Aircraft Hold Harmless and Release Agreement

PARTICIPANT: (print name)(hereinafter referred to as “you”, “your”, “I”, “me” or “my” as the context may require).

Read and initial each of these provisions before deciding whether to act as pilot in command, second in command, student pilot, instructor pilot and/or passenger (hereinafter referred to collectively as “Aircraft Operations”) in the airplane, Serial No. , N Number N (hereinafter referred to as the “Aircraft”). Signing this document results in your giving up your valuable rights to sue the owner of the Aircraft, ______(hereinafter referred to as the “Owner”), and ______[anybody else you want to name], any pilot, co-pilot, student pilot and/or instructor pilot of the Aircraft, and each of them, and each of their respective former, present and future joint ventures, partnerships, parent and subsidiary and affiliate corporations, partners, co-venturers, co-owners, principals, agents, independent contractors, attorneys, employees, stockholders, directors, officers, predecessors, successors, assigns, heirs, trustees, executors, administrators, representatives, contractors, suppliers, instructors, distributors, or any other person or organization (hereinafter collectively referred to as the “Released Parties”) for any loss, injury or death you may suffer as a result of the Aircraft Operations, even if it is the result of negligence. You agree to be solely responsible for any injury or damage you may cause to others or the property of others as a result of your participation, to whatever degree, in the Aircraft Operations and hold harmless the Released Parties. WARNING: PARTICIPATING IN AIRCRAFT OPERATIONS IS DANGEROUS AND THERE IS A HIGH RISK OF SERIOUS INJURY OR DEATH.

In consideration of the Released Parties allowing you to participate in Aircraft Operations, it is agreed that:

1.ASSUMPTION OF RISK: I am fully aware that Aircraft Operations and all associated activities are calculated, high risk activities that contain inherent risks and dangers (including serious injury or death) that no amount of care, caution, instruction or expertise can eliminate. I voluntarily and freely choose to incur any and all such risks and dangers. By signing this document, I acknowledge that I understand the scope, nature and extent of the risks involved in the activities contemplated by this agreement. Initial: ______.

2.EXEMPTION FROM LIABILITY: I hereby fully and forever discharge the Released Parties from any and all liability, claims, actions and causes of action, whatsoever, arising out of any damage, loss or injury to me or my property while upon the premises or in or around Aircraft or other vehicle, whether stopped or in motion, while participating in Aircraft Operations or any other activity directly, or indirectly, contemplated by this agreement, whether such loss, damage or injury results from the negligence, either active or passive, of the Released Parties, or from any other cause or causes. 3.FREE WILL: I acknowledge that I am involved in the Aircraft Operations, to whatever degree, of my own free will. It is of my own personal time and no employer, company or person is hereby responsible for my participation in the Aircraft Operations. Initial: ______.

4.COVENANT NOT TO SUE: I agree never to institute any suit or action at law or otherwise and hereby instruct my heirs, executors and administrators never to institute any suit or action at law or otherwise against any of the Released Parties, nor to assist nor initiate the prosecution of any claim for damages or cause of action which I, my heirs, executors or administrators may have by reason of damage, injury or death to my person or property arising from the Aircraft Operations contemplated by this agreement. 5.INDEMNITY AGAINST THIRD PARTY CLAIMS: I agree to indemnify, save and hold harmless the Released Parties from any and all losses, claims, actions or proceedings of every kind and character related to the Aircraft Operations. This includes REIMBURSEMENT OF ALL LEGAL COSTS AND REASONABLE COUNSEL FEES incurred by the Released Parties, for the defense of any actions that may arise directly, or indirectly, by any persons or organizations which arise from the Aircraft Operations contemplated by this agreement. 6.CONTINUATION OF OBLIGATIONS: I agree and acknowledge that the terms and conditions of the foregoing EXEMPTION FROM LIABILITY, COVENANT NOT TO SUE and INDEMNITY AGAINST THIRD PARTY CLAIMS shall continue in full force and effect now and in the future, and at all times during my participation, either directly or indirectly, in the Aircraft Operations of the Released Parties, and shall be binding upon my heirs, executors and administrators of my estate. 7.INSURANCE: I understand that if I require or want insurance, I must provide my own. Further, I understand that none of the Released Parties provides insurance of any type, including without limitation, no life, liability or medical insurance. Initial: ______.

8.SUMMARY: I hereby recognize that this agreement is a CONTRACT pursuant to which I have released any and all Released Parties from liability for any loss either to my person or property, or the person or property of others, EVEN IF SUCH LOSS RESULTS FROM NEGLIGENCE OF ANY Released Parties, either singularly or collectively. Further, I understand that if I institute any suit or action at law against any of the Released Parties for any loss, no matter how minor or severe, to my person or property, this document will be used in court. I UNDERSTAND THAT AGREEMENTS OF THIS TYPE HAVE BEEN UPHELD IN COURTS IN SIMILAR CIRCUMSTANCES. Initial: ______.
