5.1Maintenance of Effort

Director Wendy Pound presented information regarding a Maintenance of Effort issue. Director Pound received a call recently from CDE stating that OSAP had contacted them about a MOE that was not met by the Belleview School Districtin 2008-2009. At the time, Belleview was in declining enrollment, and the decision was made to reduce the time for the Special Education teacher. Tami Ethier, CBO at Belleview at that time, tried to explain the reduction in costs in the MOE document, but there was still a shortfall. Belleview’s understanding was if the SELPA as a whole met the MOE, then the shortfall would not be a problem. In 2012 CDE and others still felt the situation was within satisfactory parameters. Now, however, the federal government wants the money repaid. The amount in question is $7293.76.

This year, CDE contacted the SELPA and said they need to invoice the district, see the policy, and determine who will pay, district or SELPA. The documents were sent. We are currently waiting for the invoice.

There was some discussion among the board regarding whether the district should pay or the SELPA should pay. Whatever they decide, it was pointed out, will set precedent for the future.
