1.General

TheWillowTreeCottageisaprivatelyownedcottagewhichisfrequently enjoyedby theOwnersandtheirchildren.Guestsareexpectedtotreat thepropertywithasmuch careandconsiderationastheywouldtheirowncottage. We do not participate in the resort rental program but do participate in the mandatory concierge program. You will benefit in the concierge program as the resort will be able to handle your issues directly including any problems at check-in.

2. ReservationDeposit

Forreservationsmade60daysormorepriortoarrival,50%ofthetotal balanceduemustbereceivedwithin7daysofbookingyourreservation. Forreservationsmadelessthan60dayspriortoarrival,thefullamountis dueimmediately.Forreservationsmadelessthan30daysbeforearrival, thefullamountisdueimmediatelyandmustbepaideitherbycertified cheque,bankdraft,moneyorderore-mailmoneytransfer.

3.FinalPayment

Thebalanceisduenolaterthan30dayspriortoyourarrival(or immediatelyifthebookingisreceivedlessthan60dayspriortoarrival). Non-paymentbytheduedatewillbetreatedasacancellationas outlinedinparagraph5.

4. ChangingReservations

5. CancellationPolicy

6.Security/CleaningDeposit

Arefundablesecurity/cleaningdepositof$500shallbepaidwithyourfinal payment.Thesecurity/cleaningdepositwillbehelduntiladeterminationofthe conditionandcontentofthecottagecanbeverified.Amountswillbereleased toyouwithin30daysofyourdepartureshouldnoclaimbemadeagainstit. Thesecuritydepositmaybeusedinpartor infullto payforanydamage causedby negligenceonthepartofthetenantand/ortocoverthecostof cleaningshouldthecottagebeleftinanunacceptablestate.

Guestsareresponsibleforallwillfulornegligentdamagecausedtothe propertyoritscontentsduringtheirstayandacknowledgethattheowners mayseekrestitutionforanysuchdamage.

7.Eligibility

TheWillowTreeCottageisprimarilyfocusedonfamilyvacationrental thereforebookingsmaynotbeacceptedfrom:

8.Subletting

Subleasingisprohibitedandshallimmediatelyvoidtherentalagreement. Youand/oryoursub-letterwillbeaskedtovacatethepremiseswithno refunddue.

Transferofreservationsmaybepermittedandissubjectto atransferfee (seeChangingReservations).Anytransferrequestissubjecttoapproval by,andmaybegrantedatthesolediscretionoftheowners.Wewillnot unreasonablydenytransfers.

9.Occupancy

Occupancy(includingsmallchildren,infantsandvisitors)isnottoexceed6persons.Overcrowdingisaviolationofthesetermsandmayresultinthe Guest(s)beingaskedtovacatethepremiseswithoutrefund.

Pleaselistthenamesandagesofallguests(includingdayvisitors)inthe sectionprovidedonthefirstpageofthisagreement.

10.Cleaning

Guestsareresponsibleforleavingthepropertyinthe samestateof cleanlinessinwhichitwasfoundandingoodorderbeforedeparture. Guestsarerequiredto:

11.Smoking

SmokingisNOTpermittedinsidethecottageorneartheexteriorofthe cottage.

12.Pets

Pets(including,butnotlimitedto,dogsandcats)areNOTallowedatthe WillowTreeCottage.Althoughtheresortisapet-friendlycomplex,the ownersprefertokeeptheircottagepet-freetoensuretheconditionofthe cottageisnotcompromised.It alsoallowsustorenttofamilieswith allergyconcerns.

13.Check-in/Check-out

Check-inisnoearlierthan4:00p.m.onthedateofarrivalandcheck-outis nolaterthan11:00a.m.onthedateofdeparture.Theperiodcannotbe exceededunlessthe Ownersgivewrittenapproval.Guestswillbe liablefor anycostsofwhatsoevernatureincurredbecauseofanunauthorized extension.

Arrival checklist

  1. Ensure the cottage propane tank is open. Located on the back of the cottage there are 3x30lb propane tanks. Both tanks should be in the “open” position, the black lever indicates the direction of flow, and you should see a green rectangle. During your stay if you empty one of the tanks, the rectangle will turn red. Flip the black lever to activate the 2nd tank. Also there are 2x20lb tanks for outdoor bbq and sparesare kept by the BBQ. Please ask the main office to replace empty tanks and charge it to our account.
  2. Ensure water supply into cottage is turned on. The spigot is by the 3x30lb propane tanks indicated in item 1 above. The white and blue water hose feeds into the cottage.
  3. Turn on the hot water heater (switch located beside the kitchen sink window).
  4. If using, turn on furnace switch (located near the front door).
  5. Familiarize yourself with the HVAC. The thermostat is located in the hallway, and can be set to either Heat/Cool/Off. We kindly ask that you close the windows if you run the A/C or heat. Keeping some of the window shades lowered under full sun will also help keep the cottage cool in the summer.
  6. Take a moment to scan the cottage inventory, and please let us know as soon as possible if any items are missing/damaged. Photos would be appreciated.
  7. If you notice any damage to the cottage (interior or exterior), please let us know as soon as possible. In most cases, we will personally be on the premises in between rental periods, but there may be times when this is not the case.

