NOTICE TO BIDDERS
Berne-Knox-Westerlo Central School District
Take notice that sealed bids will be received at the Office of the Board of Education of the Berne-Knox-Westerlo Central Schools in Berne, New York until 10:00 a.m. onTuesday, the 30th day of May, 2006, for furnishing the materials, supplies or equipment set forth below:
1. Ice Cream Vending
2. Milk
3. Custodial Supplies
4. Transportation Supplies
DEPOSIT OF BIDS:
All bids received after the designated time stated above will not be considered and will be returned to the bidder unopened.
The bidder assumes the risk of any delay in the mail. Whether sent by mail or by means of personal delivery, the bidder assumes responsibility for having his bid deposited on time in The Office of the Board of Education.
Bids will not be considered unless made out on this and the attached forms and signed by the bidder.
Bids should be either typewritten or written in ink. Bids submitted in pencil may be rejected.
Changes, alterations, or interlineations in the bid, may at the discretion of the Board of Education void this bid entirely or as to the part changed, altered, or interlined.
BIDDER'S KNOWLEDGE OF SPECIFICATIONS PRESUMED:
The submission of a proposal by a contractor will be construed as an indication that he is fully informed as to the extent and character of the supplies, materials, or equipment required and can furnish the supplies, materials, or equipment satisfactorily in complete compliance with the specifications without any extras.
BID OPENING AND AWARDS; BID IRREVOCABLE:
The bids will be opened publicly by the Clerk of the Board after the time designated for the receipt of bids and shall thereafter be irrevocable for a period of sixty days. The Board of Education reserves the right to award bids on individual items or on the total lump sum bid whichever will be for the benefit of the school district. The award of the contract shall be made according to law as soon after the bid opening is practicable.
CONTRACT - HOW CREATED - DOCUMENTS COMPRISING CONTRACT:
The Board of Education will not require the successful bidder to execute contract documents after the award of the bid. Instead, in order to reduce paper work to a minimum, the notification of the successful bidder by the Board of Education of the award of the bid will be deemed an acceptance by the school district of the offer of such bidder to furnish the materials, supplies, or equipment set forth in his bid offer and will create a contract therefore. Such contract documents shall consist of the "Notice to Bidders", the "Specifications", the "Bid Offer", and the "Notification of Award of Contract".
PAYMENT - BIDDER TO STATE DISCOUNT:
Payment will be made after presentation of a properly executed bill, which must be submitted subsequent to delivery. Unless specifications indicate otherwise, the bidder shall state discount which will be allowed the school district, if payment is made within 10 days after presentation of voucher showing delivery. In absence of discount to school district, payment will be made on a monthly basis after presentation of voucher showing delivery, unless specifications show other means of payment.
EXEMPTION FROM CERTAIN TAXES:
Purchases made by the School District are not subject to any Sales or Federal Excise Tax. Exemption certificates must be furnished by the Contractor.
SAMPLES - ITEMS WITHIN 10%:
The Board of Education reserves the right to require samples form any bidder before or after opening the bids.
