Award-Winning Houston Criminal Defense Attorney Wins Two Not Guilty Verdicts

Mark Thiessen Successfully Defends Two DWI Cases In Montgomery And Harris Counties

HOUSTON–April 5, 2014–Localcriminal defense attorney Mark Thiessen has secured two notable victories in separate DWI cases this year, including his fifth overall not guilty verdict for a case involving a blood test.

In case#12-283384, which took place in Montgomery County Court of Law No. 1 on February 10, 2014, a not guilty verdict was handed down when the jury decided that there was not enough evidence to prosecute within reasonable doubt. Thiessen’s client was caught speeding at 76 MPH down I-45 and was pulled over by a state trooper. The trooper administered several standard field sobriety teststhough the driver displayed no overt signs on intoxication[JR1]. Blood and breath tests wererefused. The jury acknowledged probable cause owing to her speeding.

Case #1879089 in the Harris County Criminal Court at Law No. 12, completed on March 5, 2014, was Mark Thiessen’s fifth overall not guilty verdict where the blood test was admitted as evidence, but the jury did not accept the results as reliable or accurate. The client allegedly committed a felony traffic stop. Despite the driver’s ACL surgery five weeks prior, the arresting officer required him to walk one line and drop to his knees. His blood test, taken without his consent despite a willingness to undergo a breath test, revealed a 0.184 BA level, well under the legal limit of .08. Furthermore, questionable ASCLD protocoland equipmentin the lab called the evidence into question.