Departure checklist

  1. Return the Sandbanks Provincial Park to the cottage manual binder. Note: replacement charge for lost Sandbanks Provincial Park pass is $125.
  2. Empty the fridge + cupboards of any perishable/personal food items. Remove all personal belongings from closets and drawers.
  3. Clean soiled appliances (interior and exterior).
  4. Empty all garbage receptacles and take trash + recycling to the onsite disposal area (see facility map).
  5. The following cleaning supplies are kept in the master bedroom closet: all-purpose cleaner, windex, microfiber cloth, broom, sponge mop, gloves. Other cleaning supplies are in bathroom and underneath kitchen sink as appropriate. Please wipe down the bathroom fixtures, kitchen sink + counter. Damp-wipe wood furniture with water only as needed. Sweep + dampmop(with water only) the floor. We appreciate your help in keeping our cottage clean.
  6. Return all furnishings to their original location including bringing in outdoor cushions/umbrellas.
  7. Lock all windows and doors.
  8. Close all window blinds but leave about 1 inch gap to avoid condensation buildup.
  9. Set thermostat to the “off” position. Turn off HVAC and hot water heater switch. Turn off all the lights. Turn off all outdoor appliances and their 20lb propane tanks.
  10. Cover all outdoor appliances.
  11. Please report any deficiencies and/or damages to the cottage or it’s contents incurred during your stay. We understand that some degree of normal wear and tear is to be expected, and we appreciate your honesty.

14.PartiesandQuietHours

Thereisastrictno-partypolicyandguestsareaskedtorespectquiettimes between11:00p.m.and9:00a.m.Repeatednoise complaintsmayresultin guestsbeingaskedtovacatethepremiseswithnorefundowed.

15.Keys

You will not need physical keys to gain access to our unit although the front office will have a copy in case. You will be supplied vehicular and entry door access codes upon confirmation of all payments have been cleared.

16.Trash

All trashmustbebagged(separaterecyclingandgarbage)anddepositedat theonsitegarbagefacility.Nofoodorfoodwasteshallbeleftunattended outdoorstoavoidtheproblemsoffeedingthelocalwildlife.

17.ItemsNOTFurnished

Thecottagedoesnotcomeequippedwith bed linens, pillows, towels,soap,paperproducts

(except single plybathroomtissue),personaltoiletries, life jackets, water toys nor firewood. Please bring these items as appropriate.

18.Vehicles

Drive slowly around the resort. One vehicle is allowed per site and additional overflow parking is available for a fee (2017: $15/day +HST). These fees are payable to the resort directly upon check-in if requested. Roadside parking is not allowed in order to provide emergency access. ATVs and dirt bikes are not permitted on the Resort grounds.

19.Boats, Water Toys, Trailers and Docks

We do not have a dock slip thus boats, water toys and trailers must be parked in the designated area for an additional fee (2013: $15/day) when not in use. Any boats/water toys/trailers parked on site, will be asked to be removed. There is also a launch fee (2013: $12/launch). Inquire at front office if required.

20.Campers,MotorhomesandTents

Campers,motorhomesandtentsarenotpermittedtoparkontheproperty. However, these may be parked at the designated parking lot (at entrance) for a fee (2013: up to $15/day). These fees payable to resort directly upon check-in.

21.Campfires

Campfires are permitted only in the provided fire-pit.

Fires must be supervised and kept to a manageable size.

Fires must be extinguished with water prior to leaving the firepit area.

Fires will not be allowed during local fire bans.

Any fines/damages resulting from a campfire are the responsibility of the

Guest(s).

22.MechanicalApplianceFailure

Wewilluseourbesteffortsto havemechanical(water,septic,electrical andplumbing)andappliancefailurescorrectedassoonaspossiblebut cannotcontroltheschedulingofoutsidecontractors.Norefundsorrebates willbemadeforapplianceorotherequipmentnormechanicalfailuresor breakdowns.TheOwnersshallhavetherighttoarrange,inspectandmake repairsduringtherentalperiod.Guest(s)willbechargedforunnecessary maintenanceandservicecallsorrepairscausedbyabusebeyondnormal wear-and-tear.

23.Repairs

Guestsshouldnotattemptrepairsandshouldcontacttheresortassoon aspossibletomakeemergencyrepairs. Alternatively, the owner may be contacted directly.

24.UnforeseenCircumstances

Ifforanyreasonbeyondthe Owners'controlthepropertyisnotavailable onthedatebooked,orthepropertyisunsuitableforholidayletting,all rentandchargespaidin advanceby theGuest(s)willberefundedinfull. TheGuest(s)shallhavenofurther claimagainsttheOwners.

