PURCHASE and SALES AGREEMENT and

HEALTH GUARANTEE

The following agreement is between Judith and Bill Peabody of MorningShine Meadows at Hampshire Hill, Worcester, Vermont, hereafter referred to as “Seller” and _____________ of ____________, hereafter referred to as “Buyer”.

In consideration for the purchase price of _______, the Seller transfers to the Buyer as of the date specified below, all title, rights, privileges, and responsibilities associated with the ownership of ___________, male/female dog of the ___________ breed born on______.

Buyer shall indemnify and hold Seller harmless from injury to anyone or damage to any property which may be caused directly or indirectly by the dog.

GENETIC HEALTH GUARANTEE:

The dog is guaranteed to be transferred n good health and sound temperament at the time of purchase. It is recommended that the Buyer have the dog examined by a licensed veterinarian within 72 hours of the time of purchase or receipt. If the veterinarian finds the dog to be unhealthy, it is to be returned to the Seller for a full refund.

The dog will have been spayed or neutered at the time of purchase or a very specific alternative agreement will have been made between the Seller and the Buyer and documented as addendum to this Agreement.

Serious effort has been made to produce dogs in good health and temperament. In addition to screening for hip and eye health our dogs are checked for elbows, patella, thyroid, heart and vonWillenbrands disease. The Seller guarantees the dog to the age of 24 months against the disabling effects of the following genetic defects:

Hip dysplasia that significantly compromises the dog’s life as a companion dog. If concern regarding hip dysplasia arises the Buyer must provide the Seller with proof of hip dysplasia in the form of documentation from OFA or PennHip testing on or before 24 months of age.

Congenital defect of the eye causing blindness in both eyes and/or requiring surgery or ongoing medication, as diagnosed by a Veterinary Opthalmologist on or before 24 months of age.

Debilitating congenital heart disease, unrelated to parasitic heart damage, as documented by a licensed veterinarian with training specific to canine heart disease or a Veterinary Cardiologist.

While the Seller has made every effort to prevent these diseases from developing in the dog, no one can guarantee that they won’t occur. In the unfortunate event that the dog develops any of the aforementioned defects, and upon written proof of diagnosis by a licensed veterinarian, the Buyer shall be entitled to a refund of the purchase price of the dog, less the $400 deposit, shipping and/or other related costs OR a replacement puppy from another litter. If the buyer chooses a replacement pup the original pup must be returned to the Seller for care or placement in another informed home. The following conditions apply:

The Seller reserves the right to have the dog examined by a veterinarian of the Seller’s choice, to confirm the diagnosis, at the Seller’s expense.

The hip dysplasia guarantee shall be null and void if the dog is determined to have suffered serious injury or neglect; has been 20% or more overweight; or exposed to intense exercise (e.g. jogging, agility training, etc) before the age of 18 months.

The Health Guarantee is granted to the original Buyer only and is not transferable to anyone else.

All testing and examinations are the responsibility of the Buyer.

In any case, the Seller’s liability will never exceed the purchase price of the dog.

BUYER’S AGREEMENT:

Buyer agrees to maintain this dog in good health; provide routine preventive health care including, but not limited to, inoculation, internal and external parasite elimination and prevention medication; provide obedience training; provide a safe living environment and healthy diet; provide exercise for fitness, not to exceed the developmental ability of the young dog. Veterinary records must be provided to Seller if requesting refund or replacement. If any of the above preventive care has not been provided this Health Guarantee will become void.

The Buyer agrees not to resell or otherwise dispose of the dog without the Seller’s agreement. The Seller agrees to assist the Buyer in finding an appropriate home for the dog if this becomes necessary. If the dog is returned to the Seller, proceeds of the subsequent sale, if any, will be forwarded to the Buyer after veterinary, advertising, and other costs related to the sale are deducted. Seller will use best efforts to obtain a reasonable price for the dog, but Seller does not guarantee obtaining the same original price paid by the Buyer.

FULL and FINAL AGREEMENT:

The Buyer and Seller agree that this contract represents the entire agreement between them and that no other representations have been made regarding the dog described above.

That said, the Seller wishes the Buyer and this wonderful puppy many happy years together of snuggling, sloppy kisses, romping, and great laughter!
