GENERAL BUSINESS TERMS
FOR ISSUING AND USING DEBIT CARDS FOR CONSUMERS

The integral part of this Appendix - General Business Terms for issuing and using debit cards for consumers is also the Tariff for debit cards for consumers and the Time Schedule for the payment transactions of the payment services users.

I GENERAL PROVISIONS

  • These General Business Terms for issuing and using debit cards for consumers (hereinafter: General Terms) determine the rights and obligations of the User in the use of debit cards, rights and obligations of "Credit Agricole Banka Srbija" A.D. Novi Sad (hereinafter: the Bank) in the provision of services related to them.
  • General Business Terms for issuing and using debit cards for consumers along with the following documents: Appendix General Business terms for payment account and performance of payment services for consumers, Agreement on opening and managing payment accounts, Tariff for debit cards for consumers (hereinafter: the Pricelist) and the Time Schedule for the payment transactions of the payment services users are an integral part of the Framework Agreement that the User contracted with the Bank (hereinafter: the Framework Agreement).

II DEFINITIONS

Terms used in these General Business Terms have the following meanings:

Consumer – means a natural person and individual farm who concludes a contract on payment services or a contract related to electronic money for purposes other than his/her intended business or other commercial activity

User means a consumer who has concluded a framework agreement or an agreement for opening and maintaining individual payment account or payment account packages with the Bank and used payment service in the capacity of a payer and/or a payee in accordance with the provisions of the said agreement and the Appendix General Business Terms for payment accounts and performance of payment services for consumers.

Framework Agreement is an agreement on payment services that the Bank concludes with the User and which regulates future execution of payment transactions.

Payment account (hereinafter: account or current account) - means an account that is used for the execution of payment transactions, and which the payment services provider manages for one or more users of payment services

In terms of these General terms for payment accounts, as accounts are considered payment account and special purpose accounts.

General terms for payment accounts – General business terms for payment accounts and performance of payment services for consumers which regulate the conditions in which the Bank opens, manages and closes payment accounts of the consumers, performs payment services for payment accounts of the consumers, calculates fees and interest regarding payment services, as well as the manner and periods for informing the consumer and other rights and obligations of the Bank and the consumer regarding payment services provided by the Bank in accordance with applicable regulations.

Payment transaction is the deposit, transfer or withdrawal of cash, which was initiated by the User as a payer or a payee, and is performed regardless of what are the obligations of the relationship between the payer and the payee.

Payment order is an instruction by the User as a payer or a payee to the Bank, requesting the execution of a payment transaction.

Payment instrument is every personalized means and/or set of procedures agreed between the User and the Bank, used by the User for the initiation of a payment order.

Payer is a natural person who, charging his payment account, issues a payment order or gives consent to execute the payment transaction on the basis of a payment order issued by the payee, and if there in not any payment account - a natural person who issues a payment order;

Payee is a natural or a legal entity for whom the funds that are the subject of a payment transaction are intended.

Business day is a day or part of a day in which the Bank operates and is obligated to enable the execution of payment transactions to their User as a payment services user.

Value date is the reference date, or reference time used by the Bank to calculate interest on posting funds as debit or credit for a payment account.

Reference exchange rate is the exchange rate on the basis of which the calculation is performed when changing currency, which was made available by the Bank or that comes from publicly available source;

Unique identification mark is a combination of letters, numbers and/or symbols determined by the Bank for a User, and which are used in the payment transaction for unambiguous identification of that User and/or his payment account.

Cardholder - a natural person who uses the Card as an instrument of managing the funds from the account and can be a Basic User or Additional User.

Basic User – a natural person, a Client of the Bank, to whom the Bank issued the Card on the basis of the Framework Agreement and whose name is printed on the Card.

Additional User - a natural person for whom the card was issued on the basis of the request of the Basic User and whose name is printed on the Card.

Debit Card is a payment instrument issued by the Bank at the request of User, on the basis of a contract with the credit card organization, which owns the debit card brand as well as the Private Label Card, which is a proprietary card issued in cooperation with a partner contractor.

