intestate and as such entitled to Waiver? in the lands in the bill named. But they have no knowledge of the Conveyance to the Complainant (sic) by said widow of her right of Dower and therefore neither admit or deny that any such assignment was ever made and required proof of the same. These Defendants being of tender years pray the court to protect their interest in this behalf.

And afterwards pat? the Term last aforesaid of said Court came the Complainant (sic) and also came the Defendants by their said Guardian ad litem and the said Complainant exhibited before the Court his proof of said assignment and the Court being satisfied that all of the right of said Widow to Dower in the real Estate of said Nathaniel Rigby decd in the bill named hath been conveyed to the Complainant by Deed duly executed and acknowledged by said widow. It is ordered and decreed by the court that the said Complainant have set off and assigned to him by metes and bounds one equal third part of said lands in the bill named to be held by him as tenant in Dower during the life of the said Jane Rigby Widow of said Intestate in the same manner and by the same tenure as the said Widow Would otherwise be entitled to hold the same were the same assignment to her and upon her petition. It is further decreed by the Court that an order issue to the Sheriff for the assignment of said Dower pursuant to this order and to the statute in relation to Dower. Commanding the Sheriff that by the Oath of three disinterested men of the vicinity who are not of kin to either of the parties interested he cause said Dower to be set off and assigned to the Complainant in manner aforesaid and this cause is continued until the next term for the further order of this court in the premises
And afterwards, to wit, on 23d day of March AD 1833 a writ of Dower issued from said Court directed to the Sheriff of the county aforesaid which is in the words and figures following, to wit,
The State of Ohio, Fairfield County
To the Sheriff of said County, Greeting:
on the petition of Horatio Evans showing to the Court that he was the assignee of Jane Rigby who was the Widow of Nathaniel Rigby decd and entitled to Dower in the real estate of the said Nathaniel decd to wit. in 100 acres of the SW quarter of Section No 7 in Town No 14 in Range No 19 beginning at the South West Corner of said quarter thence No 160 perches thence east so far that a line due South to the South line of said Section. Thence west to the beginning will include 100 acres. It is ordained by the Court that by the Oaths or affirmations of three men of your Bailiwick who are not of kin to either of the partiesPage 270
you set off the said Horatio Evens assignee of the said Jane Rigby the right of Dower of the said Jane
in the lands aforesaid by metes and bounds to be held by him during the natural life of the said Jane, so that he may have no more than one third part thereof having due regard to the quality and quantity of the same and have your proceedings therein before the said Court at the next term thereof.

And afterwards to wit at the May Term AD Eighteen Hundred and thirty three of said Court the Sheriff aforesaid returned into court the writ aforesaid with his return endorsed thereon, with the Report of Freeholder, assigning said Dower which return of the Sheriff is as follows, to wit:
The State of Ohio, Fairfield County
In Obedience to the Command of the foregoing writ I summoned Jacob Walter, Henry Kemp and Jacob Bucher all free holders in the county and caused them to appear on the foregoing described premises on the 28th day of March AD 1833 and then and there administered to them an oath in due form of law well and truly to discharge their duties according to the statues in such cases made and provided and after a careful examination of the said premises they have set off and assigned to Horatio Evans assignee of Jane Rigby widow of Nathaniel Rigby decd the Right of Dower as ordered and made their Report to me under their hands and seal and also a plat of the same is hereunto attached and mad a part of this Return.
Given under my hand and seal this 22d day of March AD 1833.

In pursuance of an order from the Court of Common Pleas for Fairfield County on the petition of Horatio Evans vs the heirs of N. Rigby. as assignee of Jane Rigby Widow of said deceased who is entitled to right of Dower He is Expicped? in said order. We the undersigned being summoned by the Sheriff of said County and being by him duly Sworn proceeded to set off to
set off to said Horatio Evans assignee of said Jane Rigby the Right of Dower in one hundred acres of Land. A part of the SW quarter of section No 7 Township No 14 Range No 19 which said One hundred Acres of Land is described as follows beginning at the S.W. Corner of said quarter Sect thence North 160 Perch thence east so far that a line due South

to the South Line of said Section and thence West to the beginning will include 100 acres which said tract of Land we have laid off as said right of Dower is off the North End of Said Original Tract - Containing thirty three acres and three hundredths (sic) of Land and particularly described by course and distance in the Within asculect? plat which is made a part of the report. Which tract of Land so set off is the one third part in quantity and quality of said original tract. which we respectfully submit at B the Fence running east and west near the south boundary of said Dower land to bee moved on said line as a line fence and is a part of our Report.

Whereas the Court of Court of Common Pleas for Ross County aforesaid have this day an application of Horatio Evans, a minor child about the age of fourteen years, and he having chosen the aforesaid Isaac Evans his Guardian and likewise having appointed the Said Isaac Evans Guardian to Magmus Barnhouse and Augustus Barnhouse Minors under the age of fourteen years and Ordered him to be enter as such.
Now the Condition of the above obligation is such that if the said Isaac Evans shall discharge with fidelity the trust reposed in him by Tendering an accurate statement of all his transactions with a just and true account of the profits arising and deliver up the same to the court, at such time as they require, then this Obligation shall be void. Otherwise to be and remain in full form and effect in Law. In Presence of Jno. M. Langham Isaac Evans, Samuel Swearingen, N. Douglas.
