Instructions to Bidders
1.AnyandallbidsmustbedeliveredtoandreceivedattheLHCOffices,419 Cherry St. Lansing, MI 48933onorbeforethedateandtimespecifiedintheAdvertisementforBids.
2. Iffurtherinformationregardingthisbidisrequired,pleasecontactthe
LHCOffice at517- 487- 6550.
3.Thetermofthecontractwillbeforone(1)yearbutmay beextendedat theoptionoftheLHCforuptotwo(2) additionalyears.ContractcommencementshallbeJanuary 1,2013.
4. Bidderchangesoralterationstobiddocumentsincludingspecifications mayresultinabidbeingrejected.
5.Allbiddersareheldtobidpricesforninety(90)daysoruntil bid award, whichevercomesfirst,exceptthesuccessfulbidderwhosepricesshall remainfirmthroughcontractcompletion.Approvalandawardofabidshall notconstituteaformedcontract,andtheapprovalandawardofabidis contingentandconditionedonentryintoawrittencontractacceptableto theLHC.
6. Tothefullestextentpermittedbylaw,thesuccessfulbidderagreesto defend,payonbehalfof,indemnifyandholdharmlesstheLansing Housing Commission,Board of Directors,employees andothersworkingonbehalfoftheLHCagainstany and all claims,demands,suitsor loss, includingallcostsconnectedtherewith, andforanydamageswhichmay beasserted,claimedorrecoveredagainstorfromtheLHC,its Board of Directors, employees, volunteersor others working on behalf of the LHC,byreasonofpersonalinjury,includingwithoutlimitation bodilyinjuryordeath,and/orpropertydamage,includingwithoutlimitation damagetolawns,driveways,pavementand/orlossofuse,whicharises outoforisinanywayconnectedorassociatedwiththecontract,the performanceofworkunderthe contract,orotheractionsorinactionsof thesuccessfulbidderinconnectionwiththeservicesprovidedorwork performed.
7. Asuccessfulbiddershallprocureandmaintainforthetermofthecontract Worker's Compensation Insurance, CommercialGeneral Liability InsuranceandMotorVehicleLiabilityInsuranceinaccordancewith Bid Specifications.
Bid Specifications
1.DESCRIPTIONOFWORK
It istheintentof thesespecificationsto describethe requiredservicefor snow removal, shoveling andsaltingofcertainsidewalks inLHC properties.
LHCisacceptingproposalstoprovideservicescommencingwiththe2013-2014winter season.
ThesuccessfulBidderwillprovidesnowremoval, shoveling andsaltingservicesforthe followingsidewalks:Mt. Vernon Public Housing Development, La Roy Froh Public Housing Development, South Washington, Forest & Hoyt Public Housing Developments, Oliver Gardens Tax Credit Development, 310 Seymour, 419 Cherry St. and Hildebrandt Public Housing Development.
2.SCOPEANDGENERALREQUIREMENTS
LHCrecognizesthatthesnow removal, shovelingandsaltingisdependentuponthe weatherandassuch,thefollowingaregeneralrequirementsofLHCin termsofservicetobeprovided,whichtheBiddershallconfirmitsabilityand willingnesstocomplywithinitsproposal:
- ThesuccessfulBidder has to the ability to have snow removal crews on site within 30
minutes after a snow fall.
- ThesuccessfulBiddershallprovide snow removal from all,sidewalks,hillsandcurveswhen snowdepthreachestwo(2)inchesorgreater;provided,however,thatthe LHCreservestherighttochangethedepthofsnowrequiring removal.
- ThesuccessfulBiddershallapplysaltonlywhenitiseffectiveandsalt
applicationsshouldnotbeappliedinlieuofplowing.
- ThesuccessfulBiddershallprovidethenumberofemployeesnecessary to
completetherequiredworkinatimelyandefficientmannerduringall
snowevents.
- The successful Bidder shall have sufficient and fully operational
equipmenttoensurethattheservicesrequiredunderthecontractcanbe
consistentlymaintainedthroughoutthewinterseasonandshallattacha
listthoroughlydescribingsuchequipmentandthelocationatwhichitis
storedaspartofthebidproposal.
- Thesuccessfulbidder willbesolelyresponsiblefor all fuel,blades,
equipment,labor,insuranceandrepairs,andunitpriceswillbeinclusiveof all
costs andexpensesassociatedwith providingtheservicesand
complyingwiththecontract.
- Allemployeesmustbeappropriatelylicensedand/orregisteredbyorwith
theStateofMichigan,whererequiredbylaw.
- Allequipmentmustbevalidlyregisteredand/orlicensed byorwiththe
StateofMichigan,whererequiredbylaw,andclearlyidentifiedwiththe
companyidentificationmarkings.
- The successful Bidder shall not assign the contract or any of its
responsibilitiesunderitwithouttheconsentoftheLHC.
- ThesuccessfulBiddershallprovidemonthlyinvoices,by site, thatitemize
thework performedbydateanddetailinghours, equipmentandemployees
used.A proposedtimesheetthatwill beusedtotrackhours,employees
and equipmentmustbesubmittedwiththebid.
