Vertical Housing Program OAR 813-013-0001
There are 2 components in the Vertical Housing Program, the Zone and the Project.
The Zone
Before a jurisdiction, (i.e. a city or county), can propose a Project, a Zone must be established. The Zone can be a single tax lot, a parcel of many adjoining tax lots, or a large portion of a city’s urban core/area.
Examples:
· The City of Hillsboro is a good example of a jurisdiction that has established numerous Zones to satisfy specific Projects.
· The City of Tigard is an example of a jurisdiction that has established a large portion of their urban area as a Zone. Tigard made the decision to establish an entire geographic area prior to any interest of a specific site for a development.
The Process
Zone Application - (example, City of Tigard Zone –VHDZ-22)
· Upon receipt of the Zone Application create and name a new zone folder. Save a zone application review form (Program Management >Vertical Housing Program>Zone Information>Zone App Review Form) to the new folder. Insert the date received in the box at the upper left of the review sheet. Complete all the contact information. Check the application to verify which documents have been received. Contact the applicant for any missing items.
· When you entered the application receipt date note that the 45 day period for tax districts to opt out of the exemption was filled as well as the 60 day review period.
· By the 60th day you should have received all the required application materials, including the Opt Out districts, if any. Remember to update the ZONE Tracking Log (Program Management >Vertical Housing Program>Zone Information Zone Tracking Log).
· Provide the completed review sheet to the Manager for her approval, edits or corrections.
· When all the required application items have been satisfied, contact the County Assessor with the “Notice of Certification of a New Vertical Housing Development Zone”, example/template provided (Program Management>Vertical Housing Program>Zone Information). Note that this letter is CC’d to the Department of Revenue, the contact at the jurisdiction applying for the zone, and the appropriate Housing Integrator.
The Project
· In most instances the Zone is created for a specific Project. Developers may have already prepared the site. As mentioned, Tigard is an example of a jurisdiction that has chosen to create a Zone prior to receipt of an application as an open incentive for development.
The Process
Project Application –(example, project A in Beaverton. This project also has a live/work component.)
· Upon receipt of the Project Application create a new project folder (Program Management >Vertical Housing Program>. Save an application review sheet to the new project folder. Check the application to verify which documents have been received. The application should include all the items noted down to the Calculation of Equalized Floors on the review sheet. Contact the applicant for any missing items. Assemble a project folder for all the documents. (See an existing file as an example.) Maintain an electronic file as well as a paper file.

· The Calculation of Equalized Floors is a calculator located with the application materials on the web site and is also located at Program Management>Vertical Housing Program>Project Information>VHDZProjCertSummBldg.xls. The developer will provide a completed calculator with the application prior to the construction of the Project. (Keep in mind that at the end of the project final square footage may change requiring verification and a new calculator).
· Prepare Letter of Conditional Confirmation for the developer along with a sample PUA. Send the developer a clean copy of the Project Use Agreement (PUA) (Project Management>Vertical Housing Program>Project Information).
o Send a copy of the CCDC to:
§ The City administrator (they need a heads up ex. the developer tries using multiple incentives that the city limits places limits on how many programs/incentives can be used on a single project.
§ County Assessor
§ DOR
· Once the Certificate of Occupancy is submitted by the applicant (as mentioned and required in the CCDC to submit) the completed PUA must be signed and notarized by OHCS and the developer/owner. After the PUA has been recorded, have escrow return the original to the file at OHCS.
· Prepare the Project Final Certification and the VHD Certificate (Project Management>Vertical Housing Program>Project Information>VHD Certificate template-new logo). Cc the Assessor and the Department of Revenue.
