ORDINANCE NO. 2016-05
AN ORDINANCE OF THE CITY OF CANISTOTA, SOUTH DAKOTA, AMENDING THE REVISED MUNICIPAL ORDINANCES OF THE CITY BY DELETING AND REPLACING ORDINANCE 8.0104, CONSUMER’S BILLS, FOR UTILITIES SERVICES PROVIDED BY THE CITY.
WHEREAS, the City of Canistota, South Dakota, (the “City”) adopted those Revised Municipal Ordinances of Canistota, SD and Ordinance 8.0104 thereof provides that any payments for utility bills mailed to the City must be received by the City on the day after the due date but payments for utility bills hand-delivered to the City are due on the due date; and
WHEREAS, the City Council desires to amend Ordinance 8.0104 to provide among other things that payments for utility bills to the City regardless of method of delivery are due on or before the due date;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canistota, South Dakota, that the Revised Municipal Ordinances of Canistota, SD, are hereby amended by deleting and replacing Section 8.0104 to read as follows:
8.0104 Consumer’s Bills. All utility bills rendered are net, due and payable on receipt and delinquent if payment in full is not received by the fifteenth day of the month, the due date. Any bill not paid in full by close of business on the due date will be considered delinquent and a fifteen dollar ($15.00) additional charge shall be assessed. Provided, however, when a due date falls on a weekend or holiday, bills will not be delinquent until the close of business the next following work day.
This Ordinance, assigned Ordinance No. 2016-05, shall take effect as soon as it shall be published or posted as required by law.
