DECISION:
  1. The Deputy Chief Executive is authorised to carry out the necessary legal and administrative procedures required to process a Temporary One-Way Traffic and Prohibition of Driving Traffic Regulation Order, pursuant to Section 14 of the Road Traffic Regulation Act 1984, to enable essential carriageway widening works to be undertaken. Thesection of roadidentified below and shown in drawing numbered PT/TM/5222shall be closed to all vehicular traffic (except emergency services), including pedal cycles. It is also proposed to introduce a one-way traffic order along a section of the said road, from Monday 9th June to Sunday 6th July 2014to such extent as may from time to time be indicated by the appropriate traffic signs:-
1.1Perimeter Road, Kirkby (northeast bound carriageway) – fromits junction with the circulatory carriageway of the South Boundary Road roundabout, in an easterly direction for a distance of approximately 10 metres.
1.2Perimeter Road, Kirkby – no person shall cause or permit any vehicle to proceed in any direction other than south westerly, between its junctions with Spinney Road and Molly’s Lane.
  1. Exemptions will be provided in the Temporary Prohibition of Driving Traffic Regulation Order described in decision item 1 to permit reasonable access to any vehicle being used in connection with police, fire or ambulance purposes and anything done with the permission or at the direction of a police constable in uniform.

PURPOSE OF THE REPORT/REASONS FOR DECISION:
To seek authorisation for the Deputy Chief Executive to carry out the necessary legal and administrative procedures required to introduce Temporary Traffic Regulation Ordersrelating to a section of Perimeter Road, Kirkby.
ANY ALTERNATIVE OPTIONS CONSIDERED AND REJECTED:
Consideration was given to the introduction of temporary traffic signals however; given the proximity of the works to the South Boundary Road roundabout junction, it was felt that the generated traffic queue lengths could not be accommodated without having an extremely detrimental affect on traffic flows in the immediate vicinity.
Alternative traffic management techniques were considered however given the statutory requirements of Chapter 8 of the Traffic Signs Manual 2009 (for traffic safety measures at road works and other temporary situations) and in the interests of highway safety, it will be necessary to conduct the works under temporaryroad closure and one-way traffic conditions.

REPORT OF THE DIRECTOR OF REGENERATION AND HOUSING

PROPOSED TEMPORARY PROHIBITION OF DRIVING (EXCEPT FOR ACCESS) AND ONE-WAY TRAFFIC REGULATION ORDER – PERIMETER ROAD , KIRKBY

1.PURPOSE OF THE REPORT

1.1To seek authorisation for the Deputy Chief Executive to carry out the necessary legal and administrative procedures required to introduce a Temporary Prohibition of Driving (Except for Access) and One-Way Traffic Regulation Orderrelating toPerimeter Road, Kirkby.

2.RECOMMENDATIONS

It is recommended that:-

2.1The Deputy Chief Executive be authorised to carry out the necessary legal and administrative procedures required to process a Temporary Prohibition of Driving (Except for Access) Traffic Regulation Order, pursuant to Section 14 of the Road Traffic Regulation Act 1984, to enable essential carriageway widening works to be undertaken. The section of road identified below and shown in drawing numbered PT/TM/5222 shall be closed to all vehicular traffic (except emergency services), including pedal cycles.It is also proposed to introduce a one-way traffic order along a section of the said road, from Monday 9th June to Sunday 6th July 2014to such extent as may from time to time be indicated by the appropriate traffic signs:-

3.BACKGROUND

3.1As part of the Section 278 highway works to accommodate the new Matalan distribution centre, essential carriageway widening works are to be carried out by Dowhigh Ltd on Perimeter Road, Kirkby,from Monday 9thJuneto Sunday 6th July 2014. As part of these works, it is necessary to close a section of Perimeter Road and restrict the direction of traffic flow temporarily, in order that thecarriageway wideningworks may be carried out safely.

3.2Given the statutory requirements of Chapter 8 of the Traffic Signs Manual 2009 (for traffic safety measures at road works and other temporary situations) and in the interests of highway safety, it will be necessary to introduce a Temporary Prohibition of Driving (Except for Access) and One-WayTraffic Regulation Orderrelating toPerimeter Road,Kirkby.

3.3Themain strategic diversion route for vehicular traffic affected by thetemporary road closurewill be viaSouth Boundary Road, Lees Road, Ashcroft Road, Acornfield Road and Moss End Way as shown on the drawing numbered PT/TM/5222.