3.REQUESTFORCOSTSFORSERVICES
TheBiddershallprovideindividualpricingforsnow removal, shoveling andsaltingserviceoptionsasfollows:
Option 1: Fixed price for seasonal snow removal, shoveling and salting services.
The Bidder shall include separate pricing by site and by activity: 1. Hildebrandt, 2. Mt.Vernon,3. LaRoy Froh, 4. S. Washington which includes Forrest and Hoyt, 5. 419 Cherry St., 6. 310 Seymourand 7.Oliver Gardens
4. RESPONSETIME
ThesuccessfulBidderisrequiredtoknowwhentorespondtosnoweventsand determinewhetherconditionswarrantsnowremoval, shovelingand/orsaltingservicesto ensuresafedrivingconditionsduringpeaktraveltimes.
Inthecaseofmajorsnowaccumulation,thesuccessfulBidderwillprovideon goingservicesafterthestormtomakesurethatallofthesubjectroadsare clearedof snow.
5. SNOWREMOVAL, SHOVELING ANDSALTINGEQUIPMENT
TheBiddershallprovideacompletelistofallequipment,trucksandsizesthat willbeusedforperformanceoftheworkproposedinitsbid,andthelocation whereeachpieceofsuchequipmentisand willbestoredduringthetermofthe contract.
TheBiddershallprovideadescriptionofhowsnow removal, shovelingand/orsaltingserviceswill beprovidedandanestimateofthequantityofsaltrequiredonapertonbasisfor eachofthe followingscenarios:
1. Lessthan2inchesofsnowwithtemperatureabove20degreesFahrenheit.
2. Lessthan2inchesofsnowwithtemperaturebelow20degreesFahrenheit.
3. Morethan2inchesofsnowwithtemperatureabove20degreesFahrenheit.
4. Morethan2inchesofsnowwithtemperaturebelow20degreesFahrenheit.
6. INSURANCE
ThesuccessfulBiddershallprocureandmaintainatitsownexpenseduringthe termofthecontractandsupplyproofofthefollowinginsurancecoverage:
•CommercialGeneralLiabilityInsuranceonan"Occurrence Basis”with limitsofliabilitynotlessthan$1,000,000peroccurrenceand/or aggregate combinedsinglelimit,PersonalInjury,BodilyInjuryandPropertyDamage.
•OwnersContractorsProtectiveLiabilityInsurancewithlimitsofliabilitynot lessthan$1,000,000peroccurrenceand/oraggregatecombinedsingle limit,PersonalInjury,BodilyInjuryandPropertyDamage.TheLansing Housing Commission shallbe"Namedinsured”onsaidcoverage.
•MotorVehicleLiabilityInsuranceincludingapplicableNo-Faultcoverage’s, withlimitsofliabilitynotlessthan$1,000,000peroccurrencecombined singlelimitBodilyInjuryandPropertyDamage.Coverageshallincludeall owned,allnon-owned,andallhiredvehicles.
•Workers’ Compensation Insurance, including Employers’Liability
Coverage, inaccordancewithallapplicablestatutesoftheState of Michigan.
ThesuccessfulBiddershallnotcommenceworkunderthecontractuntilit hasobtained andprovidedtheLHCwithproofoftheinsurancerequired hereunderinamanneracceptabletotheLHC.Allcoverageshallbewith insurancecarrierslicensedandadmitted todobusinessintheStateof Michigan. AllcoverageshallbewithcarriersacceptabletotheCharter LHCofIndependence.
OnCommercialGeneralLiabilityand MotorVehicleLiabilityInsurance coverage,thefollowinglanguagemustbestated:theCharterLHCof Independence, Michigan,itselectedofficials,officers,employees,boards, commissions, authorities, voluntary associations, and any other units operatingunderthejurisdictionoftheLHCand withinappointmentofits operatingbudgetincludingtheLHCarenamed as additionalinsuredandsaidcoverageshallbeconsideredtobetheprimary coverageratherthananypoliciesandinsuranceorself-insuranceretention owned or maintained bythe LHC. This coverageshallbe primarytotheAdditionalInsured’s,andnotcontributingwith anyotherinsuranceorsimilarprotectionavailabletotheAdditional Insured’s, whetherotheravailablecoverageisprimary, contributingorexcess.
Workers'Compensation,CommercialGeneralLiability,OwnersContractors Protective LiabilityandMotorVehicle LiabilityInsurance,asdescribedabove, shallincludeanendorsementstatingsixty(60)daysadvancewrittennoticeof cancellationornon-renewalshallbesenttotheLHCDirector.
PriortoexecutionofacontractwiththeLHC,thesuccessfulBiddershall providetheLHCwithcertificatesofinsuranceand/orpoliciesfor the requiredcoverage’sinaformacceptabletotheLHC.
