  1. CALL TO ORDER
    Dr. Burrell, chairman, called the meeting to order at 6:30PM as a regular monthly meeting of the Board of Education. Greg Crawfordled the pledge of allegiance.

ELECTION OF BOARD OFFICERS

Dr. Burrell turned the meeting over to Mr. Foster, Director of Schools, who opened the floor for the nomination of board chairman. Jo WilliamsnominatedDr. Burrell to continue as board chairman, seconded by Rickey Rose. There were no other nominations. Dr. Burrellwas elected by unanimous vote.

Glenda Langenberg nominated Jo Williamsas board vice-chairman, seconded by Greg Crawford. There were no other nominations. Jo Williams was elected by unanimous vote.

  1. RECOGNITION OF GUESTS
    A. Elgin Foundation Dental Program – Dr. Darrel Clabough addressed the board regarding amobile dentistry service for AndersonCounty’s elementary schools. Currently the health department is serving two schools and the LearnCenter. They will also serve students in middle school and high school. Larry Foster said his staff looked at the program and felt it was a win/win situation for Anderson County students. According to Dr. Clabough, transportation is an issue in getting kids to visit the dentist. The state-of-the-art mobile lab will eliminate that problem by providing screening and services at school. Every child will be offered screening/service. If a child already has a dentist, they will be encouraged to continue to see their dentist. This program will help those with TennCare and the uninsured that are unable to find a local dentist for treatment. Motion by Steve Frittsand seconded by GlendaLangenberg to approve the request to proceed with dental screenings at Grand Oaks and Claxton Elementary Schools tomorrow (September 9, 2011) and to work out a contract with a committee and correlate through the health department and the dental association at a later date. Motion carried. Dr. Burrell asked that Dr. Clabough, Leisa Fair, Jim Stewart, and Dr. Joe Rainey be named to the committee.

VI.COMMENTS FROM THE CHAIR
A. Fall District Meeting – HardinValleyAcademy on September 20, 2011.
B. The TSBA annual convention will be held November 12 – 15, 2011.

C. The board will receive the TSBA Board of Distinctionaward and recognition at the October board meeting.

  1. The board agreed to move the October board meeting from Thursday, October 13, 2011 to Thursday, October 20, 2011 due to fall break.
  2. Karen Cupples, Fairview Elementary School principal, advised the board that SCORE (State Collaborative on Reforming Education) representatives visited her school this week to interview students, parents and staff in their effort to award the $10,000.00SCORE prize. Fairview is a finalist in the elementary school category. SCORE will award one elementary, middle and high school, and one district having the most dramatically improved student achievement.Ms. Cupples said she, the staff and students areexcited about being in the running for the award which will be announced at the LEAD conference on September 20, 2011.

VII. DIRECTOR’S REPORT

  1. Brad Pearman, ACCTC, reported Something Good going on at ACCTC. He said twelve students will participate in the LeadershipAndersonCounty program. They will work with students from CHS and the Anderson County Chamber of Commerce and attend classes to gain skills to help develop as leaders.
  2. Several teachers were awarded ORAU grants totaling $36,000.00.

  3. Jeff Harshbargerstated the IntegrationLearningAcademy is impacting all kids at his school in a positive way. He invited the board to visit at their convenience.
  4. Mr. Foster reported that he received a response to a letter written to TSBA at Dail Cantrell’s request to inquire whether or not a local chiropractor is qualified to conduct sports physicals for student athletes. TSSAA’s letter states “the only individuals designated in our bylaws to conduct and sign preparticipation medical evaluation forms are doctors of medicine, osteopathic physicians, physician assistants, or certified nurse practitioners. A Doctor of Chiropractic is not listed as one who meets our current guidelines.” The local chiropractor who is currently conducting physicals will hire a nurse practitioner to continue providing the service.

    The report was accepted as read.

IX. COMMITTEE REPORTS

A. Transportation Committee – Greg Crawford, chair, reported that a parent made a request to the committee to add a bus stop at his house for his children. The committee denied the request based on the fact that it could possibly slow bus transportation and that it might open the door for additional requests of this nature. Mr. Crawford said Joe Forgety briefed the committee on an unsafe bus stop on Edgemoor Road in Claxton and said he is working with the county highway department to get it fixed.