The Bank issues debit cards for several card systems:

  • MasterCard
  • DinaCard
  • Private Label card

Which enable the User to manage funds from the Account for which it was issued:

  • Cash machines (ATM)
  • POS terminals
  • Internet sales points
  • System on agreed way depending on the type of the card.

The Card is the property of the Bank and is not transferable.

Card number - the number of 16 digits written on the Card, and on the basis of which the transactions originating from the use of the Card are identified.

PIN - personalized security element of the Card (personal identification number) that is delivered along with the Card, known only to the Cardholder and is strictly confidential, and is used for authentication of transactions with the Card which require identification and authorization with the PIN.

Personalized security elements of the card – elements of the card necessary for the realization of payments at points of sale without the physical presence of the card (internet, catalog and telephone sales), and include: full name of the Cardholder, Card number, Card expiration date, three-digit control number printed on the back of the Card (CVV2/CVC2).

Sales point is a sales point of a dealer where it is mandatory to accept debit cards as a means of cashless payment for the sale of goods and provision of services;

Slip is a confirmation of a transaction made with a debit card;

Internet sales point is a place where the exhibition and sale of products and services, as well as all other actions regarding the sales process are conducted over the Internet without physical contact between the dealer and the User.

POS terminal - an electronic device at the sales point or a pay-out place intended for execution of payment transactions (payment of goods and/or services or cash withdrawal), which depending on the type may require a transaction authorization by the User in a manner conditioned by the POS terminal and the card (without identification, identification with a PIN or with signature identification).

Cash machine (ATM) - an electronic device intended for the execution of payment transactions of cash withdrawals, and checking the available balance on the Account associated with the Card, as well as other services by using this device with PIN authentication that the Bank will allow.

Self-service device - an electronic device intended for the execution of payment transactions of paying for goods and/or services where the transaction is carried out in the presence of the card and the identification of user in a way conditioned by the self-service device itself.

Pay-out place is the place where the business entity is authorized to accept debit card for the service of payment of cash at POS device

Daily limit - the maximum number of allowable transactions per day and the maximum amount per transaction type (cash withdrawals, payments at sales points, Internet transactions) per Card.

Monthly limit - the maximum number of allowable transactions per month and the maximum amount per transaction type (cash withdrawals, payments at sales point, Internet transactions) per Card.

Authorization is the process where the approval of transactions on debit cards is done at the request of the Dealer;

National payment transactions - transactions in which the payer’s provider of payment services and the payee’s provider of payment services perform that service on the territory of the Republic of Serbia.

International payment transaction is a payment transaction in which one payment services provider provides this service in the territory of the Republic of Serbia and the other on the territory of a third country, as well as a payment transaction in which the same payment services provider provides this service for one payment services user on the territory of the Republic of Serbia, and for the same or other payment services user on the territory of a third country.

OTP - one time password is a password generated and forwarded to the client in a safe manner, which is used for client authentication during online shopping

III CARD MANAGEMENT

  1. Issuing the card and the PIN

The User and the Bank conclude the Framework Agreement on the respective payment account / account package within which the debit cards of the contracted/requested brand and type are issued.

By signing the Framework Agreement the Basic User states that he is familiar with these general terms and that he agrees with its application and that he accepts all the rights and obligations that derive from them.

The Bank can issue to the Basic User, depending on the submitted request or account package which he chose, issues debit cards from the Bank’s offer, of the following brands: Visa, MasterCard, Dina and Private lebel Card:

Visa Electron/ Gold*

MasterCard Maestro

Dina Electron /Dina co-brand

Private Label Card

The Bank issues the PIN to the User for all, except Privete lable cards whose use is possible in selling objects of partner contractors.

Based on the requirements of the Basic User, the Bank may issue cards to the Additional Users. Additional User can be granted only cards of the same brand and type which the Basic User has.

The Basic User is obliged to inform each Additional User with the contents of all the provisions of the Framework Agreement on the basis of which the Additional User is issued a card.

The Bank has the right to check data and to collect additional data both for the Basic User and for all Additional Users.

