ADDITIONAL INFORMATION

Bayberry Lakes By-LawsThe Board asked that all driveways and sidewalks be kept clean by pressure washing for the safety of our Members who walk and for children who walk on their way to school and also the esthetics of our community. Please refer to Rules and Regulations

Pool and Basketball RulesThe pool use is for residents and guests only must be accompanied by a resident. You need a FOB to gain entrance to the Pool and Basketball area. A FOB may be obtained from Clifton Management.

Pool Hours – Dawn to Dusk

Basketball – 8AM – Dusk

ClubhouseThe Clubhouse may be reserved by the homeowners’ for various functions (no commercial functions). Our website has a calendar showing dates that are available. (Updated the 15th and 30th of each month). The application is interactive and when completed will automatically be sent to Clifton Management for updating the calendar. Within seven (7) days after reserving, a check for $250.00 security deposit must be received by Clifton Management 1326 S. Ridgewood Ave., Suite 14 Daytona Beach, FL 32114.Be sure to read the guidelines. The first rental in a calendar year is free and each additional rental in that year is $100.00. All Owners are required to follow the cleaning instructions as outlined in the application and any non-compliance would require retaining the security deposit. As long as everything is left clean with the floors cleaned and mopped and no damage, the security deposit will not be cashed. Brighthouse Wi-Fi is available at the Clubhouse. All functions at the clubhouse are recorded via Security Cameras.

Trash Pick-Up & Recycling

& Yard DebrisThe city contracts with WastePro (386-732-1225). (Trash pickup is on Tuesdays and Fridays with recycling on Friday and Yard debris on Wednesday). All Items shall be placed curbside and in proper containers. We live in Black Bear country as well as other wild animals. Trash should be placed on the curb not before dawn of the day of pickup and retrieved by dusk on the day of pickup. May we also warn you the Bears have the same schedule for visiting the community.

Yard IrrigationAll irrigation is via reclaimed water and is not potable and the system is operated by the City of Daytona Beach.

RULES AND REGULATIONS

From the By-Laws of the Bayberry Lakes Homeowners’ Association

ARTICLE XI

RULES AND REGULATIONS
11.0 As to Common Property. The Board may, from time to time, adopt or amend previously adopted Rules and Regulations governing the details of the operation, use, maintenance, management, and control of the Common Property and any facilities or services made available to the Members.

4.6 Rules and Regulations:

The following Rules and Regulations are approved by vote of the Board of Directors on ______

The Rules and Regulations are enforceable by the Homeowners’ Association under the status 720:305 for the State of Florida. The Rules and Regulations are to work in conjunction with the Bayberry Lakes Homeowners’ Association incorporation documents as well as the By-Laws for the Bayberry Lakes Homeowners’ Association.

The Rules and Regulations for Bayberry Lakes Community are in line with the laws of the State of Florida, Volusia County and Daytona Beach. The Board of Directors and all Committees of the Association are obligated to protect the safety of the residents and property values as well as creating a friendly and healthy environment for the community.

Structural Changes

Any and all changes (included but not limited to – Roof, Stucco or Brick, trim, garage door, shutters) to the appearance of a residence in the community shall be submitted by the 20th of the previous month in advance to the Architectural Committee. The request shall be made in writing on the form provided on the community website. The Architectural Committee meets once a month and is always open to all residents. The completed form and required documents may be submitted to: Clifton Management 1326 S. Ridgewood Ave Suite 14, Daytona Beach, FL 32114.

Parking:

The Associationwill have the same rules and regulations as the City of Daytona Beach, Florida ordinances concerning parking in the community, as well as Section 4.10 Parking

  1. No parking on the sidewalk or obstruction of the sidewalk from foot traffic.
  2. No parking on the streets.

It is recommendation of the Board of Directors that you review Section 94 ordinance for the City of Daytona Beach. Part of that ordinance is listed below:

Sec. 94-38 – Parking Restrictions generally

(a)

The Chief of Police may request the traffic engineer to erect signs within the City which shall be plainly marked permitting, restricting or prohibiting stopping, standing or parking of vehicles upon streets or portions of streets during certain hours of certain days.

(b)

Whenever motor vehicle without a driver is parked, stopped or standing in a restricted or unrestricted parking area, a police officer or parking enforcement specialist may mark the vehicle and shall note the time, so that if the vehicle remains parked, stopped or standing in violation of subsection (b) of this section, the police officer shall take its registration number and shall take any other information displayed on the vehicle which may identify its user. The police officer or parking enforcement specialist shall then conspicuously affix to such vehicle a parking ticket in writing on a form provided by the City Clerk.

Sec. 94-181. – Front yard parking

No person shall park or store any motor vehicle, boat, trailer or recreational vehicle in the front or back yard of any residential district, except as follows:

(1)

The temporary parking of trucks and commercial vehicles shall be permitted in accordance with Article 17 of the Land Development Code, Ordinance No. 93-187, as amended.

(2)

The parking of boats and recreational vehicles/trailers shall be permitted for up to two hours on any calendar day for washing or cleaning.

Sec. 94-182. – Nuisance declared

The existence of a motor vehicle, boat, trailer, or recreational vehicle in the front or back yard of any residential district, is a violation of Section 94-181, adversely affects neighborhood aesthetics and property values, contributes to the neighborhood blight, and is declared to constitute a public nuisance. Such a nuisance may be removed and abated as provided in Section 94-183.

The Board of Directors has voted in the past to allow one overnight parking of recreational vehicle for the purpose of cleaning. If this is intended, the Management Company or a Board Member must be advised in advance f the overnight stay. And per 4.10, boats, motor homes may be stored on lots containing a residence with an enclosed garage.

Rental of Homes – 1.11-Single Family

Rental of Homes:

The Owner of the home shall provide to the Management Company a copy of the license provided by the City of Daytona Beach defining that the Owner has the legal right to rent the house. See the ordinance below.

Sec. 26-294 – License required

(a)

It shall be unlawful to rent or lease, or offer to rent or lease, any residential rental unit without a current residential rental license for the unit, a copy of which shall be posted or available at the residential rental property.

Sec. 26-299 – Enforcement

(a)

The code enforcement board/special magistrate shall have jurisdiction to enforce the provisions of this article, and any person, firm, corporation, or agent determined to be in violation shall be subject to all penalties and remedies available to the board magistrate as provided by law.

Air Condition Unit (Window and or Wall Unit)

4.32 No window or wall a/c units shall be permitted

Garbage Cans

Containers such as garbage can or any other item that contains garbage are allowed to be out the day of and picked up the collection day. Containers may be placed curbside the morning of collection day and retrieved the night of collection. No garbage cans or containers shall be stored in a location front and/or side yard that is visible from the street.

68A-4.001 General Prohibitions

(1)(a) Intentionally feeding bears is prohibited except proved for in this Title.

(b) Placing food or garbage, allowing the placement of food or offering food or garbage that attracts bears and is likely to create or creates a nuisance is prohibited after receiving prior written notification from the Commission.

(2)No person shall take or assist in taking wildlife using a method that involves remote control aiming and discharging of a gun when that person is not physically present at the location of that gun.
