This Cold Room is only available for use by residents and short-term occupants of the building.

This Cold Room is not to be used for any commercial purpose whatsoever unless permission is granted by the Body Corporate.

Terms and Conditions:

The Body Corporate requires this form to be completed and signed when residents and short-term occupants of the building request to use the Cold Room.

A Resident is a person who is an owner of a Lot in The Aurora Tower or a person(s) who have a residential lease of a Lot in the AuroraTower with a term of 6 months or more.

A Short-term occupant is a person who occupies a Lot under a lease, fee or other arrangement with a term of less than 6 months.

Guests to the building are not allowed to use the Cold Room without the written permission of the Body Corporate.

TheCold Room is not to be used for any commercial purpose whatsoever unless written permission is granted by the Body Corporate.

Smoking is not permitted inside or near the Cold Room.

The Cold Room is under constant CCTV surveillance.

Costs:

There is no fee payable for the use of the Cold Room.

There is no charge for electricity.

A minimum cleaning fee of $200.00 will apply if the User has not properly cleaned the area including removal of all stains, marks and smells, to be determined by the Building Manager or their representative or the Body Corporate at their sole discretion.

Any damage to the Cold Room will be charged to the User. Such charges will be calculated by the Building Manager or their representative, and the Body Corporate at their sole discretion but having regard to reasonable market rates.

All costs for any damage, loss or liability incurred by the Body Corporate which is directly attributable to the use of the Cold Room by the User or persons for whom they are responsible, will be passed on to the User.

Release and Indemnity:

The User unconditionally and irrevocably releases and forever discharges and holds harmless the Building Management and the Body Corporate, their respective agents, officers, servants, related companies, contractors and assigns from all claims, actions, demands, damage, loss, liabilities, cost, charge, expense, outgoing or payment which the User has or may have but for this document, against any one or more of them, whether now or in the future arising out of, or in relation to or in any way connected with the use of the Cold Room by the User, and any costs which the Building Management and/or Body Corporate incurs as a result of the use of the Cold Room by the User.

The User agrees to indemnify and keep indemnified the Building Management and the Body Corporate, their respective agents, officers, servants, related companies, contractors and assigns in respect of any or all loss arising with respect to or in any way connected with the use of the Cold Room by the User or arising as a result of any and all claims, suits, actions and demands, liabilities or proceedings of whatsoever nature which the User has or may have or might have but for this document, against any one or more of them.

Cleaning:

The User is responsible for cleaning the Cold Room.

All rubbish is to be disposed of in the rubbish and/or recycling bins on Level 1.

Emergency Procedures:

The Cold Room has internal lights and a bell on the Cold Room door to attract attention. The door to the Cold Room and the internal door to the Freezer section can be opened from the inside.

If someone is locked in the Cold Room, the person should operate the bell to attract attention. If no help is forthcoming, the person should undo the wing-nut on the inside wall adjacent to the Cold Room door to release the lock. The door can then be pushed open. The person should immediately report the incident to the Building Manager or their representative.

The User will be briefed on Fire and Emergency Evacuation Procedures by the Building Manager or their representative at the time of signing this agreement. Should the User waive this emergency procedure introduction, the User will not hold the Building Management, Body Corporate or its representatives responsible or liable for any loss or damage which may be sustained in the event of an emergency.

Persons accompanying the User are to be advised by the User of the emergency procedures for the building and given instructions on location of fire exits.

Acknowledgement of Agreement:

The User acknowledges an understanding of the Fire and Emergency Evacuation Procedures and that the location of fire exits and fire equipment have been explained by the Building Manager or their representative.

The User agrees to the Terms and Conditions for the use of the Cold Room outlined in this document.