The Bank may withhold the issuance and delivery of the card in case of unfulfilled obligations by the User towards the Bank.

*As a part of Privilege account package, Bank issues Visa Gold card to consumer who receives salary on an account opened in the Bank (after two salaries received).

  1. Validity of the card and reissuing of the card

Card validity/due date of the card is printed on the front side of the card.

The Card is valid until the last day of the month indicated on the Card.

The Bank renews the validity of all the cards that are used in accordance with the provisions of the Framework Agreement under which the User regularly pays due obligations, provided that in the last 6 months he had a turnover on the account in which the cards are issued, unless the Basic User at least 60 days before the expiration date on the cards applies for the cancellation of the card.

In case the User refuses to accept reissued card within 60 days of receipt of notice that the card is reissued, the opportunity to use the funds from the account using the card.

The bank shall not automatically reissue the card in case

-If the Framework Agreement on account to which the card is related is canceled/terminated

-If the account has a different status other than active/normal

-If the card is blocked

-If the card is not activated

-If the account does not have any turnover in the last 6 months (with the exception of accrued interest and fee calculation)

  1. Receiving the card and the PIN

The User receives the newly issued and reissued card and PIN at the selected branch office of the Bank, or by any other means if so agreed.

The card and the PIN (personal identification number) can be taken by the User in person. When receiving it, the User is obliged to sign the card, otherwise it is invalid, and possible financial consequences in case of misuse of unsigned card are borne by the User.

The User of the basic card takes his card and PIN.

The User of the basic card can take the card and PIN of the additional user.

The User of the additional card can only take his card and PIN.

The Bank ensures that only and exclusively the user may be in possession of and know the PIN code through the way of its creation.

The user confirms by signing the receipt of the card and the PIN that he had received the card and the PIN, or by any other means if so agreed.

IV USE OF THE CARD AND LIMITATIONS

The card is a payment instrument owned by the Bank and at the request of the Bank it must be returned.

The card whose validity term has expired may not be used.

Visa/Master card cards are cards of international validity and are used:

-to pay for goods and/or services at sales points, including Internet sales points, marked with Visa/Visa Electron or MasterCard/Maestro in the country and abroad

-for cash withdrawals without interest at ATMs and counters of the Bank, as well as for cash withdrawals at ATMs and bank counters in the country and abroad, marked with the label Visa/Visa Electron or MasterCard/Maestro in accordance with the Tariff for fees.

DinaCard cards are cards of national validity and are used:

-to pay for goods and/or services at sales points in the Republic of Serbia, marked with DinaCard

-for cash withdrawals without interest at ATMs and counters of the Bank, as well as for cash withdrawals at ATMs and bank counters in the Republic of Serbia marked with the label DinaCard in accordance with the Tariff for fees.

The Bank, in cooperation with business partners issues a co-brand Dina cards of national validity with all functionalities of the DinaCard card and with concluded additional privilege when purchasing goods/services with a partner contractor (realizing the contracted discounts).

The User can use the card to the amount of available funds in the account for which the card is a payment instrument, within the limits of daily and monthly limits on the type of transaction determined by the Bank and, as defined in the Framework Agreement. The limits are variable and with the consent of the Bank at the request by the Basic User can be changed for the basic card and for all additional cards without drafting the Appendix of the initial Contract.

The Bank may set a maximum number of transactions and the total amount of transactions that are carried out daily through the card for cash withdrawals and purchase of goods and services on which the Bank notifies the Card User on the Bank's website and in the business premises of the Bank in which they conduct business with clients.
The Bank for security reasons determines the limit on the amount of cash and the amount of payment for goods and services that can be used daily through ATMs and EFTPOS terminals.

The amount of funds available for use with a card is determined by the basic Agreement on the account to which it is bound.

The Bank does not bear responsibility if a dealer does not want to accept the card, although they have written VISA/MAESTRO/MASTER CARD/DINA CARD logo or if due to improper use of the terminal, or a technical problem, the transaction cannot be done at the request of the User.
