Agree Terms for Care Provision

1.0  Introduction:

Having submitted a proposal it may be that the prospective customer wishes to enter agreement with Briarcare ltd as to the content, terms and conditions of any contract.

2.0 Objective:

To ensure that the Service User or customer and the Company are in agreement and understand all terms and conditions of the care provision in order to provide satisfaction thereafter.

3.0  Procedure:

Private individuals who are self funding:

q  Prior to commencement or within 2 days of commencement of the provision of care the Company shall ensure that the Service User has an individual Service Contract or equivalent Letter containing the key terms and conditions.

q  The Service user and/or their relatives or representative shall have a copy of the Service Contract or equivalent Letter.

q  The Service User or their named representative shall sign the Service Contract or equivalent Letter

q  An authorised officer of the Company shall sign the Service Contract or Letter.

q  The Company shall ensure that:

Ο  All the Company’s procedures have been complied with.

Ο  The terms of the Service User’s Guide meet the requirements

Ο  The Service User’s Care Plan F/103 is correct

Ο  The Care Plan is accurate

Ο  All parties are able to meet their obligations under the agreement

Ο  The Service User is willing and able to meet their obligations under the agreement

Ο  All statutory and legal requirements have been met.

Ο  The agreement is legal and binding

Ο  Every party to the agreement has a copy

q  The Company shall retain a copy of the agreement, for record purposes.

Public Sector:

q  The key terms and conditions of the service contract agree with the submitted proposal:

q  An authorised officer of the Company shall sign the service contract.

q  An authorised officer of the Customer shall sign the service contract.

q  The Company shall ensure that:

Ο  All the Company’s procedures have been complied with.

Ο  The terms of the Service User’s Guide meet the requirements

Ο  The Service User’s Care Plan F/103 is correct

Ο  The Care Plan is accurate

Ο  All parties are able to meet their obligations under the agreement

Ο  The Service User is willing and able to meet their obligations under the agreement

Ο  All statutory and legal requirements have been met.

Ο  The agreement is legal and binding

Ο  Every party to the agreement has a copy

q  The Company shall retain a copy of the agreement, for record purposes.

4.0 Persons Responsible:

Group Director

Company Secretary

Directors

Branch Managers

q  The Group Director is responsible for authorising this procedure

q  The Group Director is responsible for ensuring that all legal requirements regarding the Service Contract or equivalent Letter are complied with.

q  The Company Secretary is responsible for ensuring that all legal and statutory requirements have been taken into account
