In accordance with the public procurement order published in the Official Gazette of the Republic of Slovenia, No. dated , for the following contract:

the contracting authority (the beneficiary of this guarantee) requires that the bidder, as an earnest of the bid in this public procurement order, secures for the contracting authority a bank guarantee of EUR .

The bank undertakes to pay the stipulated amount in the following cases:

a)if the bidder withdraws or changes their bid during the time of the validity of the bid stipulated therewith:

or

b)if the bidder, whom, during the time of the validity of the bid, the contracting authority informs of the acceptance of his/her bid:

  • refuses to conclude the contract or fails to conclude the contract in accordance with the provisions stipulated in the Instructions to the bidder;

or

  • fails to submit or refuses to submit the performance bond in accordance with the provisions stipulated in the Instructions to the bidder.

We undertake to pay to the contracting authority the sum stipulated herein, without requesting any additional argumentation, within 15 days of the receipt of the contracting authority's first written claim, on condition that in its claim the contracting authority states that the sum be paid to the contracting authority as a result of the occurrence of one or both of the aforementioned cases, and states which case(s) apply.

The claim for retaining the guarantee must be submitted to the bank and must contain:

1. the original letter of the contracting authority for redeeming the guarantee in compliance with the foregoing paragraph, and

2. a submitted statement of the Public Payments Administration of the Republic of Slovenia that the claim for redeeming the guarantee has been signed by a person authorised to do so, and

3. the original of the Guarantee No. /.

This guarantee shall be reduced by each sum forfeited in accordance with this guarantee.

This guarantee shall be deemed valid until a bidder for the aforementioned public procurement is selected, and (in the event that a whole or partial bid is accepted), until the time that the chosen bidder concludes the contract with the contracting authority and submits to the said authority the performance bond, but by the expiry of the validity of the contract at the latest.

If no claim is received regarding the payment of the guaranteed sum by , this guarantee expires, regardless of whether it is has been returned to us.

This guarantee is not transferable.

Any disputes between the beneficiary and the bank are subject to Slovenian law and shall fall within the jurisdiction of the competent court in Ljubljana.
