Primary/Secondary Vendors
The primary vendor will provide service to all users within the defined geographical regions, unless an agency seeks a DEG waiver, in which case the secondary vendor will become the service provider. DEG will only approve a waiver for using a secondary provider for reasons of service quality. In the event the secondary vendor is unable to deliver quality service or there is not an agreement with a secondary vendor, alternate vendors may be considered.

Authorized Users
Authorized users may purchase cellular services from this contract. The same terms and conditions apply with some price variations. Authorized user is defined as any county, city, village, town, school district, board of school directors, sewer district, drainage district, vocational, technical and adult education district, or any other public body having the authority to award public contracts (s. 16.70(8), Wis. Stats.).
Suspected Fraud (cloning)
Vendor account representative or Customer Support Center should be contacted as quickly as possible. If cloning fraud is detected a corrective course of action will be recommended (e.g., suspend service, replace telephone, change telephone number, etc.). Invoice will be credited if cellular fraud occurs.
Lost Or Stolen Telephones
Vendor account representative or Customer Support Center should be contacted as quickly as possible. A corrective course of action will be recommended (e.g., suspend service, replace telephone, change telephone number, etc.).
Local Number Fulfillment
In most cases, Vendor will provide cellular numbers that are local to user’s primary employment location. There may be a few exceptions, especially in rural areas.
Cellular Equipment
Basic equipment (handset, carrying case, headset, battery, AC adapter, DC adapter) provided at no additional charge remains the property of the Vendor. Vendor provides maintenance and repair. Vendor is responsible for removal and disposal of equipment they own throughout the term of the contract.
Users requiring equipment other than the basic equipment package may opt for a one-time basic equipment credit to be applied to the retail list price of alternate equipment. The credit is available only at the time of account activation. Equipment purchased by the State remains the property of the State with Vendor providing maintenance and repair.
Should the State of Wisconsin elect to extend the agreement from its original 3-year term, Vendor shall provide a one-time replacement of all equipment in use by State agencies and authorized users that has been in service more than 12 months as well as provide new
basic equipment for newly activated accounts. Replacement of equipment is at the discretion of the purchasing agency.
Reports
Agencies may request monthly inventory reports showing user name, user address, account number, cellular telephone number, agency name, activation date and site contact.
On-Line Support
Vendors will provide a State of Wisconsin exclusive web-based interface for secure on-line ordering of airtime and/or equipment. It will include pricing plans, equipment and
accessory pricing and training. Billing information may also be available. Development time may require at least 2 months.
Detailed Billing
This is to include line or package calling charge, additional non-standard features, date of call, time of call, call destination, call duration, airtime totals (divided by local, toll, roaming), roaming charges, monthly access charges, roaming access charges and miscellaneous charges and credits.
Liquidated Damages
For reports that are 5 days past the mutually agreed upon due date: $5 per day with a cap of $50 per report per occurrence, paid directly to the department. Yearly cap of $500 per each required report.
For failure to correct a properly disputed individual cellular telephone number invoice within two billing cycles: $10 per cellular telephone number, credited directly to the number’s account.
Optional Rate Package Pricing
Optional rate package pricing (regional or national plan) is available. There is flexibility to move between plans without penalty. Telecom Managers may contact Vendors for assistance with cost analysis. Telecom Managers may request DEG waivers to optional rate packages through Beth Ascher, .
