APPLICATION FOR THE REGISTRATION OF A FOOD BUSINESS ESTABLISHMENT
(Regulation (EC) No. 852/2004 on the hygiene of foodstuffs, Article 6(2))

This form should be completed by food business operators in respect of new food business establishments and received by the relevant Food Authority 28 days before commencing food operations. On the basis of the activities carried out, certain food business establishments are required to be approved rather than registered. If you are unsure whether any aspect of your food operations would require your establishment to be approved, please contact Newark and Sherwood District Council for guidance.

REGISTRATION OF FOOD BUSINESS ESTABLISHMENTS

All operators of food businesses must register their establishments with the District Council except establishments which are approved under Regulation 853/2004, or fall outside the scope of the Regulation 852/2004 or are engaged only in primary production activities.


There are no other exemptions from the requirement to be registered.

1: Applications in General

Food business operators should register their food business establishments with the District Council at least 28 days before food operations commence using the standard registration form

2:Multi-establishment Sites

2.1: Controlled by the same food business operator

The operators at sites on which there are two or more food businesses under the control of the same food business operator for example, in a shopping centre, must registered separately each establishment under their control.

2.2: Controlled by different food business operators

At sites on which there are two or more food businesses under the control of different food business operators, for example a café in a supermarket under the control of a different food business operator. The cafe will not be covered by the supermarket’s registration and must be registered in its own right by its operator. A cafe operated by the supermarket is covered by the supermarket’s registration.

3.:Lists of Food Business Establishments

The District Council keeps a list of the registered food business establishments available for inspection. The list contains:

1. Name of the food business

2. Address of the food business establishment

3. Particulars and nature of the food business

On request we may give or send a copy of the list or any entry on it to any person who makes a request subject to Freedom of Information and Data Protection legislation and our standard charge.

3.2: Referral from County Council Food Authorities

County Council Food Authorities will refer requests from the general public for information on registered food business establishments in their area to the relevant District Council Food Authority.


4: Action on Receipt of Completed Registration Form

4:1 On receipt of a completed registration form the Council will;

record the date of receipt on the form.


ensure that if there are any activities indicated on the form outside their enforcement remit, a copy of the form is sent without delay to the relevant competent authority.


enter relevant information from the registration form on to the database and lists of registered food business establishments.


place the registration form on a file prepared in respect of that food business establishment.

keep application forms relating to current businesses in a format that maintains their admissibility as evidence if required.

If any information is missing from a registration form the Council will either contact the food business operator or return the form to the food business operator for full completion.

On receipt of a completed application form, the Council will also consider carrying out an inspection of the establishment.

5.: Registration Certificates / Confirmation of Receipt

Certificates of Registration will not be issued because of the potential to mislead consumers that a food business has “official approval”.
On request we can confirm safe receipt of registration forms and entry of an establishment on to the list of registered food business establishments.

6: Changes to Activities After Registration

A food business operator must notify the Council of any significant changes of activities, or closure, preferably in writing before the changes occur, and in any event no later than 28 days after the change has occurred.

A new food business operator should notify changes to the operator of a food business establishment.

The Council will update the list of registered food business establishments and record the details on the file relating to that food business establishment.

7: Moveable Establishments

7.1: Ships, Aircraft, Trains and Coaches

Registration is only required if the establishment is fixed such as a floating restaurant. Food business operators must also register vessels under their control trade on inland waterways e.g. pleasure craft, with the Council in the area in which they are ordinarily kept.


7.2: Vending Machines

Vending machines are subject to the food laws but there is little practical value in the registration of individual vending machines or the premises on which they are sited if the only food related activity on those premises relates solely to vending machines.
7.3: Markets

In the case of vehicles and stalls (whether or not these stalls are provided by the controller of the market) used for transporting or preparing food or the sale of food to consumers within the area of a market, the food business operator should register the establishment with the relevant Council where their stocks of food are ordinarily kept
If the controller of a market is the provider of permanent units (establishments) (and not simply stalls) within a market, the food business operators operating their food businesses from those establishments should register each such establishment with the Council.


7.4: Movable Establishments Other Than Those Which Form Part of a Market or Operate Within the Area of a Market

Moveable establishments other than those which form part of a market or operate within the area of a market e.g. ice cream vans, hot dog vendors etc. should be registered by the food business operator with the Council in the area in which they are ordinarily kept.

8: Non-registered Establishments Subject to Regulation 852/2004 (Other than Primary Production)

The Council will ask the food business operator to complete a registration form and check that the food business establishment is operating in compliance with the food laws.
