Purchase Agreement for “Priority Buyer”
This agreement is for the purchase of a 2016 Foal that has NOT been selected yet. Terms of the purchase are outlined in this agreement including several purchase options.
Advantages of becoming a Priority Buyer:
*Priority Buyers receive Notice of Births of available Foals Before the General Public.
* Priority Buyers are able to Select New-Born Foals Before the General Public.
* Priority Buyers receive Notice when additional Foals become Available that were not previously available.
*Priority Buyers receive Notice (before the general public) if a buyer defaults on payments, and a Foal becomes available that was previously reserved.
*Making payments over an extended period of time allows for smaller payments. Smaller payments are often easier on monthly or bi-weekly budgets in many cases.
*Buyers don’t always have the finances, facilities, experience, or knowledge to have broodmares and raise foals… but buying a foal before it is born, or just after birth gives the buyer the excitement of the birth of the foal… and then the buyer gets to witness the growth and development of the foal through photographs and/or visits to the ranch.
*Buyer is not responsible for the cost of the broodmare, stud fees, and broodmare care… or the responsibility of the care at birth and raising the foal.
*Mares bred at our facility receive pre-breeding exams, vaccinations, and routine dental care. Our mares are ultra-sounded during her cycle to monitor her reproductive health, and to monitor follicle development and ovulation in an added effort to insure the best pregnancy outcome, and screen for twins. We Ultrasound our mares’ pregnancies at different intervals to insure the pregnancy is developing normally.
*Mares at our ranch are bred A.I. so we know exact breeding dates, and can predict due dates.
*The selected foal benefits from the early planning of the sale, and is paired up with his/her new owner sooner… and the buyer and foal get to start forming a partnership and developing a relationship.

Deposit … Foal Announcements … Foal Selection:
1. Buyer wishes to purchase a 2016 Foal from Seller. Buyer has NOT chosen a Specific foal at the time of this agreement. A Deposit of $500.will be accepted as a down payment toward the purchase of a foal/horse. Deposits are non-refundable. Buyers who pay a Deposit on a 2016 Foalwill become a “Priority Buyer”. They receive advanceNotification of births of Foals, and are able to Select available foals before the general public.
2. When an Available Foal is Born… Seller will contact (by Email)all Priority Buyers who have paid Deposits on Foals. Seller will send photos of the newborn foal, and information about the foal including current price, sex, color, etc.
3. A Buyer may then select That newborn, or may Wait until additional Foals are born to make a selection. No Foal will be taken off the Available List without a Deposit, signed Purchase Agreement, and an additional payment. The buyer who contacts Bedonna first, and whose next payment is Received First will be the Buyer of that Foal/Horse. Any Disputes between buyers will be settled by whose Payment was received first.
4. Priority Buyers may Select any Available Foal born in 2016.Prices and Availability Status will be Updated on Website regularly, but Buyer must contact Seller to confirm any changes.
5. Buyer may choose a foal before it is born, or wait until after a Foal is born to select it. Prices are subject to change. Prices are negotiated between Seller and Buyer. Current Prices and Availability for Un-Born Foals and Foals that have already been born are listed on Website and updated regularly, but information must be confirmed by contacting Seller.
6. If the Buyer does Not select a 2016 Foal… the Deposit may be Applied toward the purchase of any available 2015 Foal, 2014 Foal, broodmare, or other available horse for sale owned by Seller.
7. If the Buyer does not select a 2016 Foal… the Deposit may be Applied toward the purchase of any available 2017 Foal.
8. Buyer has Until JULY31, 2017… to use their Deposit, and Select any available foal/horse.
9. Board is not charged for a Foal under 4 mo. of age. However, Board Charges usually apply during Payment Plans of any Weaned Foal, Yearling, and older horse until picked up.
Guarantees and Terms of Sale:
1. The Seller of allavailable foals is the Owner of the Dams of the foals, and has Full Authority to sell Foals. Seller is also legal owner of any other foal/horse listed available for sale, and has the legal right to enter into a sales agreement to sell the foal/horse.
2. The Seller Guarantees the Registration Papers and Completed Transfer of Ownership to all Foals/Horses that are Registered or eligible for Registration with AQHA, APHA, ApHC, or other Breed Associations.
3. Seller will Register Foals, if eligible, and pay the fees to Register the foals.
4. Seller will care for the Dam of the foal during her pregnancy. Seller will provide her feed, health care, vaccinations, de-worming, and dental care. The cost of Dam’s care is the responsibility of the seller.
5. Seller will provide care ofFoals at time of birth. Seller will treat foal’s navel and administer oral supplements to foals the day they are born.
6. This agreement includes a Live Foal Guarantee if Buyer chooses a foal before it’s born.
7. Seller will contact all Priority Buyers when the foals are born and provide information about foals and photos of foals.
8. Seller will care for Dams and Foals at Seller’s Ranch. Foals will be weaned when around 4 months old.
9. Seller will provide initial halter-training or young foals with her donkeys. (Note- See our website for more info about our donkey-time and donkey-training program.)
10. Seller guarantees the chosen foal to be Healthy, free from illness, and that the foal has no serious Injuries or Lameness at the time the foal is weaned and ready for pick up.
11. Seller is responsible for cost of feed and care of selected Foal including de-worming through weaning time, and initial halter training.
12. When foal or horse is ready to be picked up... The cost of care will be the responsibility of the Buyer. Board will be charged $_____ per day after foal/horse is ready to be picked up. Buyer must pick up foal/horse as soon as possible unless other long-term arrangements have been made with seller. Buyer must pay expenses monthly if boarded. Failure to pay for Foal/Horse & expenses will cancel sale. If buyer fails to pick up foal/horse 60 days after weaning/ready… the foal/horse may be considered abandoned and the seller has the right to cancel the sale with no refunds.
13. Buyer may pick up foal/horse personally or hire a hauler to transport him/her. Buyer is responsible for Transport Costs. Seller will assist in proving names of approved horse transport companies if needed. Seller will work closely with Buyer and Hauler to coordinate safe transport of foal/horse.
14. Buyer may have a Vet examine foal/horse before pickup. Cost of any vet exams or tests are the responsibility of the buyer.
15. Seller will arrange for any Coggins Tests and Health Certificates needed for transport. These can be done by seller’s vet at a reasonable fee. Buyer will be required to reimburse any of these vet costs. Note- As of 1/01/16, the local vet fees are: $25 for a Coggins, $25 for the Health Certificate, and $32 for the farm call.
16. Seller will provide a halter for any weaned foal.
17. Seller will provide some hay and feed to buyer at time of pick up for transport, and for transition to new diet.
Steps to Completing Sale-
1. Buyer completes this Priority Buyer Agreement, and includes the $500 Deposit.
2. Priority Buyer will receive Email notices of new Foals, and may also view Website at any time to see updated information and photos of foals.
3. When Priority Buyer sees a Foal/Horse they may want… they should contact Seller immediately to discuss. Availability and information can also be confirmed at this time.
4. A Payment Schedule will be discussed and decided for the Balance of the Foal/Horse. Payment Plans are customized for each buyer.
5. When a Foal/Horse has been selected… the Priority Buyer then sends another Payment toward the purchase of the Foal/Horse. Minimum of $500 required for next payment, or 25% of Balance, and to take that Foal/Horse off the market. Note- No Foal/Horse will be reserved for Buyer without the next payment. Buyers should plan ahead and set up PayPal accounts, or be prepared to make next payment with a Debt/credit card to secure Selected Foal/Horse.
6. Seller will complete Supplemental Page of this agreement, and send a copy to Priority Buyer.
7. Foal/horse must be paid in full along with other expenses due (example: Coggins Test, etc.) before foal/horse may be picked up.
Reasons the Buyer may Transfer All Paid Moneys To a Different Foal/Horse:
1. If a specific un-born foal is Selected, but that Dam fails to deliver a Live Foal.
2. If Selected Foal is born with a rare Birth Defect. (example: Cleft Pallet)
3. If Selected Foal Dies or becomes seriously injured before weaned and picked up. (examples: Leg Injuries resulting in permanent lameness or permanent unsoundness; Eye injuries resulting in loss of vision.)
Note: Please keep in mind that as foals grow and play, and older horses live in groups in the pasture… minor scuffs and scratches may occur.

