O R D E R

The Delhi Medical Council examined the complaint of Shri Jal Singh which was referred by Govt. of NCT of Delhi. The complainant has alleged that his daughter Smt. Geeta was admitted under Dr. Pankaj Anand at Tirath Ram ShahHospital on 10.1.2000. He alleges that on 12.1.2000, Geeta was taken up for pus removal but Dr. Anand operated upon her and because of the surgery which was performed by Dr. Pankaj Anand, Geeta’s both legs got damaged and that Dr. Anand threatened him with dire consequences. He seeks direction from Delhi Medical Council to Dr. Anand to provide further treatment or else seeks compensation for further treatment elsewhere.

The Council examined the complainant, his witnesses, Dr. Pankaj Anand, Director of Tirath Ram Shah Hospital, documents on record and the relevant Radiological Investigations.

It has been established by the documents on record and the radiological investigations that Smt. Geeta was suffering from advanced Tuberculosis of the spine affecting from level D4 to level D11 with anterior epidural abscess leading to cord compression thus causing weakness of the limbs which was present prior to the surgery by Dr. Anand. The surgery done by Dr. Anand was after consent which is available on record. Surgical intervention as was performed by the operating surgeon was indicated in this patient. The patient did not have much recovery since the pre-existing disease process was fairly advanced.

The patient did not come for follow up after discharge and subsequently underwent another surgery for the same illness at G.B.PantHospital in December 2000. Dr. Pankaj Anand and the Director of the hospital have offered free treatment to the patient in the presence of the Disciplinary Committee of Delhi Medical Council.

There is no medical negligence on the part of Dr. Pankaj Anand in the management of his case. The Council directs that as per offer given by Dr. Pankaj Anand and Director of Tirath Ram Shah Hospital to provide free treatment to Smt. Geeta, further treatment to be provided by Dr. Pankaj Anand at Tirath Ram ShahHospital free of cost as per norms of the Hospital.
