The National Road Administration [Vägverket] hereby prescribes[1] the following pursuant to Chapter 11, Sections 11, 12 and 16 of the Vehicles Order [fordonsförordningen] (2002:xxx) and Section 11aof the Order (1993:1067) on electromagnetic compatibility.

Chapter 1. Introductory provisions

Section 1 These administrative provisions contain detailed provisions concerning the characteristics and equipment of vehicles as specified in the Vehicles Act [fordonslagen] (2002:574) and the Vehicles Order (2002:xxx).

The administrative provisions are applicable to tractors but not to vehicles converted to tractors.

The administrative provisions are not applicable to a new vehicle which has been type-approved in accordance with Directive 74/150/EEC and which has been provided with a type-approval mark and is accompanied by a valid certificate of compliance in accordance with the templates contained in the annex to the directive. However, the administrative provisions are applicable once an EC type-approved vehicle has been taken into use.

Section 2 In the case of a vehicle which is lawfully manufactured or marketed in another Member State within the European Economic Area, approval may be submitted in connection with registration inspection provided that the vehicle fulfils the national administrative provisions in the Member State for areas not covered by harmonised rules and that the National Road Administration can establish that the Member State’s administrative provisions concerning requirements for equipment and checks on this offer a level of protection which is equivalent to that provided by the requirements contained in the present administrative provisions.

Section 3 Unless otherwise specified, the designations used in the present administrative provisions have the meaning specified in the Act (2001:559) on road-traffic definitions [lagen om vägtrafikdefinitioner], in the Order (2001:651) on road-traffic definitions [förordningen om vägtrafikdefinitioner], in the Vehicles Act (2002:574) and in the Vehicles Order (2002:xxx).

Section 4 When applying requirements pursuant to EC directives or ECE regulations to new vehicles, the latest version of the directives or regulations shall be used.

When applying requirements pursuant to EC directives or ECE regulations to vehicles which have been taken into use, the version of the directive or regulation which was current at the time the vehicle was first taken into use shall be used unless otherwise specified.

Section 5 Where the term “be type-approved” is used in these administrative provisions, it means that a component, a system, a separate technical unit or vehicle type with respect to installation of a separate technical unit or component is of type-approved design in accordance with EC directives, ECE regulations or the National Road Administration’s administrative provisions.

Where the term “fulfil the requirements” is used in these administrative provisions, it means that a component, a system or a separate technical unit has been tested in accordance with EC directives, ECE regulations or the National Road Administration’s administrative provisions and has been found to fulfil the requirements specified therein [type approval in accordance with or included in the above]. The procedure for verifying compliance with requirements is specified in the National Road Administration’s administrative provisions on ... inspection ... , Chapter x. Section y (VVFS 2003:xx).

Section 6 References to standards and provisions in the present administrative provisions are based on a survey carried out when the requirement contained in the administrative provisions was first laid down and does not necessarily mean that the standard or the provision cited is the latest version.

Section 7 When checking that requirements made of vehicles pursuant to the present administrative provisions have been fulfilled, the vehicle must be standing on a level, horizontal surface and be in normal driving condition for the service weight unless otherwise specified.

Chapter 2. EC directives

Section 1 Directives in accordance with Sections 2–26 are applicable with regard to the characteristics and equipment of vehicles to the extent prescribed in Chapters 4–28. The reference to the basic directive also covers the amending directives as specified in the respective points of the present chapter.
