The district obtained and is now using the mandated forms to document the eligibility determination for Specific Learning Disabilities(SLD).
Department Order of Corrective Action:
Please train the appropriate staff on the use of the mandated SLD forms. Develop an internal monitoring system that includes supervisory oversight and periodic reviews to ensure compliance. Following the district's implementation of its corrective actions, report the results of an internal review of student records for those students who were identified has having a SLD for evidence of compliance with the use of the SLD forms.

Submit evidence of staff training, including an agenda and signed attendance sheets(indicating name and role of staff). Submit a description of the oversight system and identify the person(s) responsible for oversight, including the date of the system's implementation. Please submit this progress report by September 28, 2012.

Include the following: Number of records reviewed; Number of records in compliance; For all records not in compliance with this criterion provide corrective actions taken by the district to remedy any non-compliance. Staff interviews and document review indicated that Benjamin Banneker Charter School does not have a sufficient number of teachers trained in Sheltered English Immersion, therefore limiting access to the general curriculum for LEP students.
Description of Corrective Action:
The district is awaiting review and approval of the proposed amendments to the regulations for Education of English Learners, 603 CMR 14.00 in conjunction with statewide adoption WEDA standards and assessment tools and the anticipated impact on curriculum design and professional development, once standards are in place the district assures the Department that we will develop a professional development plan that aligns with all professional development requirements.

The documentation review indicated that Benjamin Banneker Charter School does not have a policy for students who become pregnant.
Description of Corrective Action:
If a student should become pregnant:
1. Pregnant students are permitted to remain in regular classes and participate in extracurricular activities with non-pregnant students throughout their pregnancy,
2. After giving birth are permitted to return to the same academic and extracurricular program as before the leave.
The district does not require a pregnant student to obtain the certification of a physician that the student is physically and emotionally able to continue in school unless it requires such certification for all students for other physical or emotional conditions requiring the attention of a physician.
In no way will they be singled out for their condition.

Department CPR Finding: Documentation reviewed indicated that the district has begun to develop a curriculum for English language learners (ELLs) who scored at level one on the MEPA (Massachusetts English Proficiency Assessment). The district is using the Literacy Collaborative Language and Literacy Framework in conjunction with the English Language Proficiency Benchmarks and Outcomes (ELPBO). Regarding the curriculum, the district should note that the Department has new regulations in place, which may affect the district’s corrective action plan (CAP). Please refer to: for more information.
Concerning English as a second language (ESL) services, the district provides these services.
However, the Department could not verify amounts of ESL being provided at each MEPA level because specific hours of ESL instruction per week were not specified. (Please refer to - p. 5)
For comments on Sheltered English Immersion (SEI) professional development training, please see ELE 15.
To summarize the district does not have a fully implemented SEI program as the development of an ESL curriculum is in the beginning stages, content area teachers have not received training in all four SEI categories, and the hours of ESL instruction provided to ELLs could not be verified.
Narrative Description of Corrective Action:
- ESL Curriculum: Begin process of adding to our beginner’s curriculum for ELLs by overlaying WIDA standards onto district curriculum created from Massachusetts Curriculum Frameworks. Process will begin by becoming more familiar with WIDA standards by attending sessions hosted by WIDA & DESE; investigating process others used when developing curriculum, and using resources from the WIDA website as well as those created for teaching ELLs. The curriculum team, ESL team and administrators will collaborate to create an ESL curriculum.
- SEI endorsement Course: Teachers have been informed about the requirements for enrolling in the SEI endorsement course. They have been sent the Teacher Letter and have enrolled in the course. As additional information comes from DESE with regards to SEI endorsement, this information will be disseminated to all staff via email or during a staff meeting.
- ESL instruction provided to ELLs: At the beginning of the school year, ESL staff will meet with the ESL coordinator to review guidelines for amount of instructional hours recommended based on ACCESS scores and English Language Proficiency. Additionally, student performance including but not limited to; internal assessments, class participation, teacher input, and MCAS scores; will be considered. Service delivery hours will be indicated on ESL teacher’s schedule. Guidance for determination of amount of service hours will be disseminated to staff and will be part of an ESL Program Resource Book.
