VACANT BUILDING AND PROPERTY ORDINANCE #2011-25

On November 17, 2011 the Village of River Grove Board of Trustees adopted a Vacant Building

Registration Ordinance.

Village officials believe this will allow owners and the Village the ability to work together and take greater collective action in the prevention of problematic vacant properties. This action became a necessity with the downturn in the economy and the increasing number of foreclosed, vacant properties that have begun impacting the quality of life in the community.

The goal is that this new ordinance will facilitate an empowered relationship between property owners and the Village of River Grove to take the necessary measures in addressing problematic vacant properties that may come about from time to time.

DUTY TO REGISTER VACANT BUILDING: The owner of a building who knows, or from all the facts and circumstances should know, that his or her building is or has become a "vacant building" within the meaning of this Chapter after the effective date of this Chapter or the owner of a building. Which the building commissioner determines at anytime to be a 'vacant building", or the owner of a building whose appeal from the building commissioner's determination has been denied by the village board shall take the actions provided for in this section within fifteen (15) days after either the date of the building commissioner's notice of determination or occurrence of the facts which would cause a reasonable person to believe that the building was a "vacant building", or denial of the appeal, whichever is applicable.

ANNUAL INSPECTION AND ANNUAL REGISTRATION RENEWAL: Renew the vacant building

registration each year on the anniversary date of the first filing so long as the building remains vacant and pay the required two hundred dollars($200.00) annual registration fee; and in addition to the annual registration fee, the owner shall schedule and allow for a code compliance inspection of the interior of the vacant building on or before the anniversary date of the vacant registration and pay a two hundred dollar ($200.00) inspection fee. Such inspection will determine the extent of compliance with village property, building, health, fire, water and sewer codes. The village shall send the inspection report to the owner within thirty (30) days of the inspection. Any annual fees not paid in a timely manner shall increase to double the amount provided for above.

VACANT BUILDING PLAN: At the time a building is registered as required herein, the owner shall submit a vacant building plan. If the owner fails to submit the plan as provided for by this Chapter the building commissioner may determine the plan. The plan shall contain the following as a minimum see (ord. 2011-25 section 6e)

Section IV - Insurance

In ordinance 2011-25 section 6D: Requires that owner must obtain liability insurance and maintain such insurance for as long as the building is vacant, and file evidence of such with the Building Commissioner, as follows:

1. Five Hundred Thousand dollars ($500,000.00) for a vacant residential building of one to three units;

2. Seven Hundred Thousand dollars ($700,000.00) for a vacant residential building of four to eleven units;

3. One Million dollars ($1,000,000.00) for a vacant residential building of twelve to forty eight units;

4. Two Million dollars ($2,000,000.00) for a vacant residential building of more than forty eight units;

5. Two Million dollars ($2,000,000.00) for a vacant manufacturing, industrial, storage, or nonresidential commercial building.

TERMS OF VILLAGE SERVICES

I/We hereby request that the Village of River Grove commence water and sewer service and/or refuse services at the above-identified property on or after. ______

I/We understand that the water used at the premises shall be registered and measured by meter. If a meter fails to register the quantity of water that passes through it at any time, then the quantity shall be determined and charged based upon the average quantity registered during such preceding period of time prior to the date of failure. No deductions shall be made from bills on the account of leakage. I/We also understand that sewer services provided by the Village shall be charged based upon the metered water usage, and further that if applicable refuse services provided through the Village shall be provided on a weekly basis. I/We understand that I/we must comply with all ordinances regarding sewer and refuse services, and that I/we shall pay the standard monthly service fees to the Village.

I/We hereby acknowledge that all persons signing this application shall be jointly and severally responsible for the payment of any water, sewer and/or refuse services supplied by the Village of River Grove or its agents as a result of this application until written notice is given to the Village at least ten (10) days in advance of the date that such services be terminated by the Village of River Grove.

By making this application and signing below, I/We hereby authorize the Village to shut off and terminate all water services and/or refuse services without notice if any bill for such services is not paid within sixty (60) days of its due date. I/We understand that partial payment of any amount due and owing the Village of River Grove shall not toll the sixty (60) day period without an express written agreement signed by a duly authorized officer of the Village of River Grove. I/We also understand and agree that the supply of water and water services may be stopped until all arrearages and the sum of Fifty Dollars ($50.00) for shutting off and turning on water are paid in full to the Village of River Grove.

In the event that the Village of River Grove is required to commence a civil action to recover money due for water, sewer and/or refuse services rendered, I/We agree that the Village of River Grove shall be entitled to recover the judgment amount, plus costs and expenses, including reasonable attorney's fees, incurred in collecting said money from any or all persons signing this application.

By my/our signature(s) below, I/we hereby represent that the information provided in this application is true and correct to the best of my/our belief; that I/we understand that this property is located within the zoning district indicated above, and that any conversion or use of this property in violation of the zoning code of the village shall subject me/us to corrective action by the village. This is includes without limitation the conversion of a single family dwelling unit into a multi-family dwelling unit in violation of the village code, that would require the removal of any unlawful dwelling units upon complaint to or inspection by the village. In the event the village is required to commence legal action to ensure my/our compliance with the zoning code of the village and the court determines that a violation exists, I/we understand that I/we shall be responsible for the cost of all corrective actions, plus the court costs, including reasonable attorney fees, the village incurs in taking such action.