25.Damages

Youassumeresponsibilityforanywillfulornegligentdamagestothecottage anditspremisesbyyouoryourguests.Itisstronglyrecommendedthatyou havehomeownersortenantsinsuranceandmakesurethatthecoverage includesliabilityinsurance.

26.Liability

Ownersassumenoresponsibilityforinjurytoanycottageguestnortheloss ofordamagetotheGuest(s)’spossessionsontheOwners’property. Guest(s)herebyagree(s)tomakerestitutionforandholdandsaveharmless Ownersandtheiragentsfromloss,damages,claim,demand,suits, judgments,liabilitiesoranycausewhatsoever,whichtheOwnerswouldbe otherwiseheldresponsibleforarisingfromanyinjuryordeathto personsor property,oranyclaimonaccountthereofresultingfromGuest(s)useofthe premisesorGuest(s)failureto complywiththisagreement,eitherinorabout theoccupiedpropertyorelsewhere.

27.GuestsResponsibility

Guest(s)is responsibleforalltermsandconditionssetforthinthisdocument forthem,theirguestsorotherstheymayhaveonthepropertyduringtheir termofoccupancy.

28.Validity

IfanytermorprovisioninthisRentalAgreementshallinwholeorinpartbe heldtoanyextenttobeillegalorunenforceableunderanyenactmentor ruleoflawthattermorprovisionorpartshalltothatextentbedeemed

nottoformpartofthisagreementandtheenforceabilityoftheremainder ofthisagreementshallnotbeaffected.

29.Resort Rental Agreement

As we have signed up for the concierge program, you may be required to sign the resort rental agreement – see annex A for 2017 version but later years should be similar. Annex A is primarily for the resort rentals which we are not participating in order to provide much lowered costs to you. Annex A will need to be done in person at the front office. I wish to point out that Annex A is to be superseded by my agreement:

  1. Cancellations – see section 5.
  2. Checkin/Out – see section 13.
  3. Accomodations/Amenities – see section 17.
  4. Resort Fee – we will pay these. If requested by resort for you to pay, please inform them to charge to my account as per my concierge agreement. Additionally propane should be charged directly to my account.
  5. Security Deposit – see section 6.
  6. Permitted Occupants – see section 7,8 and 9.
  7. Pets – we do not allow pets, see section 12.
  8. Smoking – see section 11.
  9. Parking –see section 18.
  10. Housekeeping – also see section 10.
  11. All others in Annex A apply but are already stated in this agreement.

Bed Configurations

Our cottage has a total of 3 bedrooms:

  • Bedroom 1: Queen-size bed
  • Bedroom 2: Single over Double bunk bed
  • Bedroom 3: Single over Single bunk bed
  • Pull-out double sofabed in living area

The cottage has a 3-piece bathroom featuring a full-size bathtub with shower. Please bring appropriate linens, pillows, blankets, sheets, etc as necessary.

Tap water

We ask that you supply your own drinking water: we suggest to either bring from home, or to purchase from one of the local grocery stores. According to the resort management, the water goes through a treatment facility where it is treated with a UV filtration system. The water is tested and safe for consumption, however they do not recommend drinking the water as it has added chlorine which might not agree with your stomach. It’s absolutely safe for general purpose use (brushing your teeth, washing dishes, food prep) but we recommend you bring water for drinking.

Gas stove

The cottage has a gas stove; here are some general instructions for those who may be unfamiliar with operating a gas stove. To light a burner, push the dial in and slowly turn to the left.You’ll hear a “clickclickclick” ing noise, and a slight hiss. The hiss is the propane, and the click is the ignitor. Once the flame has caught, continue to turn the dial left to the desired heat setting.If the flame doesn’t catch within a few seconds, turn the dial back to the right to the “off” position.Give the propane a moment to dissipate in the air, and then try again. NEVER LEAVE THE DIALIN THE “ON” POSITION WITHOUT A FLAME as this means propane is leaking out into the air, always return the dial to the “OFF” position after use.

If the stove won’t ignite and you don’t hear a hiss or smell propane when you try to light the burner, this may be an indication that the propane tank is empty. Go around to the back of the trailer, turn the primary tank to the “OFF” position and turn the second tank to the “ON” position.

SEPTIC

Asweareonaprivatesepticsystem,thefollowingguidelinesaretobe followed:1plytoilet tissueisonlytobeused.Personalhygieneproducts,diapersandpapertowelswillcausedamagetothesepticsystem.Anybabywipes,diapersorhygieneproductsmustbedisposedofvia ourwastedisposal areasonthe resort.Donotdisposeofgrease,oilorotherproductsinthesinksortoiletsontheResort.Yourawarenessandassistancewillensureaproperlyoperatingsepticsystemandwillreduceanysepticodoursaroundtheresort.
