REGULAR MEETING

The Fairbank City Council met in regular session on Monday, June 10, 2013. Mayor Welsh called the meeting to order at 6:00 P.M. with the Pledge of Allegiance. Members present: Sullivan, Vorwald, Woods Mangrich and Erickson. Also present: Dave Ryan, Public Works Director; Heather Prendergast, City Attorney and Marlene Strempke, City Clerk.

Motion by Sullivan, second by Woods to amend the agenda to include City Website and Board of Adjustment Decision. Roll call vote—Ayes: Sullivan, Woods, Vorwald, Mangrich and Erickson. Nays: None.

Motion by Erickson, second by Mangrich to approve the agenda as amended. Roll call vote—Ayes: Erickson, Mangrich, Sullivan, Vorwald and Woods. Nays: None.

Motion by Mangrich, second by Vorwald to approve the Minutes of the May 28th regular meeting. Roll call vote—Ayes: Mangrich, Vorwald, Woods, Erickson and Sullivan. Nays: None.

Motion by Vorwald, second by Erickson to approve the Treasurer’s Report. Receipts for the month of May were: General, $28,439.69; Special Revenue, $15,274.41; TIF, $8,677.83; Capital Projects, $32.55; Permanent Funds; $16.00 and Proprietary, $134,643.35. Disbursements were: General, $41,482.81; Special Revenue, $942.72; TIF, $94,629.15; Capital Projects, $30,000.00 and Proprietary, $110,136.20. Balance on hand at close of business May 31, 2013 was $2,393,931.64. Roll call vote—Ayes: Vorwald, Erickson, Mangrich, Sullivan and Woods. Nays: None.

Motion by Woods, second by Erickson to open the public hearing on agreements with Christian Trail property owners on city tax rebates. Roll call vote—Ayes: Woods, Erickson, Mangrich, Sullivan and Vorwald. Nays: None. No comments written or oral were received.

Motion by Mangrich, second by Sullivan to close the public hearing. Roll call vote—Ayes: Mangrich, Sullivan, Vorwald, Woods and Erickson. Nays: None.

Motion by Vorwald, second by Erickson to approve RESOLUTION 2013-10 – RESOLUTION APPROVING AGREEMENTS WITH CHRISTIAN TRAIL PROPERTY OWNERS AND AUTHORIZING PROPERTY TAX REBATE PAYMENTS. Roll call vote—Ayes: Vorwald, Erickson, Mangrich and Sullivan. Nays: None. Abstain: Woods.

Motion by Vorwald, second by Sullivan to approve RESOLUTION 2013-11 – RESOLUTION APPOINTING COLTON GAEDE AS POLICE CHIEF. Roll call vote—Ayes: Vorwald, Sullivan, Mangrich, Erickson and Woods. Nays: None.

Motion by Sullivan, second by Mangrich to approve Cigarette/Tobacco Permit Applications from Casey’s General Store, Fairbank Food Center and Pronto Market. Roll call vote—Ayes: Sullivan, Mangrich, Erickson, Woods and Vorwald. Nays: None.

Motion by Mangrich, second by Sullivan to approve the Supplemental Agreement with the Iowa Department of Transportation for snow removal for the next year. Roll call vote—Ayes: Mangrich, Sullivan, Vorwald, Woods and Erickson. Nays: None.

Motion by Mangrich, second by Erickson to approve the Application for Fireworks Permit from Fairbank Development Corporation for Fairbank Days. Roll call vote—Ayes: Mangrich, Erickson, Woods, Vorwald and Sullivan. Nays: None.

Jason Kayser was present on behalf of the Fire Department requesting that the council amend the FY2014 budget to allow them to replace a piece of emergency equipment for the ambulance which has quit working. It will be paid from ambulance savings – two thirds from Capital Expenditure Trust and one third from Operations Trust. Motion by Mangrich, second by Sullivan to approve the request. Roll call vote—Ayes: Mangrich, Sullivan, Vorwald, Woods and Erickson. Nays: None.

Non-paid help at the pool failed for a lack of a motion.

Motion by Woods, second by Vorwald to address the possibility of purchasing gas at Casey’s General Store again if and when they would allow purchases on an open account not requiring credit cards. Roll call vote—Ayes: Woods, Vorwald, Sullivan, Mangrich and Erickson. Nays: None.

Recycling at 709 Kristi Lane failed for lack of a motion.

The forms for the low-to-moderate income survey to be done to attempt to obtain a grant for sewer upgrades which are mandated have been received and the council and mayor will be doing the survey in coming weeks.

East Knoll Ridge Fourth Addition will be on the next agenda for acceptance of the Preliminary Plat.

Motion by Woods, second by Mangrich to approve Change Order One with Blazek Corporation in the amount of $1,381.30. Roll call vote—Ayes: Woods, Mangrich, Sullivan, Vorwald and Erickson. Nays: None.

Motion by Mangrich, second by Sullivan to approve Pay Request for Blazek Corporation in the amount of $34,204.70. Roll call vote—Ayes: Mangrich, Sullivan, Vorwald, Woods and Erickson. Nays: None.

Discussion was held on the preliminary design of the web site and they felt that the company should be given the creative okay to continue.

The decision made by the Board of Adjustment on a variance was discussed. A resident was present to ask what recourse they had to appeal the decision and was informed by the city attorney that they would need to take legal action to attempt to overturn the decision.