X.ACTION ITEMS
A. A committee meeting will be scheduled to discuss when the director of schools’ evaluation and board’s self evaluation will be held each year. TSBA will be contacted to determine if both can be done at the same time during a special called meeting. The annual agenda will be approved once this task is completed.

B. Motion by Jo Williams and seconded by Scott Gillenwaters to approve policy 4.503 Service Animals on second reading. Motion carried.

Service Animals In Schools

Anderson County Schools does not discriminate on the basis of disability, and complies with all state and federal laws, regulations, and rules regarding the use of service animals by students with disabilities under appropriate circumstances. (Individuals with Disabilities Education Act- IDEA, Section 504 of the Rehabilitation Act of 1973, TCA§62-7-112)

Service animal means any dog that is individually trained to do work or perform tasks for the benefit of an individual with a disability, including a physical, sensory, psychiatric, intellectual, or other mental disability. Other species of animals, whether wild or domestic, trained or untrained, are not service animals for the purposes of this definition. The work or tasks performed by a service animal must be directly related to the individual's disability Section 504 means section 504 of the Rehabilitation Act of 1973 (Pub. L. 93-112, 87 Stat. 394 (29 U.S.C. 794), as amended. .(ADA Title ll, 2011, 28 CFR §§ 35.104,28 CFR §§ 35.136,)

Possible exceptions – miniature horse. The ADAAA includes miniature horses as service animals. In compliance with ADAAA, the district shall make reasonable modifications to permit the use of a miniature horse if the horse has been trained to work or perform a task.

Requirements for Admission of a service animal. – The student’s need for and use of the service animal must be documented in the student’s individual educational plan (IEP) or Section 504 plan. The district may review existing documentation or evaluate the student’s disability and obtain documentation to determine whether the animal’s function allows the student to access the student’s IEP.

The district may offer alternative modifications to the use of a service animal, but the alternative must be effective in all of the functions that service animal performs with respect to the student’s disability.

Request- The district shall identify the administrative staff responsible for determining whether the service animal meet s the standards for acceptance in the school setting. If the animal is to be allowed in other locations, the handler must make a written request to the director of schools. These requests must be renewed each school year.

Behavior –The service animal must not interfere with theeducational process of any student and must not pose a health or safety threat to students, school personnel, or other persons.

Health – The animal must be in good health. The owner or handler must submit to the school principal each, year documentation from a licensed veterinarian the following; a current veterinary certificate of health; proof of the service animal’s current vaccinations and immunizations.

Control – A service animal must be under the control of its handler at all times. The service animal must have a harness, backpack, vest identifying the dog as a trained service dog, leash, or other tether, unless;

A) The handler is unable because of a disability to use a harness, leash, or other tether; or

B) The use of a harness, leash, or other tether would interfere with the service animal’s safe, effective performance of work or tasks, in which case the service animal must be otherwise under the handler’s control (e.g. voice control, signals, or other effective means).

Supervision and Care – The owner or handler of a service animal is responsible for the supervision and care of the animal, including any feeding, exercising, and clean up.

Transportation – The Coordinator of Transportation, the school principal and the animal’s owner shall be responsible for developing procedures to accommodate a student’s use of school transportation vehicles if necessary.

Damages to School Property – The owner or handler of a service animal is responsible for any damage to school property or injury to personnel, students or others caused by the animal.

Removal of Service Animals – A school administrator can require an individual with a disability to remove a service animal from school property under the following circumstances:

  1. The presence of the animal poses a direct threat to the health and safety of others;
  2. The animal is out of control or disruptive and the animal’s handler does not take effective action to control it;
  3. The animal is not housebroken; or
  4. The presence of an animal would require a fundamental alteration to the service, program or activity of the school system.

Any handler or student with a service animal who disagrees with a decision to remove, limit or exclude a service animal may appeal that decision to the director of schools. This appeal must be in writing and provide detailed information regarding the basis of the appeal.