Payments for each Purchase will be customized to each buyer.
Payment Plans are often scheduled to be completed when foal is 4 months old and approaching time to be picked up.
Several Payment Options available(some fees may apply to some forms of payment, but are waived for others)
Preferred Payment: Cash, US Bank Cashier’s Checks, US Money Orders, and Bank Wire Transfers are accepted. Personal or Business Checks are NOT accepted Unless they are received at least 4 Weeks Prior to Foal being picked up to allow time to clear bank. Processing and/or Convenience Fees are Waived with these forms of payment.
PayPal: PayPal payments can be accepted if sender Adds 5% to balance to cover transaction fees, or sends where fees are not removed from payment.

Alternate Payment Methods: Visa, Master Card and Discover (Credit Cards or Debit Cards) are accepted as payment for your convenience and a 5% Convenience Fee will be added to total for each transaction.
**By Signing this Agreement, the Buyer authorizes that he/she has permission to use below listed card or any Other Card that is provided. Fees may be charged to Cards as outlined in this agreement for payments and/or expenses. Buyer is responsible for card use and payment of all fees and for any Card Information given in this agreement or given verbally over the phone and is responsible for any and all fees charged to a Card, regardless of name of Card Holder. If Card Holder is a spouse, relative, friend, etc…. it is still the Buyer who is ultimately responsible in making sure all fees are paid.

*** This contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied, are included unless specifically stated in this written contract. This contract is entered into the State of Oklahoma, and will be interpreted and enforced under its laws. If any dispute should arise, then it will be governed by the laws and courts in Tillman County, Oklahoma. If any clause in this contract is against state law, then that clause shall become null and void. When both parties sign this agreement, it will then become a binding contract on both parties, subject to these terms and conditions. ******