7.CAREANDDILIGENCE
TheservicestoberenderedbythesuccessfulBiddershallbeperformedina safe,competentandefficientmanner.ThesuccessfulBiddershallberesponsible fortherepairofanylawns,landscaping,mailboxes,drivewaysorotherproperty damagedduringsnow removal.Therepairsoflawns,landscaping,drivewaysandother propertydamage,exceptformailboxes,shallbecompletedonorbeforeMay1,2013.Damagedmailboxesmustbetemporarilysetupwithin24hoursoftheoccurrenceofdamageinordertoreceivemailandmustbepermanentlyrepaired on orbeforeMay1, 2014, May 1, 2015, and May 1, 2016. The LHCmay, initsdiscretion, withhold paymentsdueafterMarch1,2014, March 1, 2015, and March 1, 2016assecurityforthecompletionoftherepairs requiredunderthisparagraph.
The successful Bidder also agrees that any consumption before or during workinghoursordrivingorworkingundertheinfluenceofalcoholorcontrolled substancesbyitsemployeesisstrictlyforbiddenandshallconstitutegroundsfor contracttermination.
8.CONTACTPERSON
ThesuccessfulBiddershallprovide,inwriting,thename ofacontactperson (employeeorsubcontractor),aphonenumberandanemergencynumberthat theLHCshalluseforthedispositionofproblems.
9. CONTRACTTERMINATION
TheLHCshallreservetherighttoterminatethecontractuponthirty(30) dayswrittennoticeduetopoorperformanceorforanyreasondeemedtobein itsbestinterest.TheLHCwillbe solelyresponsiblefordetermining acceptableperformancelevels.TheLHCreservestherighttore-awardor re-bidthecontractinwhatevermannerisdeemedtobeinitsbestinterest.
10. BIDDER’S QUALIFICATIONS
TheBiddermustconfirmthatithasa minimumoffive(5)yearsofexperiencein snow removal, shovelingandsalting.
11.REFERENCES
TheBiddermustsubmitalistofatleastfive(5)references,preferablyat leastoneneighborhood andalargeplazaormallforwhichithasperformed similarservices.Thelistmustincludethereferringorganization'sname,contact person'snameandtitle,telephone number,email(ifavailable) andlengthof service providedtoreference.
12.TAXES
The successful Bidder shall be responsible for timely and fully paying all applicable federal,stateandlocalincome,business,property,payroll, unemployment,salesandothertaxes,assessmentsandlevies,andshallhold harmlessand indemnifytheLHCagainstanyliabilityforsame.
13.COMPLIANCEWITHLAWANDREGULATIONS
ThesuccessfulBiddermustcomplywithallapplicablefederal,stateandlocal laws,ordinancesandregulations,including butnotlimitedtoapplicable OSHA/MIOSHArequirementsandtheAmericanswithDisabilitiesAct.
14.1NDEPENDENTCONTRACTOR
ThesuccessfulBiddershallbeconsideredtobeanindependentcontractorand notanemployeeoragentoftheLHC.
15. SUBCONTRACTORASSIGNMENT
ThesuccessfulBiddermaynotsubcontract, assignordelegateservicesor responsibilities underthiscontractwithouttheLHC’s advance written consent.
16. EXCEPTIONS:
Whereanexceptiontoanyspecificationistaken,suchexceptionshallbeclearly indicatedandfully explainedbytheBidder.

The Bidder proposes to do all of the work defined in the proposal and
specificationsforthepricesstatedbelow.TheBiddercertifiesanddeclaresthat this
proposalwarrantiestotheLHCthefollowingitems:
1.TheBidderhasexamined andfullyunderstandstheinstructions tobidders, bidspecifications,andallotherdocumentsandaddendums thathavebeen suppliedaspart oftheLHC’s requestforproposals pertainingtothe2013-2014, 2014-15, 2015-16LHCSnowRemoval, ShovelingandSaltingProposal.
2.TheBidderacknowledgesthattheyareanindependentcontractorand no employee
ofthesuccessfulBiddershallrepresentoractasanagentofthe LHC.
3.The Bidderhasexaminedthestreetsandsidewalks and hasbecomefamiliarwithconditions surroundingthesnowplowingandsaltingrequirements.
4. TheBidderproposestofurnishalllabor,equipmentandmaterialsnecessary toperformthecontractrequirementsandagreesthattheratesareinclusive offuel, equipment,labor,insurance,repairs costsandallothercostsand expenses that are or may be associated or incurred by the Bidder in connectionwithperformingtheservicesasrequired.
5. Theworkwillbeperformedinaccordancewithallelementssetforthinthis proposal.
6. Thisproposalismadeingoodfaith andwithoutfraudorcollusion.
7. ThisbidisbasedsolelyupontheBidder'sownindependent experienceand businessjudgment.
8.TheBidderacknowledgesandagreesthattheinstructionstobidders, bid specifications,andallotherdocumentsandaddendumsthathavebeenorwill besuppliedaspartoftheLHC'srequestforproposalspertainingtothe2013-2014, 2014-2015, and 2015-2016 LHC Snow Removal and Salting Proposal shall be consideredanintegralpartofthisbidproposalandwillbemadepartofthe contract thatBidderherebyagreestoenter intowiththeLHCifawarded thisproject.
