Forfull StateAidinformationreferto theBIS guidance:

TheDeMinimisregulationallows MemberStates to givecomparatively smallamounts of support uptoacertainlimit, whichmay bepaidforalmostany purpose,aslongas itmeets all of theconditions setout intheRegulation. Priornotificationandapprovalarenotnecessary as longas therequirementsof theregulationaremet.

Legalbasis forDeMinimis is theCommissionRegulationontheapplicationof Articles 107and108of theTreaty ontheFunctioningof theEuropeanUnion to aid.

DeMinimis aidis usedto describesmallamounts(€200,000over a3 yearfiscal period)(€100,000 intheroadfreight transportsector)of supportwhichcomplieswiththeDeMinimis. 4.3TheEuropeanCommissionconsiders thatpublic fundingwhichcomplies withtheDeMinimisregulationhasa negligibleimpactontradeandcompetition,anddoesnotrequirenotificationandapproval.

DeMinimis canbegivenformostpurposes, includingoperatingaid, and is notproject-related:

ThemaximumDeMinimis fundingany singlerecipient can receiveis €200,000(cashgrant equivalent)over a 3-yearfiscalperiod. Youmust takesteps to ensurethelimit is not exceededandthat you candemonstratethis,hencethis form.Theroadfreight hiresectorhas a limitof€100,000.

Thesterlingequivalent is calculatedusingtheCommissionexchangerate(Seejournalexchangerate offerof DeMinimis funding.

Theaboveceilings apply tothetotalamount of DeMinimisaidtoasinglerecipient fromall sources ofDeMinimis aid.

WheretheDeMinimisthresholdis exceeded,youmustuseTrainingAid.

Legalbasis forthe(TrainingAid)GeneralBlock ExemptionRegulation(GBER)is theCommissionRegulation EUNo. 651 / 2014declaringcertaincategoriesofaidcompatiblewiththeinternal market in applicationof Articles 107and108of theTreaty (Generalblock exemptionRegulation).

Thepromotionof trainingconstitutesacentral objectiveof theeconomic andsocialpoliciesof theUnionanditsMemberStates.

Trainingusuallygeneratesbenefits forsociety,increasingthepoolof skilledworkersandimprovingthecompetitiveness of industry. Aidtopromotetraining is thereforeexemptedfromthenotificationrequirementundercertainconditions. Inlightof theparticularhandicaps thatSMEsface andthehigherrelativecosts they mustbearwhenthey invest intraining, theintensities ofaidexemptedbytheGeneral Block ExemptionRegulation(GBER)areincreasedforSMEs. Additionally, theintensitiesofaidexemptedarefurtherincreased if thetrainingis given todisadvantagedworkersorto workerswithdisabilities.

TheGBERcoversaidupto €2millionpertrainingproject providingcertainconditions aremet. Anyindividualaidwith a grant equivalentexceeding€2millionpertrainingproject mustbenotifiedtotheCommissionforpriorapproval. Aidcannotbegrantedfortrainingwhichis carriedouttocomply withnationalmandatory standardsontraining.

EligibleCosts andAidIntensities.Theeligiblecosts shall bethefollowing:

(a)) Trainers’personnel costs, forthehoursduringwhichthetrainers participateinthetraining;

(b)) trainers’andtrainees’operatingcostsdirectlyrelatingtothetrainingprojectsuchas travelexpenses,materials andsupplies directly related totheproject, depreciationof toolsandequipment, tothe extentthat they areusedexclusivelyforthetrainingproject. Accommodationcostsareexcludedexceptfortheminimum necessary accommodationcosts fortraineeswhoareworkerswithdisabilities;

(c)Costs of advisoryservices linked tothetrainingproject;

(d)) Trainees'personnel costs andgeneralindirect costs(administrativecosts,rent,overheads)forthehoursduringwhichthetrainees participatein thetraining.

Theaidintensitymustnot exceed50%of theeligiblecosts. It may beincreased,upto amaximumaidintensity of 70% of theeligiblecosts, asfollows:

(a)) By 10percentagepoints if thetraining is given toworkerswithdisabilitiesordisadvantagedworkers;

(b)) By 10percentagepoints iftheaid is grantedto (51to 250employees)medium-sizedenterprises andby 20percentagepointsif theaidis granted tosmallenterprises (less than50employees);

Note:

  • Thevalueof theaidmaynotbethevalueof thefundingprovidedbytheSkills FundingAgency.It shouldbethecost of providingthetraining,as shownaboveundereligiblecosts.
  • Wheretheaidprovidedwillbe50%of thecosts of training, forexample, theemployerwillneed to provideevidencefortheremaining50%of thecosts throughtimesheets of thelearnerandconfirmhourly rates.
  • Evidence of theenterprise’s contributionmust besignedbytheemployerandretainedby theprovider.Youmust refertothefull textof theregulation:
