Conditions Precedents, Guarantees and warrantees related to contract for providing generator services:

  1. Separate tenders will be required, if applying for more than one branch.
  2. Counterfoil of the receipt obtained by depositing requisite amount is to be enclosed with the tender document.
  3. ID Proof, Address Proof, Copy of PAN card, Aadhar, Voter ID etc. must be enclosed with the application.
  4. Tenders for only new threephasesilent generators of 50 hertz 220 volts with 10 KVA to 20 KVA capacities (30-KVA capacity for Deoghar Main Branch) will be accepted.
  5. The vendor will be bound to provide Generator Services between 10 A.M. to 7 P.M. on all working days of the bankat the normal monthlyrent as per bid by the successful bidder or mutually agreed by the Bank with the L1 vendor; and the Vendor would also be bound to provide generator facilities at all timesas per requirement of the bank, ( i.e. on 24x7x30x365 basis) even beyond the normal office hours of the bank including on Sundays and Holidays–at hourly rentas per bid by the successful bidder or mutually agreed by the Bank with the L1 vendor.
  6. Vendor will be bound to provide immediate uninterrupted electric supply even In case of short supply or low voltage of electricity supplied by State Electricity Distribution Company without any extra charges during normal office hours of the bank, and at hourly rent agreed upon with the Bank beyond normal office hours. There should not be wide fluctuations in the output of the generator set.
  7. All arrangement for fuel, labour, lubricant, operating and maintaining costs, repairing & maintenance charges will be borne by the vendor. Vendor will have to abide by the Minimum Wages Act regarding payment of wages to generator operators, and also with all other laws, rules and regulations, whether present or future.
  8. TDS, or any other Taxes or levy will be deducted at source as per law and will be borne by the vendor.
  9. The Vendor has to make his own arrangement for placement and fixation of the generator set, the cabling up to the main switch. Any rent, Taxes etc., if levied by municipality, town committee, Gram Panchayat or any other local authority, will be fully borne by the vendor, and the bank will not be liable or responsible in any way in this regards.
  10. Vendor hasto himself arrange any NOC, permission or license, if applicable, as per law, from local municipality, town committee, Gram Panchayat or any other local authority, State electricity generation or distribution company/department or from pollution control board and will have to incur all related expenses and charges whether by way of license fee, rental or any other name etc.
  11. Safety security of the Generator Set and its operator will be sole responsibility of the vendor, and the vendor will make arrangements for firefighting equipments near the generator set to handle any eventuality, exigency or emergency.
  12. In case of breakdown of machine the vendor will be bound to make immediate alternative arrangement and if generator service is not available for more than half an hour for any reason what so ever, Bank will be free to make its own alternative arrangement for which the entire cost of such alternative arrangement with penalty of Rs. 2000/- per occasion will be borne by the vendor.
  13. Any act of omission or commission on the part of the vendor, or by any of his/her agent, contractor, engineer, technician or employee which causes damage or loss to Bank’s property, or to life or property of any third person has to be fully compensated by the vendor. Any law suit, whether civil, criminal or tortuous, relating to any such malfeasance or misfeasance by or on behalf of the vendor will be defended by vendor himself, without involving bank in any way, and if the bank is made party to any related dispute the same will be defended by the bank at the cost and expenses of the vendor and the vendor will be bound to fully compensate the bank in this regard including reimbursement of any compensation paid by the bank as a result of such dispute, whether legal or quasi judicial. In such circumstance, the Bank will also be at liberty to cancel the arrangement without any notice to the vendor.
  1. The contract for providing generator services under this tender will be for a period of three years and during the currency of the contract period, no variation will be made in monthly or hourly rent due change in cost of fuel, lubricants, spares, labor cost, repairing or maintenance charges, or change in any tax rates etc. However, If for any reason generator services cannot be availed by the bank e.g. due to closure or shifting of the branch or due to any directives or order of the Government, RBI or Bank for the implementation of green /renewable energy norms etc., the agreement / contract under this tender will stand automatically cancelled without any future rent or compensation to the vendor.
  2. In case of tie, the land lord of the branch premises or if the tie is not with the land lord of the branch premises any other Local vendor will be preferred.
  3. The Bank reserves the right to change the terms and conditions of this tender notice at any time before the tender opening date, and afterwards with mutual consent ofL1 vendor.
  4. The Bank also reserves the right to further negotiate with the L1 vendor for further reduction of monthly/per hour rent, or for better terms and conditions in favour of the bank.
  5. Within a week of receipt of acceptance of bid, Successful bidders will have to deposit security by way of caution/retention money at the rate of Rs. 15000 for 10 KVA, Rs. 20000 for 15 KVA , Rs.25000 for 20 KVA and Rs. 35000 for 30 KVA Generator in the form of FDR issued by any branch of Allahabad Bank which will be held by the bank under its lien for the entire tenure of the contract, and may be adjusted as per clause 11 above in case of any default by the vendor.
  6. The Bank further reserves the right to cancel any or all tenders and stop the process at any point of time without assigning any reason or notice whatsoever.
  7. Loan facility may be availed by any vendor for providing generator services to the bank under this tender notice, subject to fulfillment of terms and conditions of the bank and the scheme under which loan is applied. However, the two transactions, and contracts/agreements there for will be treated totally independent and separate and will not form the basis for one another.