3.4No frontages are directly affected by the closure or the proposed one-way traffic order.

3.5The Emergency Services will be formally notified of the proposed Order through the circulation of the Networks Bulletin, and will also be informed of the proposals by the Deputy Chief Executive as part of the statutory consultation procedure. Every effort will be made to ensure that the Emergency Services have continuous access throughout the duration of the temporary road closure however; there may be short periods when they will have to travel along the diversion routes described in paragraph 3.3 of this report. These periods will be kept to an absolute minimum.

3.6Perimeter Road is not a bus route,therefore Merseytravel have notbeen consulted directly on the proposals in order that alternative access and routing arrangements may be made.

3.7The pedestrian footway adjacent to the site will remain open throughout the duration of the works.

3.8The contractor, Dowhigh Ltdwillconsult occupiers of anyaffected properties via a letter drop, which will take place two weeks prior to the road closure. In addition, the proposed prohibitionwill be advertised through the local media and advance signs will be installed to advise motorists.

3.9In proposing to exercise these powers, regard has been made by Knowsley Council, as the Highway Authority to its duty under Section 122 of the Road Traffic Regulation Act 1984. When determining the proposals made in this report regard has been given to; the desirability of securing and maintaining reasonable access to premises, the affect on the amenities in the locality, the importance of regulating and restricting the use of roads by heavy commercial vehicles so as to preserve or improve the amenities of the areas through which the roads run, the Council’s strategy produced under S80 Environmental Protection Act 1990 (the national air quality strategy), the importance of facilitating the passage of public service vehicles, to securing the safety and convenience of persons using or desiring to use public service vehicles and any other matters appearing to the local authority to be relevant. The Council is satisfied that the Order will not result in a detrimental effect on highway users, due to the short term nature of the road closure and the availability of alternative access arrangements to properties that are affected.

4.RESOURCE IMPLICATIONS

4.1Financial

The cost of administering and advertising the Temporary Traffic Regulation Order is approximately £1,500 and will be met by Dowhigh Ltd.

4.2 Human

There are no specific human resource implications for the Council associated with this proposal, other than staff time to process the order.

4.3Information Technology

There are no information technology implications for the Council associated with this proposal.

4.4Physical Assets

The proposed temporary Order will allowessential carriageway wideningworks to be undertaken, which will improvehighway assets in the area to the benefit of the local community.

  1. PERFORMANCE AND RISKS

5.1The Temporary Traffic Regulation Order described within this report is required to allow essential carriageway widening works to be undertaken in accordance with the statutory requirements of Chapter 8 of the Traffic Signs Manual 2009.

5.2Failure to approve the Temporary Traffic Order would prevent the essential works from being completed in a statutory, safe and legal manner and would constitute a risk to road users and works operatives whilst the works were being carried out.

5.3Unfortunately it is inevitable that works of this nature will cause some disruption to the local community, however the proposed communication strategy outlined in paragraph 3.8should assist matters.

6.EQUALITY AND ENVIRONMENTAL ASSESSMENT

6.1Equality and Diversity

In formulating these proposals regard has been given to the duties imposed by the Equality Act 2010, particularly the need to provide equality of opportunity between disabled persons and others and to take account of disability issues in developing schemes. It is considered that there are no direct equality implications arising out of this proposal.

6.2Environmental Policy

Given the nature of the prohibition and its temporary, short term duration then the impact of the proposed recommendation would not be of significance having regard to the Council's environmental policy.

7.COMMUNICATIONS ISSUES

7.1The Emergency Services will be formally informed of the proposed Order through the circulation of the Networks Bulletin, and will also be informed of the proposals by the Deputy Chief Executive as part of the statutory consultation procedure.

7.2Local Councillors have been consulted, and no adverse comments have been received at the time of writing this report.

7.3Dowhigh Ltd will ensure that an appropriate Communications Strategy is developed and implemented prior to the proposed road closure, as set out in paragraph 3.8 of this document.

7.4Perimeter Road is not a bus route, therefore Merseytravel have notbeen directly consulted on the proposed road closure in order that alternative access and routing arrangements may be made.

8.CONCLUSION

8.1The Temporary Traffic Regulation Orderas described within this report, will allow essential carriageway wideningworks to be undertakenin accordance with the statutory safety requirements, whilst protecting highway safety and movement.
