Pre-qualification

Project Description – Bid Packages

The following bid packages are currently being pre-qualified:

PROJECT SCHEDULE

The deadline for submission of pre-qualification documents is March 3, 2006.

The anticipated bid period for the MASONRY and METALS Bid Packages isMarch 15, 2006through April 12, 2006 and the anticipated bid period for the REMAINING BID PACKAGES isApril 3, 2006 through May 3, 2006.

Construction is scheduled to begin in Mayof 2006 and scheduled for completion in July of 2007.

PROJECT CONSTRUCTION BUDGET

The construction budget for the project is approximately $4,000,000 million dollars.

PRE-QUALIFICATION PROCEDURES

Beginning February 9, 2006, pre-qualification documents for each trade will be available to all intending bidders by mail/express, e-mail or in person at:

Any questions or requests for clarification to the Pre-qualification Documents must be submitted in writing to Anthony D’Amante at Lathrop Construction Associates by fax 707/746-8080, by mail (address noted above) or by e-mail (e-mail noted above) by February 21, 2006. Questions received after the above-noted deadline may be answered at the discretion of Lathrop Construction on behalf of the District. If required an Addenda to the pre-qualification documents will be faxed to prospective bidders during the business day of February 27, 2006 to all who are known by Lathrop Construction to have received a complete set of Pre-qualification Documents and who have provided a FAX number or e-mail address for receipt of Addenda.

Prospective bidders shall submit one (1) set of the completed Pre-qualification Documents and any required attachments in a sealed envelope identified with the Project name, Contractor’s name and address to Barbara Tittle, Brentwood Union School District 255 Guthrie Lane, Brentwood, CA 94513 before 2:00 PM on March 3, 2006.

No prequalification questionnaire will be accepted after March 3, 2006, however, Brentwood Union School District reserve at their sole discretion the right to request, to receive, and to evaluate supplemental information after the above time and date.

Bidders will be notified by letter by March 15, 2006 whether or not they are Pre-qualified.

The exact dates, times and location for bidding will be confirmed in an “Announcement to Pre-qualified Bidders” distributed by the District / Lathrop, as well as by a published Advertisement for the Bid to Pre-qualified Bidders.

When the Bidding Package(s) on the above sub-trade work for the subcontractor becomes available, lump sum bids are to be submitted directly to the BrentwoodUnionSchool District and the District will receive bids ONLY from pre-qualified subcontractors. Should Lathrop Construction Associates Inc. elect to furnish a bid on one or more of the bid packages, the bids for that work will be received and opened by the District.

The District reserves the right to reject any or all applicants to thispre-qualification process and any or all bids and to waive non-material irregularities in pre-qualification documents or bids received. If the District deems there is aninsufficient pool of subcontractors for competitive bidding, they reserve the right to withdraw or modify the pre-qualification requirements or modify the pre-qualification process.

After submission of subcontractors bids to the BrentwoodUnionSchool District, the District will award the subcontract to the pre-qualified subcontractor submitting the lowest responsive bid for the portion of work.

All insurance policies required to be obtained by subcontractor shall be subject to approval by the District for form and substance. All such policies shall be issued by a company rated by Best as A- or better and a financial classification of VIII or better, or have equivalent ratings by Standard and Poor’s or Moody’s.

The following insurance coverages will be required for work performed at the project site: Workers’ Compensation, Employers Liability, Commercial General and Excess Liability and Automobile Liability.

Pre-qualified bidders will be required to furnish Bid Security in the amount of 10% of the lump sum base bid, including alternates, accompanying each bid. Surety companies used by bidder shall be an admitted surety.

Prospective bidders desiring to be pre-qualified are informed that they may be subject to and must fully comply with all of the bid conditions including the ability to provide 100% performance and payment bonds.

All information submitted for prequalification evaluation will be considered official information acquired in confidence, and the District will maintain its confidentiality to the extent permitted by law.

The Pre-qualified successful Bidders and its Subcontractorsshall pay all workers in all Work performed pursuant to this Contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as determined by the Director of the Department of Industrial Relations, State of California, for the type of work performed and the locality in which the work is to be performed within the boundaries of the District, pursuant to sections 1770 et seq. of the California Labor Code. Prevailing wage rates are available for review on the Internet at: The Brentwood Union School and the American Avenue Middle School project is funded in whole or in part with bond funds and, therefore, the District and/or its designee, Davillier-Sloan, Inc. operate a labor compliance program pursuant to Labor Code section 1771.7. Bidders specifically acknowledge and understand that if awarded the Contract, all Work in performance of this project and other District projects shall comply with all applicable provisions of the District’s labor compliance program.

Lathrop Construction Associates, Inc. has contracted with the BrentwoodUnionSchool Districtfor management of the project as the Construction Manager at Risk. This “Determination of Bidders Responsibility” process is a part of Lathrop’s scope of work. The Public Contract code required that each public agency award to the lowest responsible bidder. The California Supreme Court has determined that “responsible” refers to the “quality, fitness and capacity of the bidder to satisfactorily perform the proposed work”. It is the intent of this pre-qualification to determine responsibility prior to or after the bid, and to aid the District in selecting the lowest responsible bidder.
