The ABCC’s primary responsibility is to regulate workplace relations laws in the building and construction industry through education, advice and compliance activities.

Overview

The Australian Building and Construction Commission (ABCC) promotes an improved workplace relations framework to ensure that building work is carried out fairly, efficiently and productively for the benefit of all building industry participants, without distinction, and for the benefit of the Australian economy as a whole. The ABCC works to achieve this framework by providing assistance, advice and education to the industry; monitoring and promoting compliance with relevant laws; undertaking enforcement activities; using information and analysis to inform decision making.

Investigators are primarily responsible for undertaking assessments, investigations and audits into breaches of the Building and Construction Industry (Improving Productivity) Act 2016 (BCIIP Act), the Fair Work Act 2009 (FW Act), the Building Code 2013, the Building Code 2016 and other laws relating to the building and construction industry.

APS 4 Investigators will have some experience conducting investigations and/or audits, an ability to interpret and apply the law, well-developed communication and interpersonal skills, a capacity to work well individually and as a team member, and be able to deal with conflict in a professional manner.

APS 5 Investigators will have experience in conducting investigations and/or audits, a demonstrated ability to interpret and apply the law, well-developed communication and interpersonal skills, a capacity to work well individually and as a team member, and be able to deal with conflict in a professional manner.

Investigators must be prepared to travel interstate for up to a number of weeks at a time for operational training, or to assist in other ABCC offices. They must also hold a current driver’s licence.

The successful applicant will be appointed as an Inspector under the BCIIP Act.

Duties

APS 4

Under general supervision and guidance, the typical duties of an APS 4 Investigator include, but are not limited to:

  • Conduct compliance activities and investigate breaches of Commonwealth workplace laws and the Building Codes.
  • Conduct site visits and undertake all aspects of code audits and inspections.
  • Participate in education sessions that the ABCC provides to industry participants and undertake liaison with relevant organisations and Government agencies.
  • Prepare reports, correspondence and briefs of evidence.
  • Provide advice and assistance to industry participants via the ABCC 1800 Hotline service.
  • Update the ABCC case management system and use information technology generally to enhance investigation work.

APS 5

Under limited supervision, the typical duties of an APS 5 Investigator include, but are not limited to:

  • Conduct compliance activities and investigate breaches of Commonwealth workplace laws and the Building Code.
  • Conduct site visits and undertake all aspects of code audits and inspections.
  • Participate in education sessions that the ABCC provides to industry participants and undertake liaison with relevant organisations and Government agencies.
  • Prepare audit and inspection reports; correspondence on results of compliance activities; and briefs of evidence to legal officers for the conduct of legal proceedings.
  • Provide advice and assistance to industry participants via the ABCC 1800 Hotline service.
  • Collate statistics and data relating to the building and construction industry.
  • Update the ABCC case management system and use information technology generally to enhance investigation work.

Selection Criteria

APS 4

  1. An ability to plan and conduct investigations and/or audits. Able to acquire knowledge of the relevant laws and identify breaches.
  2. Sound written and oral communication, liaison and representational skills.
  3. Sound conflict resolution and interpersonal skills.
  4. Ability to assess priorities and manage competing deadlines both independently and as a member of a team.
  5. Sound computer skills and ability to use case management systems.

APS 5

  1. Well-developed investigative skills including a demonstrated ability to plan, conduct and lead investigations and/or audits.
  2. Demonstrated ability to interpret and apply legislation and a working knowledge of preparing briefs of evidence.
  3. Well-developed written and oral communication, liaison and representation skills.
  4. Well-developed conflict resolution skills and interpersonal skills.
  5. Ability to assess priorities and manage competing deadlines both independently and as a member of a team, including mentoring of junior staff.
  6. Well-developed computer skills and demonstrated experience using case management systems.

Employment Conditions and Eligibility

Employment Conditions

Your conditions of employment will be those contained in the Australian Building and Construction CommissionEnterprise Agreement 2017-2020.

The Australian Building and ConstructionCommission offers an attractive remuneration package. It comprises base salary and superannuation at 15.4%. Base salary for this position at the APS 4 level is $68,128 and at the APS 5 level is $75,950. The successful applicant will commence at the relevant base salary.
