RECOMMENDATION:

That the City Council, by Motion,

  1. Approve and authorize the Mayor and City Clerk to execute a consultant services agreement with ANAHEIM GATEWAY PARTNERS a Joint Venture (AGP-JV) for consultant services in an amount not-to-exceed $7,768,254 and increase the Department of Public Works FY 2009/10 revenue and expenditure appropriations accordingly;
  1. Waive Council Policy 4.1 and award the contract to the most qualified responsible bidder to provide Program Management Consultant services for the ARTIC Project; and
  1. Authorize the Director of Public Works to take such actions as are necessary to implement the contract on behalf of the City

DISCUSSION:

ARTIC Background and Project Description

In recent years the City of Anaheim (City), the Orange County Transportation Authority (OCTA) and other local, regional and federal agencies have dedicated extensive planning efforts toward advancing the ARTIC project from concept to reality. The ARTIC project, as planned, is important to the City and the region as it will:

·  Provide easy connections between the Platinum Triangle, Anaheim Resort, the southern California region and beyond;

·  Facilitate convenient travel via train, inter-city bus, taxi, car, or local transit; and

·  Accommodate high-speed train service infrastructure.

As we reach another set of milestones in the ARTIC planning, the City Council is being asked to approve another critical element in the ARTIC project planning: Selection of a Program Management Consultant team to perform program management services including but not limited to the management, administration and coordination of all stakeholders and project components from design and environmental to construction and commissioning of ARTIC Phase 1.

ARTIC Phase 1 will include relocating the existing Anaheim Amtrak/Metrolink station and supporting transit facilities to the ARTIC site. This relocation will facilitate the planned Metrolink Expansion Programand provide improved connections to other services such as fixed-route bus and bus rapid transit. Phase 1 will also include transit-oriented retail, mixed-use commercial development and civic space. Future Phases 2 and 3 are anticipated to encompass additional transit functionality improvements to accommodate new regional transportation services, high-speed rail and additional mixed-used development.

Procurement of a Program Management Consultant Team

The City and the OCTA agreed to develop the ARTIC Phase I (Initial Transportation Facility) as a traditional public agency-led, design-bid-build project. This approach has been initiated by the City with its procurement processes for the selection of the Architecture/Engineering (A/E) team and a Program Manager to oversee ARTIC Phase 1 from the design phase through the anticipated initial service in April 2013. Of recent, on May 26, 2009, an agreement between the A/E team of Parsons Brickerhoff/HOK and the City was executed for the design of ARTIC Phase 1.

On April 30, 2009, the City in partnership with OCTA, issued a Request for Proposal (RFP) to consulting firms with extensive experience in program management and construction management of high quality iconic transportation centers, sustainable developments, world-class architectural expertise, and outstanding experience in functional transportation. The procurement was widely distributed to local, national and international firms. The City received proposal responses from 7 teams on June 4, 2009.

An evaluation committee comprised of representatives from the Public Works Department, Public Utilities Department, City’s Urban Design Advisor and the OCTA, was convened. The committee evaluated the responses based on criteria that rated the firms’ overall qualifications and relevant experience in providing effective project manage & administrative oversight to multi-faceted project comparable to ARTIC Phase 1, references on projects similar in size and scope as well as experience with iconic elements. As a result of the evaluation process, a short list of Program Management Consultant teams was identified and those teams were invited to participate in the interview phase of the procurement.

Following the proposal submissions, the evaluation committee conducted interviews with each short-listed RFP respondent team that allowed each team to respond to a series of written questions, present their program management and administrative methodologies, highlight their RFP submittals and answer questions from the evaluation committee. Based on the proposal evaluations and interviews, the evaluation committee concluded that the Anaheim Gateway Partners, Joint Venture (AGP-JV) team clearly distinguished themselves as the most qualified and experienced team given the City’s evaluation criteria and objectives for the ARTIC Phase 1 program management consultant.

The AGP-JV team combines world class rail and transit facility experience of STV Construction, Inc., as evidenced in the success of the $450 million Houston Metrorail system and others, with the unparalleled construction management experience of Tishman Construction, as evidenced in the iconic MGM Mirage development, with the variety of highly technical professional engineering services provided by Harris & Associates in support of transportation infrastructure, rail systems, vertical buildings as well as iconic components such as the Disney Concert Hall project. The proposed total contract with AGP-JV is for a not-to-exceed amount of $7,768,254.00.

The AGP-JV Team is made up of 10 different consulting firms, all with the expertise to assist the City of Anaheim in managing, overseeing and delivering the ARTIC project. The major team members include STV Construction, Inc., Tishman Construction Corporation, and Harris & Associates.

In order to comply with Federal Transit Administration (FTA) procurement guidelines, waiver of Council Policy 4.1 is required. The selection criteria of the Brooks Act (as required per FTA) and Council Policy 4.1 are both qualifications based, except that the Brooks Act excludes the pricing component. The Evaluation Panel completed their evaluation of the proposals in compliance with FTA procurement guidelines for selection of this Program Management Consultant Team.

Co-Op Agreement No. C-9-0448

As background regarding funding for ARTIC Phase 1, on March 23, 2009, the OCTA Board approved the full funding request for ARTIC using Renewed Measure M Project T and other fund sources. Subsequently, on April 20, 2009, the OCTA Board approved the Regional Gateways Funding Plan for ARTIC. This comprehensive plan provides for $178.86 million as follows:

Cooperative Agreement C-9-0448 between the City and the OCTA defines the specific terms, conditions and funding responsibilities and was previously approved by the OCTA Board on May 22, 2009 and the Council on May 26, 2009. Authorization for the Director of Public Works to take such actions as are necessary to implement this contract on behalf of the City is also recommended to streamline the integration of this Program Management Consultant Team into the ongoing efforts of ARTIC Phase 1, thereby minimizing the length of its learning curve and maximizing the effectiveness of its efforts.

IMPACT ON BUDGET:

There is no impact on the General Fund. Funding for ARTIC Phase 1 is provided through previously approved and executed Cooperative agreement C-9-0448 with the OCTA and includes a variety of local, state and federal sources. The City and the OCTA are working collaboratively to match the timing of funding sources with project requirements for funding disbursements. In the event gaps between the timing of sources and uses should arise, a solution will be crafted that will not adversely impact the General Fund. This action by the Council will result in an increase in the Department’s FY 2009/10 revenue and expenditure appropriation of $7,768,254.00.
