REPORT OF HEAD OF ENVIRONMENTAL AND CONSUMER PROTECTION SERVICES

ON APPLICATION FOR A CLUB PREMISES CERTIFICATE FOR THE PREMISES KNOWN AS NORTH HAVEN YACHT CLUB, 2B BANKS ROAD, POOLE BH13 7QB, SITUATED WITHIN CANFORD CLIFFS WARD.

Introduction
1.1 / An application has been received from North Haven Yacht Club for the granting of a Club Premises Certificate for the premises known as North Haven Yacht Club. Following receipt of representations this matter is brought before the Licensing Committee for determination.
2.0 / Background
2.1 / The Licensing Act 2003 enables the Licensing Committee to consider the granting of licences where representations are received from responsible authorities or interested parties.
The Licensing Act 2003 gives the Licensing Committee the power to grant the application, refuse the application, or prescribe terms, conditions and restrictions to the premises licence or club premises certificate. These conditions must relate to the four objectives of the Licensing Act 2003;
  1. prevention of crime and disorder
  2. public safety
  3. the prevention of public nuisance; and
  4. the protection of children from harm

2.2 / Following the outcome of the committee hearing, all parties to the application have the right to appeal to the magistrates court within the period of 21 days beginning with the day on which the appellant was notified by the licensing authority of the decision appealed against.

Matter for consideration

3.1 / Committee members are reminded that North Haven Yacht Club is located at 2B Banks Road within Canford Cliffs ward. The premises is surrounded by commercial and residential properties.

3.2 / The proposed application is as follows:
  • The proposed opening times are;
Monday to Sunday 00:00 hours until 23:59 hours
  • To permit films, indoor sporting events, live music, recorded music and anything of a similar description indoors only, at the following times;
Monday to Sunday 00:00 hours until 23:59 hours
  • To provide facilities for dancing and facilities for entertainment of a similar description, indoors only, at the following times;
Monday to Sunday 00:00 hours until 23:59 hours
The applicant has identified a number of steps in order to promote the licensing objectives associated with the representations, namely the prevention of public nuisance, and these are;
All club social events will be run responsibly with due regard to our immediate neighbours with most events finishing around 23:30 hours with the exception of the New Year’s eve social.
A Sentry MKII noise limiter has been installed in the clubhouse to restrict noise nuisance.
All doors and windows shall remain closed, save for access and egress, when regulated entertainment is provided.
No outside music is allowed.
A notice has been placed at the exit to remind members and guests to leave quietly
Car parking is in the adjacent public car park.
Rubbish bins are situated at the rear of the club premises away from public access.
No emptying of bottles, bins and rubbish between 23:00 hours and 07:00 hours

3.3 / Consultation has been carried out in accordance with the Licensing Act 2003. The application has been advertised in the form of a premises notice and a newspaper advertisement and the relevant responsible authorities have been consulted with.
3.4 / 6letters of representation have been received. The representations refer to:

The representations are attached as appendix C.
3.5 / No further representations were received from any of the responsible authorities.
4.0 / Conclusion
4.1 / The Committee members are asked to consider the application, representations and the evidence that is given before them and to make their decision. The Committee members must bear in mind when making their decision the Borough of Poole licensing policy, the guidance as set out by the Secretary of State, and the licensing objectives as set out in the Licensing Act 2003, the most relevant of which here is the prevention of public nuisance.
5.0 / Recommendations
5.1 / The Committee is recommended to have notice of the representations made and determine whether or not the Premises Licence should be refused, granted or granted with prescribed terms or conditions.
