INTEGRITY AND USES OF THE PROPERTY
Describe the physical integrity of the features associated with the applicable battle(s) or site(s). Consider what battlefield landscape features and/or historic buildings remain intact on the property.
Describe previous and current uses of the property. Identify uses such as agricultural crop production, animal husbandry, equestrian uses, timber harvesting/replanting, residential, historic site interpretation, museum/visitor use, vacant land, etc.
Describe plans for future uses of the property. Note any anticipated alterations to existing buildings, structures and/or landscape features, demolition and/or removal of existing structures, and any anticipated new construction, whether residential, agricultural, or interpretative in nature.
Describe plans for stewardship, treatment, and/or interpretation of historic resources present on the property.

LEGAL AND TAX MATTERS
For Easement Acquisition Projects:
Will this be a partial-sale, partial-gift transaction (e.g. will there be a combination of grant funding and federal or state tax incentives to purchase an easement on the property, or will a portion of the transaction include a bargain sale)? If yes, please describe.
Is the property to be placed under easement held in trust? If yes, please submit a copy of the trust agreement or other document(s) that created the trust.
Will there be a mortgage, home equity loan, or other lien on the property at the time the easement is recorded? If yes, provide a copy of the recorded deed of trust or other agreement. Indicate whether you have contacted the lender(s) regarding their willingness to subordinate the lien to the easement and/or submit written documentation from lender(s) indicating such.
For ALL Projects:
Is there a Title Insurance Report or Title Commitment for the property? If yes, please provide copy of the report with all supporting documentation.
Are there any other encumbrances on the property (e.g. oil or gas lease, electric easement, right-of-way easement)? If yes, list below and provide copies of these documents.
Has the property been previously platted for subdivision? If yes, provide a copy of the recorded plat of subdivision and identify what site work and/or improvements were initiated in preparation for construction.
Are there any deed restrictions, covenants, or homeowners association agreements that impact the property? If yes, describe below and provide a copy of any related documents.
What is/are the current zoning designation(s) for the property?
Is perpetual conservation of the property consistent with the current comprehensive plan in effect for the locality? Cite or attach copies of applicable pages/sections of the comprehensive plan.
Identify the future land use designation for the property as indicated in the current comprehensive plan. Identify the designation for all parcels and provide a copy of the associated future land use map with the location of the property marked. Note: This application now requires that you contact the Planning Department for the locality and request documentation in writing that perpetual conservation of the property is consistent with the current comprehensive plan. If there are conflicts with the local comprehensive plan, official documentation from the appropriate authority within that locality authorizing the proposed conservation/preservation use must be provided. This documentation must be submitted with your application.
Are there any projects listed on the VDOT Six-Year Improvement Program plan that impact the property? If yes, please identify the project.
Identify how the project supports the Virginia Outdoors Plan (2013), as amended. Cite or attach copies of applicable pages/sections of the plan.
Are there any residential, agricultural, commercial, or other leases currently in effect on the property? If yes, please provide a copy of the lease or rental agreement.
Will there be any residential, agricultural, commercial, or other lease agreements in effect at the time of easement recordation? If yes, please provide a letter signed by the landowner or beneficiary of these reserved rights indicating their consent to subordinate their rights as a tenant/lessee to the easement. This includes any life estates.
Has the property been surveyed within the last ten years? If yes, please submit a copy of the property survey or an older property survey if available. DHR reserves the right to require a property survey.
Please identify any other information about the property or its condition not included above, such as boundary line disputes, significant trash dump(s), outstanding life estates, third party access easements through the property, matters involving public infrastructure projects or pending takings by the Commonwealth or any public utility, etc.

APPLICANT MANAGEMENT AND ORGANIZATIONAL CAPACITY
Describe the financial and administrative capacity of the applicant to complete the project. For all fee simple acquisitions, provide documentation confirming the applicant’s financial and administrative ability to maintain and manage the property consistent with the public investment and public interests.
The applicant is required to read and review DHR’s standard easement template. Please outline the proposed terms and conditions of the perpetual conservation easement and indicate any proposed reserved rights in the easement (e.g. new dwellings, divisions/subdivisions, new agricultural buildings, etc.)
Multiple Applications: For any applicant submitting multiple applications, please specify the priority that this particular project has among your organization’s other grant applications and why.
First Time Applicants: Describe the financial and administrative capacity of applicant to manage the land following acquisition in fee simple.

THE FOLLOWING DOCUMENTS MUST BE SUBMITTED WITH YOUR APPLICATION IN ACCORDANCE WITH THE 2017 VIRGINIA BATTLEFIELD PRESERVATION FUND GRANTS MANUAL AND THIS APPLICATION

A.  Confirmation of Match: Statement or certification form demonstrating appropriate match. Such statement and/or certification should specify the source of the funds to ensure that no state funds are used as part of the match.

B.  Contract of Sale: A contract of sale, contingent contract of sale, or letter from the property owner indicating willingness to sell the land or perpetual conservation easement to the applicant; or verification of the date on which the applicant closed on the sale of the property.

C.  Perpetual Easement: Written statement from the applicant or landowner (i) affirming his/her commitment to place the property under a perpetual easement to be held by the Commonwealth of Virginia, Board of Historic Resources; and (ii) confirming that he/she has reviewed the Department of Historic Resources’ draft battlefield easement and agrees to negotiate and execute such a deed.
