ALIEN WITH EXTRAORDINARY ABILITY

I. QUALIFICATION FOR EXTRAORDINARY ABILITY

EB1(a) is set aside for aliens with extraordinary ability in the sciences, arts, education, business, or athletics. To qualify for this category, you must establish that your level of expertise has made you "one of that small percentage who has risen to the very top of the field". You must show that you have sustained national or international acclaim and that your achievements have been recognized within the field. A specific job offer is not required as long as you are entering the United States to continue work in the field in which you has extraordinary ability. Therefore, you may file your own petition with the INS for classification in this preference, rather than having the petition filed by an employer.

In order to demonstrate your eligibility for such classification, we must provide evidence of :

  • Receipt of a major, internationally-recognized award, such as the Nobel Prize, or
  • At least three of the following forms of documentation:
  • Receipt of nationally or internationally recognized prizes or awards for excellence in the field of endeavor.
  • Membership in association in the field which require outstanding achievements of their members (as judged by recognized national or international experts in the discipline or fields)
  • There is published material about you in professional or major trade publications or other major media relating to the your work
  • Participation on a panel, or individually, as a judge of the work of others in the field.
  • Evidence of your original scientific or scholarly contributions of major significance in your field.
  • Evidence of your authorship of scholarly articles in the field in professional journals or other major media.
  • Evidence of your employment in a critical or essential capacity for organizations and establishments that have a distinguished reputation.
  • Evidence that you have commanded a high salary or other significantly high remuneration.
  • Evidence of the display of your work in the field at artistic exhibitions or showcases in more than one country
  • Evidence of commercial success in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales.

II. DOCUMENT LISTS TO ESTABLISH THE ABOVEQUALIFICATIONS:

Copies of your published articles; if possible, collect evidence to prove the ranking of the journals your articles are published on. (Journal Citation Report may have such information)

Copies of documentation regarding any patents which you may hold.

 Copies of letters you may have received inviting you to participate in conferences, submit papers or to review the work of other scientists.

Information regarding any awards that you may have received for your work within your discipline.

Letters of reference letters from experts in your field detailing your outstanding contributions.

Provide an updated curriculum vitae and publications list.

Provide evidence of citations of your articles.

Information on your membership in any professional/scientific societies. Specifically, what are the requirements of membership, i.e., is nomination required? is a certain degree level required? etc. Also, any evidence of membership (certificates, membership cards, etc.).

Statement from you outlining your outstanding achievements in your field. This statement may be in the following format:

In addition to the documentation requested regarding your qualifications for being classified as an outstanding researcher/professor,please provide the following additional documents:

Copies of all degrees (if not already provided to our office).

Copy of forms I-94 for you, your spouse and children (if applicable);

Copies of all passports.

V. APPLICATION PROCEDURES

Once you have provided all of the information to me, I will file the visa petition with the Immigration and Naturalization Service (INS). The processing time is varied for each INS service center. Please check my website on most recent processing time for this type of case (I-140). Once the INS approves the petition, we will then commence processing the application for permanent residency/immigrant visa through an INS office in the United States or a U.S. Consulate/Embassy abroad. The processing of this application is also dependent on whether your priority date is current for the visa bulletin. At this time, the Category 1 for Employment Based Visas is current for all countries.

VI. DOCUMENTS REQUIRED FOR THE FINAL STAGE (I-485 ADJUSTMENT OR CONSULATE PROCESSING)

You must obtain birth certificates for all family members who will be immigrating with you. If they are not in English, please translate into English. We will also need a copy of your marriage certificate and divorce decrees, if you or your spouse were previously married.
