Negro Close Maitama, according to the terms and conditions stated in this bidding procedure.

2 – HOW TO SUBMIT BIDS

Bids should be submitted:

a) Closed envelope to be submitted at No 30 Nelson Mandela Street, Asokoro, Abuja on business days, from 9:30 to 13:00hrs, until Friday the 08th of May, 2015by13:00hrs.

b) By e-mail to , until 08thof May, 2015 at 13:00hrs.

Submission of a bid implies full knowledge and acceptance by the bidder of the provisions governing this Procurement and the interpretation of its precise scope.

Bids may only be submitted until the submission deadline established. No changes introduced thereafter will be accepted.

3 – CONTENT OF THE BID

The bid must be drafted in English, signed by a company official or legal representative. Any changes such as amendments, cancelations, text or numbers added between lines must signby the company official or legal representative.

The bid must be signed on each and every page by the bidder or their legal representative.

The bid must contain the following information:

3.1) Name and surname or company’s name, address, telephone number, fax number and e-mail address.

3.2) Address in Abuja and copy of the company’s Certificate of Incorporation indicating valid registration number.

3.3) If the Bid should be signed by a legal representative, copy of the Mandate and Professional registration of such Representative should be presented.

3.4) Description of the services and any other relevant information relating to the services must be included where applicable; including information on where the Embassy’s properties will be relocating.

3.5) Filling of the quotation form will be done according to point 5 of this Procurement Procedure, and signed by the Bidder or Legal Representative.

4 – QUOTING METHOD

The quote form must be signed by the bidder or its legal representative.

The total price stated in the quote will be the final amount to pay by the Embassy and should be expressed in Nairas (mentioning amount in USD).

Price should include all taxes and transportation or any other charges that may affect the final amount that the Embassy should pay.

Any mistake on the price, not denounced before the opening of the biddings will make be dismissed.

5 – VALIDITY OF THE BID

The quotes presented at this bidding should be valid for at 30(thirty) days from the opening of the Biddings. If any modifications should arise, it should be communicated to this Embassy within ten days prior to the 30 Days expiration of the Quotation. If no communication received, it is assumed that the offer was automatically renewed, and the price given is still valid.

6 – OPENING OF BIDS

At the date and time indicated by this Procurement Procedure, there will be a public opening procedure of the bids. An Act will be signed by the Embassy officials as well as the bidder’s representative present at the Act. Bidders should make sure that all the documents presented in the name of the bidder or company must be signed by the bidder or its legal representative.

7 – REVIEW OF BIDS

During the bid analysis period, bidders may be asked to rectify, amenderrors or omissions in their bids.These amendments or omissions cannot change the essence of the Bid, nor alters quotes to gain advantage over other bidders.

If a Bidder fails to act upon the rectifications requested within the term established, their bid will be non-amendable grounds for bid dismissal deemed abandoned.

8 – NON-AMENDABLE GROUNDS FOR BID DISMISSAL

Bids will be dismissed with no opportunity for rectification in the following cases:

a)Bids drafted in a language other than that established in the bidding terms and conditions.

b)Bids that are not signed by the bidder or their legal representative in any of the pages.

c)Bids containing erasures, deletions, amendments or text added between lines that are not initialled in the financial proposal, the description of the goods or services offered, the term of delivery, or any other section that is of the essence to the contract.

d)Bids that have a shorter term of validity than that established in the bidding terms and conditions.

e)Bids drafted in pencil or any other means that can be erased and rewritten without trace.

f)Bids submitted by persons who are currently suspended or prohibited from seeking contracts with the Argentine Government at the time of the opening of the bids, during the bid review period, or at the time of the award.

g)Bids submitted by individuals or legal entities that are not authorized to seek contracts with the Argentine Government at the time of the opening of the bids, during the bid review period, or at the time of the award.

h)Bids containing any qualifications.

i)Bids containing terms that infringe the rules governing the procurement or that prevent a precise comparison against the rest of the bids.

j)Bids containing substantial errors or omissions.

k)Bids with quoted prices that are excessively low or not serious.

l)Bidders who are ineligible.

m)Bidders submitting more than one bid, either on their own or as part of a group, association or legal entity. This prohibition shall not apply where bids submitted include discounts, alternatives or different options.

n)Samples not included within the term established in the bidding terms and conditions, where applicable.

9 – AWARD

The contract will be awarded to the offer that is considered more convenient to this Embassy, taking into consideration, requirements of this procurement, price, quality, and services provided by the bidders.

The successful bidder will be notified as well asevery bidder within 3(Three) days from the adjudication by:

a)Direct contact with the bidder or their legal representative.

b)By written letter.

c)By E-mail

The Awarded Bidder should present an Invoice including all the services.

10 – TIME AND PLACE OF DELIVERY

The home appliances will be delivered toNo. 9 Rio Negro Close Maitamawithout any damages. The Embassy will determine the most convenient time for the fulfilment of this contract within reasonable hours.

11 – TIME AND PLACE OF PERFORMANCE OF THE CONTRACT

The services to deliverthe home appliancesshall be done within two (2) working days.

12 – ACKNOWLEDGEMENT OF RECEIPT

The Embassy officials shall be the ones to acknowledge receipt of the home appliances.

13 – TERMS OF PAYMENT AND SUBMISSION OF INVOICES

The payment will be effective after the receipt of the home appliances in full conformity of this Embassy.The invoiceshould be submitted after the contract is awarded.

14–GUARANTEE FORSERVICES

The bidder has to assure the Embassy that he/she would deliver excellent quality of the home appliances. Guarantee of at least 1 year required.

15 – TERMINATION OFTHE CONTRACT

Where the successful bidder expressly abandons the contract before the term established for its fulfilment,or where the electronic equipmentremain undelivered after the expiry of said term, the procuring entity will declare the contract terminated without any court or out-of-court procedures, unless it decides to accept late fulfilment.

16– LIABILITY

The contracted bidder, should abide by the rules and legal principles of the signed contract according to its activity and its responsible for any and all judiciary or extra judiciary claims this Embassy may present and will pay and all costs derived from its acts or omissions, from its personnel or subcontractors or third parties responsible, in complying with any and all terms and conditions of the present agreement and contract.
