A. Reading Of The Reconciliation Statement And Prayer

Fabienne Thewlis, Manager Governance & Corporate Support, read the following reconciliation statement:

We acknowledge that we are meeting on the traditional land of the Boonwurrung and Wurundjeri people and offer our respects to the elders past and present. We recognise and respect the cultural heritage of this land.

The meeting began with a prayer at 7.00pm.

The Mayor (Cr Sehr) introduced Councillors and the CEO, Warren Roberts, to the meeting. The CEO introduced Council Officers.

C. Adoption And Confirmation Of Minutes Of Previous Meeting(S) In Accordance With Section 63 Of The Act And Clause 423 Of General Local Law 2008 (No 1)

Motion: Moved Cr Koce Seconded Cr Chandler
That the Council confirms the Minutes of the Council Meeting of the Stonnington City Council held on 18 May 2015, subject to the following:
Cr Koce asked that the following correction be made to the Minutes:
·  on page 9, LED Street Lighting: a report was given noting that United Energy has approved installation of LED lights to replace the current T5 lights. The new LEDs use half the energy of a T5 which was the most efficient lighting option available to councils prior to 30 January. So far Council has only replaced 17% of the old mercury vapour 80 watt globes with T5 globe.

D. Disclosure by Councillors of any conflicts of interest in accordance with Section 79 of the Act

Cr Davie declared an Indirect Conflict of Interest in Item 18 - Malvern Valley Primary School Out of Cycle Community Grant 2014-2015, as she has a child attending Malvern Valley Primary School.

Cr Ullin declared a Direct Conflict of Interest in relation to Item 10 - Special Rates and Special Charges for Promotional Purposes - Declaration - High Street Armadale Shopping Precinct, as he operates a business in High Street.

E. Questions to Council from Members of the Public

The Mayor Cr Sehr, read the following statement:

During Council’s previous Ordinary Meeting no set of questions to Council was received from members of the public.

For tonight’s Ordinary Meeting of Council no set of Questions to Council has been received for response.

F. Correspondence – (only if related to council business)

Cr Chandler tabled the following correspondence:

·  An email (26.5.15) on behalf of the Chapel Precinct Committee thanking Councillors for a meeting and saying he is looking forward to Council confirmation of: the waiving of City of Stonnington permit fees associated with the restoration of shop tops; Council’s agreement that it will take over maintenance of VicRoads Signal Boxes; and a decision about whether the City of Stonnington has the capacity to undertake the management of the restoration of the Prahran Arcade in a way similar to that used by the City of Bayside when restoring the ‘Munro Building’, Church Street, Brighton. Cr Chandler formally asked for a report on these matters.

Cr McMorrow tabled the following correspondence:

·  An email (27.5.15) from a resident of Malvern Road, Glen Iris, objecting to Planning Application 1168/14 – 1789-1793 Malvern Road, Glen Iris, on the grounds of: excessive high density; serious neighbourhood character and amenity issues; road safety concerns; and exacerbation of existing traffic and parking congestion.

·  An email (30.5.15) from residents of Wilton Vale Crescent giving details of their rates for the past five years, expressing the opinion that the size and rate of increases over those years are unreasonable, and asking their Ward Councillors to justify these rate rises.

·  An email (22.5.15) asking that Council establish: a bike path along the rail line at the back of Allenby Avenue to connect Gardiners Creek to Hedgeley Dene and beyond; and a grade connection at the pedestrian crossing at Kardella Street / Burke Road opposite Central Park.

·  An email (21.5.15) making negative comments about a VicRoads flyer in relation to works in Tooronga Road and listing things that the flyer did not explain. The email also details the extreme congestion on Tooronga Road at certain times of the day.

·  Correspondence in relation to Council street sweeping and falling leaves:

Ø  An email (26.5.15) expressing thanks for a response from Council Officers in relation to street sweeping and suggesting that sweeping of residential streets not commence before 8am on Saturdays or public holidays.

Ø  An email (29.5.15) from a resident of Beech Street, Malvern East, in relation to street sweeping and collection of leaves in that street.

Ø  An email (19.5.15) from a resident of Beech Street, Malvern East, complaining about street sweeping of leaves in that street in contrast to street sweeping taking place in the Gascoigne Estate and Toorak.

Cr Stubbs tabled the following correspondence:

·  An email (1.6.15) from a trader in Commercial Road, Prahran, making comments about the Special Rate for the Chapel Street Precinct Association, including: a request for fair and reasonable representation; complaints about the website; slow response time to phone calls; and lack of acknowledgement of the diversity of the association’s constituent businesses.

