AN ORDINANCE AMENDING THE CODE OF THE CITY OF FORT WORTH, TEXAS, (1986), AS AMENDED, BY REPEALING DIVISION 6, "DEPARTMENT OF HOUSING AND ECONOMIC DEVELOPMENT", ARTICLE IV, "DEPARTMENTS" OF CHAPTER 2, "ADMINISTRATION AND RESTATING IT AS DIVISION 6, "DEPARTMENT OF ECONOMIC DEVELOPMENT;” PROVIDING FOR THE ESTABLISHMENT AND SUPERVISION OF THE ECONOMIC DEVELOPMENT DEPARTMENT; PROVIDING FOR THE APPOINTMENT OF EMPLOYEES OF THE ECONOMIC DEVELOPMENT DEPARTMENT; PROVIDING FOR THE DUTIES OF THE ECONOMIC DEVELOPMENT DEPARTMENT; AMENDING SECTION 2.5-5, "ADMINISTRATION", OF DIVISION 1, "GENERAL PROVISIONS", OF ARTICLE I, "EMPLOYEES RETIREMENT FUND", OF CHAPTER 2.5, "RETIREMENT" OF THE CITY CODE; AMENDING SECTIONS 20-370(A)(6), "PROGRAM ENHANCEMENTS", AND 20-373, "LICENSES AND MISCELLANEOUS BUSINESS REGULATIONS", OF ARTICLE X, "MINORITY AND WOMEN BUSINESS ENTERPRISES," OF CHAPTER 20 OF THE CITY CODE TO REFERENCE THE ECONOMIC DEVELOPMENT DEPARTMENT; AMENDING SECTION 30-173(D)(3), "COLLECTION OF IMPACT FEES ", OF DIVISION 2, "ASSESSMENT AND COLLECTION OF IMPACT FEES", OF ARTICLE VIII, "TRANSPORTATION IMPACT FEES", OF CHAPTER 30, "STREETS AND SIDEWALKS" OF THE CITY CODE TO REFERENCE THE ECONOMIC DEVELOPMENT DEPARTMENT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVEOF ALL PRIOR ORDINANCES AND REPEALING CONFLICTING ORDINANCES; PROVIDING FOR A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, Chapter VIII, Section 1 of the City Charter authorizes the City Council to establish by ordinance such departments, divisions, and offices as it deems necessary for the operation for the City's business (in addition to those departments required by the City Charter); and

WHEREAS, Chapter VIII, Section 1 of the City Charter authorizes the City Council to discontinue any department or office established by ordinance and to prescribe, combine, consolidate, distribute, or abolish the functions and duties of departments, divisions, or offices; and

WHEREAS, the Department of Housing and Economic Development was created in Ordinance No. 18320-09-2008, adopted by City Council on September 30, 2008, as codified in Section 2-166(b) of theCode of the City of Fort Worth, Texas (1986), as amended ("City Code");

WHEREAS, the City Manager has recommended, and the City Council desires,that the Department of Housing and Economic Development be divided into two departments, the Department of Neighborhood Services, and the Department of Economic Development, and this Ordinance hereby creates the Department of Economic Development.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:

SECTION 1.

Division 6, "Department of Housing and Economic Development", Article IV, "Departments" ofChapter 2, "Administration" of the City Code, is hereby repealed in its entirety and replaced with the following:

DIVISION 6 – DEPARTMENT OF ECONOMIC DEVELOPMENT

Sec. 2-164. - Establishment and supervision of department.

Pursuant to Chapter VIII, Section 1 of the Charter of the City of Fort Worth, the Economic Development Department ("Department") is hereby established. The Department shall be supervised by a Director ("Director"), who will be subject to appointment and removal by the City Manager. The Director's salary shall be set by the City Manager in accordance with the City's compensation plan.

The Director shall have the authority to appoint, employ and remove assistants, employees and other personnel as the Director deems necessary for the efficient administration of the Department's affairs and the execution of the Department's duties and obligations. The Director shall prescribe the duties of and compensation to such assistants, employees and other personnel in accordance with the City's compensation plan.

(a)The Department shall oversee projects designed to increase investment in all areas of the City of Fort Worthin order to expand the city's economy and tax base and to increase local employment.

(b)The Department shall endeavor to provide a positive business environment in which local businesses can grow, flourish and create high-paying jobs with benefits for citizens of the City of Fort Worth.

(c)The Department shall use incentives as allowed by law to encourage new investment and business expansion in the City of Fort Worth as designated from time to time by the city council.

(d)The Department shall provide skills development, technical advice, and financial assistance to small and medium-sized businesses and entrepreneurs in the City of Fort Worth.

(e)The Department shall promote international trade from and to the City of Fort Worth and employ various initiatives to increase local awareness of global economic issues and opportunities.

(f)The Department shall conduct and participate in activities that promote job opportunities for citizens of the City of Fort Worth.

(g)The Department shall encourage close cooperation with other local jurisdictions, chambers of commerce, and organizations interested in promoting the economic well-being of areas within the City of Fort Worth.

SECTION 2.

Section 2.5-5, "Administration", of Division 1, "General Provisions", of Article I, "Employees Retirement Fund", of Chapter 2.5, "Retirement" of the City Code is hereby amended to replace the reference to the "Housing and Economic Development Department" to the "Economic Development Department".

SECTION 3.

Section 20-370(a)(6), "Program Enhancements", of Article X, "Minority and Women Business Enterprises," of Chapter 20, "Licenses and Miscellaneous Business Regulations" of the City Code is hereby amended to delete the reference to "Housing and Economic Development Department's".

SECTION 4.

Section 20-373, "Contract Monitoring and Reporting", of Article X, "Minority and Women Business Enterprises," of Chapter 20, "Licenses and Miscellaneous Business Regulations" of the City Code is hereby amended to delete the reference to "(i.e., Housing and Economic Development Department)".

SECTION 5.

Section 30-173(d)(3), "Collection of Impact Fees", of Division 2, "Assessment and Collection of Impact Fees", of Article VIII, "Transportation Impact Fees", of Chapter 30, "Streets and Sidewalks" of the City Code is hereby amended to replace the reference to the "Housing and Economic Development Department" with "Economic Development Department".

SECTION 6.

This ordinance shall be cumulative of all provisions of ordinances of the City Code except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such City Code, in which event conflicting provisions of such ordinances and such City Code are hereby repealed.

SECTION 7.

It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 8.

All other provisions of the CityCode shall remain in full force and effect, save and except as amended by this ordinance.

SECTION 9.

This ordinance shall take effect upon adoption, and it is so ordained.
