ESSA Assurances

The NH Bureau of Integrated Programs has issued the Integrated Programs’ Assurances and Equitable Services. Please confirm that the superintendent or school district executive has completed this document and ensures adherence to the Title III assurances and general provisions of the ESSA.

Title III Assurances
The Superintendent, on behalf of the LEA hereby assures the NH DOE that pursuant to the requirements in the Elementary and Secondary Education Act (ESEA), Title III, that the LEA will do the following:
____ Use Title III funds so as to supplement the level of Federal, State, and local public funds that, in the absence of such availability, would have been expended for programs for English learner and Immigrant children and youth, and in no way supplant such Federal, State, and local public funds. Title III section 3115(g)
____ Comply with Section 1112(e) regarding Parental Notification prior to, and throughout, each school year. Title III section 3116(b)(4)(A)
____ Comply with any and all State laws, including State constitutional law, regarding the education of English learner. Title III section 3116(b)(4)(B)
____ Assure consultation has occurred with teachers, researchers, school administrators, parents and family members, community members, public or private entities, and institutions of higher education, in developing and implementing the Title III plan. Title III section 3116(b)(4)(C)
____ Coordinate activities and share relevant data under the plan with local Head Start and Early Head Start agencies, including migrant and seasonal Head Start agencies, and other early childhood education providers. Title III section 3116(b)(4)(D)
____ Certify that all teachers in any English Language Development (ELD) program for English learners that is, or will be, funded with Title III are fluent in English and any other language used for instruction, including having written and oral communication skills. Title III section 3116(c)
____ Understand that by accepting Title III Immigrant Set-Aside funds, if applicable, to use these funds to support activities that provide enhanced instructional opportunities for immigrant children and youth and agree to comply with all associated program requirements. Title III section 3115(e)

General Education Provisions Act (GEPA)

The NH DOE Title III Office is responsible for ensuring that the school district or other local entity has submitted a sufficient Section 427statement. With state-formula grant programs from the United States Department of Education, a state needs to provide a description for projects or activities that it carries out with funds reserved for state-level uses. Local Education Agencies(LEAs) or other eligible applicants that apply to a State (SEA) for funding also need to provide this description in their applications to the state for funding.

Section 427 is not intended to duplicate the requirements of civil rights statutes, but rather to ensure that, in designing projects, applicants for Federal funds address equity concerns that may affect the ability of certain potential beneficiaries to fully participate in the project and to achieve to high standards.
