PRE-QUALIFICATION OF INTERNATIONAL CONSTRUCTION CONTRACTORS

1.0  INTRODUCTION

1.1  Kuwait University (KU) is in the process of designing and constructing a complete New University City at their Shadadiyah Campus. The project site is located on the south-west side of Kuwait City and the site encompasses some 4.9 million square meters. The terrain is largely flat without any unusual topographical features requiring special consideration during the construction phase.

1.2  The objective of the project is to transform what is effectively a desert environment into a complete New University Campus, with all the features and facilities required to provide state of the art educational and support facilities for students, faculty staff and all other employees.

1.3  Kuwait University wishes to pre-qualify International Construction Contractors to participate in their future tenders for the University Projects. This pre-qualification shall be open to suitably qualified International Contractors.

1.4  The purpose of this questionnaire is to examine the records and resources of the general contractors wishing to be invited to tender for the construction works. This information will be utilized in an evaluation of the particular contractor’s expertise and ability to participate in the project. Contractors participating in this exercise will be required and expected to provide all the information requested. Information provided must be rendered accurately and openly.

Failure to comply may render the contractor’s prequalification liable for rejection. In this respect, KU reserves the right to have the data which is submitted, verified.

1.5  The Construction Strategy on the project does not intend that the whole of the project construction works will be awarded to any single contractor or contracting organization. Rather, the project will be sub-divided into construction Packages for tendering purposes, at the discretion of the Employer.

1.6  It could be that individual contractors will be allowed to bid for more than one Construction Package.

1.7  All contractors will be required and expected to liaise with the appropriate statutory bodies, the University Authorities and the University’s appointed Consultants. The contractor will be responsible to ensure that there will be no disruption to the activities of others engaged on or around the site.

1.8  The Contractors will be required and expected to take all reasonable measures at their disposal, to minimize disruption to traffic flow around the environs of the site and of Kuwait City in general.

1.9  The result of this pre-qualification exercise will be the development of a list of international contractors capable of taking full responsibility for the engineering, and construction of projects more than a value of KD 150 million, and to whom Invitations to Tender for the new projects will be issued.

Contractors to be engaged in the construction activities in the project will be required and expected to fully liaise and to cooperate with all other contractors on the project.

The result of this pre-qualification exercise will be qualifying two lists of capable international contractors who will be invited to participate in the new projects (1st Group & 2nd Group). Qualified companies of 1st Group (KD 150 million and above) are allowed to win unlimited number of Tenders. Qualified companies of 2nd group (less than KD 150 million) are not allowed to win more than two Tenders.

1.10  The International Contractor shall form a consortium / JV / Association with one or more of the local contractors.

In case of consortium / JV / Association with the local contractors, the selection must be from the list of qualified contractors by CTC, grade first or second of construction Category.

1.11  In case of participation in this pre-Qualification in the form of Consortium /JV/Association, the agreement showing this consortium should be attached. It should be signed by the authorized persons & attested by Chamber of Commerce & Industry of State of Kuwait.

1.12  The Consortium / JV / Association, should address the Central Tenders Committee / Kuwait University showing that the International Contractor is the leader of this Consortium / JV / Association and emphasize the full responsibility of the Consortium /JV/Associate before Kuwait University. The International Contractor shall perform at least 75% of the work (in value) in the contract and shall be responsible for furnishing Performance and other bank bonds under its name.

2.0  GUIDELINES FOR THE PRE-QUALIFICATION

Subject to the provision that Kuwait University is under no obligation to pre-qualify any applicant or to give reasons for acceptance or rejection, applicants shall be pre-qualified if they satisfactorily demonstrate the following to KU.

2.1  That the applicant is capable and prepared to take full responsibility for construction of projects from its inception, until the successful completion of such projects, including commissioning, maintenance and hand over of the completed facilities.

2.2  Applicant has a proven record of completing projects as described above, as the prime contractor, with full responsibility for the entire project.

The Applicant for Group 1, must have completed a minimum of two (2) projects with values of at least KD 150 million each.

2.3  Applicant for Group 2 (less than KD 150 million) has a current workload, which shows that the Applicant is presently active in the engineering and construction industry and that this workload is consistent with their current resources, manpower and financial standing. It must be confirmed that additional work of the magnitude being considered by KU, would not overstretch the Applicant's capability or resources.

2.4  Applicant is currently employing his own personnel and resources, which are of adequate quantity and expertise for KU and active in the engineering and construction industry. The Applicant will also need to show that he has access to additional personnel and resources if required, to boost the Applicant's capability in the event of award of work by the University.

3.0  CONDITIONS FOR AWARD OF WORKS

Invitations to Tender issued by CTC will be issued in accordance with the State of Kuwait's Law Number 37, regarding Public Tenders including any subsequent amendments thereof. This law requires that any bid submitted, which is not strictly in accordance with the Terms and Conditions contained in the Invitation to Tender shall be disqualified. Applicants are therefore advised that only companies who can accept the Client’s contractual terms, in full, should apply for pre-qualification.

The most important terms are:

3.1  Invitations to Tender for KU work requires that the Tender Price is a Fixed Lump Sum, and is not subject to change.

3.2  The contractor shall execute the project by supplying all materials, plants, labor and services necessary for timely completion of the works.

3.3  Time for completion will be completion will be determined by the University within the Invitation to Tender document. The contractor’s tender must be based on the stated contract period.

3.4  Liquidated damages will be applicable in the event of delay beyond the contract completion date. The calculation basis for liquidated damages varies depending on the nature of the project concerned.

3.5  The contractor will insure the Works to the full value with an 'All Risks' insurance policy for the duration of the contract.

3.6  Performance Guarantees as prescribed in the contract, shall be required.

3.7  The Governing Law of the contract will be the Law of the State of Kuwait.

4.0  INSTRUCTIONS TO APPLICANTS

4.1  The Applicant shall complete all parts of the questionnaire and provide the information in the English Language.

4.2  The Applicant shall be required to answer every question in this questionnaire.

4.3  Answers to questions and information supplied must be accurate and unambiguous. Additional pages may be inserted in the event additional space is needed for replying to the questions. Any additional information that the applicant wishes to offer, should be clearly separated from specific responses within the single bound document to be submitted. Do not include any company reports or other handouts of an advertising nature, unless they contain relevant and specific information as requested in the questionnaire.

4.4  The Applicant shall submit one original and five copies of the questionnaire and supporting information. The form and layout of questionnaire must be adhered to by the applicant.

4.5  The Applicant's submittal must be presented in six sealed envelopes in one box.

4.6  Pre-qualification questionnaire is divided into seven (7) sections as follows :

Section 7 - In addition to the above, the Applicant shall submit a covering letter by the Applicant’s authorized officer, and on the Applicant’s letterhead, as detailed under Appendix -1.

4.7  If the Company applying is a wholly owned subsidiary company, or part or group of companies, then the application must be for the company who shall actually perform any work awarded and in the location where that work will be performed.

4.8  No more than one application shall be considered from any group of companies, for each list of projects.

4.9  Pre-qualification shall be granted for the Applicant's company only, and shall not include pre-qualification of any parent, sister or subsidiary companies.

4.10  By submittal of an application, the Applicant agrees and shall permit the University to: -

a) Take any steps which KU considers necessary to audit or verify the Information contained in the application, and

b) Subject to visit the Applicant's offices and facilities wherever they may be located.

5.0  GENERAL

5.1  KU will retain all documents submitted by the Applicant for their records.

5.2  Subject to 4.12 above, KU will treat all replies in a strictly confidential manner.
