Conditions of Sale

In these conditions, BA means Bryanston Auctioneers

1)  The highest bidder shall be the purchaser. Should any dispute arise between 2 or more bidders, the auctioneer shall at his discretion either declare the purchaser or re-auction the disputed lot. The auctioneer’s decision in all circumstances is final.

2)  BA shall have full discretion to refuse any bidding, to divide any lot, to combine lots and to withdraw any lot from auction without giving any reason.

3)  All lots are sold voetstoets. Care is taken to ensure that any statement as to origin, date, age, attribution or condition is reliable and accurate, but all statements are statements of opinion and are not to be taken as statements or representations of fact. A bid shall be taken as proof that the buyer has made him/herself acquainted with the lots on which he/she bids.

4)  The auctioneers Vendue Roll is final and no dispute shall be taken into consideration as to the correctness of same.

5)  All accounts must be paid immediately at the conclusion of each sale.

6)  Payment by ONLY bank guaranteed cheque, credit card, debit card and via internet / bank transfer. No cash will be accepted at the place of auction.

7)  All lots knocked down remain the risk of the purchaser. The removal of any lot purchased will be at the risk and expense of the purchaser.

8)  All lots must be removed within 72 hours of conclusion of the auction. If not removed within 72 hours, 10% of the purchase price will be levied per week for storage costs.

9)  Ownership of the goods vest with BA until payment is received in full.

10)  A 15% buyers premium will be levied on the hammer price.

11)  A 3.5% premium will be levied on all debit and credit card transactions.