·  An email (23.5.15) from a resident of Yarradale Road, Toorak, on behalf of the Bicycle Network, asking Council to invest in bicycle infrastructure to alleviate the problems of traffic congestion and inactivity.

·  An email already tabled commenting on Council rates over the past five years.

·  An email already tabled in relation to Planning Application 1168/14 – 1789-1793 Malvern Road, Glen Iris.

·  An email (28.5.15) from Planning & Property Partners Pty Ltd on behalf of the applicants in relation to 1-3 Olive Street, Malvern, with an attached request to amend the planning permit.

·  Two identical emails (21.5.15) objecting to a planning application for 15/38 Macfarlan Street, South Yarra, on the grounds of: exacerbation of existing problems including antisocial behaviour, excessive noise, traffic and parking issues, and waste management.

·  A copy of the Interim Management letter 2014/15 from the Victorian Auditor General’s Office advising of only some minor questions following the preliminary their interim audit.

·  A series of emails between Council Officers and Cr McMorrow (21.5, 29.5 &1.6.15) in relation to Cr McMorrow’s request for an independent traffic survey in Burke Road where three contiguous developments are proposed. Council Officers advise that it is unlikely that any new study will provide anything of assistance and predict that it would simply endorse what is already proposed.

·  An email already tabled in relation to road works in Tooronga Road.

·  An email (1.6.15) from a resident of Waverley Road, Malvern East, asking for assistance in relation to unanswered communications with Council about damaged guttering and a parking fine.

·  Correspondence in relation to street sweeping:

Ø  Two emails already tabled in relation to this issue:

Ø  An email (22.5.15) from a resident of Langville Court, Malvern East, asking Ward Councillors to drive down the court to see the current state of the street and the lack of Council street sweeping to remove fallen leaves.

Cr Koce tabled the following correspondence:

·  An email (8.5.15) from a resident of Hawthorn Kooyong (corrected with adoption of minutes at meeting of 22 June 2015) containing notes from a meeting about Righetti and Ferrie Oval, giving information including: use of these ovals; the proposed scoreboard; payment for use; dog walkers; security lighting; and other matters.

Cr Ullin tabled the following correspondence:

·  An email (19.5.15) from a resident of Raleigh Street, Windsor, who has an incapacitated child in relation to access issues caused by the M39 South Yarra to St Kilda Water Main Project. After a phone call to the Project hotline, amicable arrangements have been made.

·  An email (26.5.15) from a resident of Kooyong Road, Armadale, noting the difficulty and danger experienced by residents attempting to exit their properties onto Kooyong Road due to reduced visibility caused by parked cars, especially between High Street and Wattletree Road. The email makes suggestions for dealing with these issues. Cr Ullin noted that the matter had been responded to.

·  An email (1.6.15) asking that parking restrictions be put in place in Debigh Road to prevent commuter parking, especially near King David School.

·  An email already tabled in relation to a planning application for 15/38 Macfarlan Street, South Yarra.

·  Emails (19 & 20.5.15) from a resident of Chilcote Avenue objecting to a proposed development at 6 Chilcote Avenue on the grounds of massive overdevelopment; and noting that they have mailed an objection to Council.

·  Two emails (20.5.15) from a resident of Green Street objecting to a proposed redevelopment at 10 Green Street, Windsor, on the grounds of: worsening of existing parking problems; waste management issues; heritage and streetscape issues; and excessive height.

·  An email (20.5.15) from a resident of Sutherland Road asking Council to clear fallen leaves that are causing flooding of Sutherland Road and blockage of stormwater drains. This is a safety issue for elderly residents.

Cr Sehr tabled the following correspondence:

·  A letter (25.5.15) on behalf of the Fundraising Committee, South Yarra Primary School, asking if Council could donate the use of Functions on Chapel as a venue for the school’s fundraising night in October. Cr Sehr noted that, although this school is not located in the City of Stonnington ,being just across Punt Road, it is attended by many Stonnington children.

G. Questions to Council Officers from Councillors

A / Safety of pedestrians in Yarra Street in the evening
Cr John Chandler tabled an email (28.5.15) from a resident expressing concern about the safety of pedestrians in Yarra Street in the evening. Foot traffic is forced to walk on the road because construction gear is obstructing the footpath. There are no lights and the ground is uneven. Cr Chandler asked Council Officers to ensure that Council permit requirements are being complied with and to check if more lighting is needed.
The CEO, Warren Roberts, took the question on notice.
